The subdivision plan "approval required" was filed prior to the 1973 zoning approval for this area which upgraded zoning to one (1) acre. The finally approved subdivision in 1973 has a seven (7) year protection period to 1980. Lot 14 (locus) was last owned in common with surrounding lots in 1976; see Certificate of Title No. 7214 attached. On January 16, 1979 Lot 14 was transferred to John E. Colahan, see Certificate of Title No. 77009 who transferred ownership to Warren F. Averill and Mary Averill on May 15, 1999; see Certificate of Title No. 120503-the present owners. The only abutting lots are Lot 13 and Lot 28 on Land Court Plan 36319C, being assessor's Map 39, Parcels 82 and 97. Lot 13 on Land Court Plan 30319C was conveyed out of Certificate of Title No. 72174 to Carol Ann Eliad; see Certificate of Title No. 80360 on December 14, 1979. She conveyed to Kostantin Eliadi and Carol Ann Eliadi, see Certificate of Title No. 108276 on October 6, 1986. They conveyed to Carol Ann Eliadi; see Certificate of Title No. 133887, dated May 23, 1994. She conveyed to Lawrence Goldman, the present owner, see Certificate of Title No. 147406.
