Residence F, Resource Protection Overlay District Hearing Date: November 18, 2015 Recording Information: Deed: Book 11816 Page 235 Plan: Book 178 Page 151 (Lot 17) Background In Appeal No. 2015-027, Russell &Judith White sought to.transfer Special Permit No. 1993-17 into their names and to modify the permit to allow them to continue to lease the commercial portion of the property for retail sales. The subject property is an approximately half-acre parcel on the corner of Falmouth Road/Route 28 and Windmill Lane in Cotuit, improved with a 4,612 gross sq.ft (2,440 sq.ft living area) structure that contains a commercial storefront facing Route 28 and a residence to the rear.. There is also a detached garage, constructed in 1999. Prior to 1983,the site was zoned BL-C,which allowed "small retail businesses common to a residence district". The property was the site of a hardware store. Commercial use of the property became nonconforming when the property was rezoned to RF in 1983. In 1984, a Special Permit for a 576 sq.ft expansion of the hardware store, then a pre-existing nonconforming use, was granted pursuant to an Agreement for Judgment. 1n 1993,. the Board granted Barbara Irving, Judith White's (the Applicant's) mother, a Special Permit to change a nonconforming use to another nonconforming use. Special Permit No. 1993-17 allowed use of the property for "the sale of antiques" and a residential home. That permit was granted subject to twelve conditions,the first of which reads: 1. This Special Permit is issued to the applicant for the sale of antiques, at this site. It is not transferable to another person or.for another retail sales activity without first being approved by the Zoning Board of Appeals. Barbara Irving passed away and in 1998, Russell and Judith White took sole ownership of the property. Since that time, the commercial portion of the property has continued to be used for the sale of antiques, clothing, and other items on consignment. Russell and Judith White occupy the residence on the property and lease the commercial space. The Special Permit was never transferred to reflect the change in ownership. Procedural & Hearing Summary Special Permit application No. 2015-055 for the transfer of Special Permit No. 1993-17 and the continuation of the preexisting nonconforming retail use was filed at the Town Clerk's office and office of the Zoning Board of Appeals on October 23, 2015.- A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties-in accordance with MGL Chapter 40A. The I Town of Barnstable Zoning Board of Appeals—Decision and Notice Special Permit No.2015-055—White hearing was opened on November 18, 2015 at which time the Board found to grant the special permit. subject to conditions. Board Members deciding this appeal were Brian Florence, Alex Rodolakis, George Zevitas, David A. Hirsch, and Robin Young. The Applicants, Russell and Judith White, represented themselves before the Board. Mr.White explained the previous ownership, how they came to own the property, and the current use. He indicated the discrepancy regarding the Special Permit arose when they sought to install an additional bathroom on the main floor. The Board Chair requested public comment and no one spoke. Findings of Fact At the hearing on November 18, 2015,the Board unanimously made the following findings of fact in Special Permit Application No. 2015-055, a request to transfer and modify a special permit for a preexisting nonconforming retail use: 1. In Special Permit Application No. 2015-055, Russell and Judith White seek to transfer and modify Special Permit No. 1993-17 into their names and to continue to use the property at 4015 Falmouth Road (also 12 Windmill Lane)for retail sales and a residential dwelling. 2. Massachusetts General Law Chapter 40A Section 14 provides the Zoning Board of Appeals authority to modify orders and decisions in conformity with the provisions of said Chapter. 3. The existing use the property for retail sales is a lawful preexisting nonconforming use. It was established in accordance with Business Limited-C Zoning in effect prior to 1983. The Zoning Board authorized a change in the nonconforming use with Special Permit No. 1993-17 to allow retail sales of antiques. 4. There is no square footage expansion of the retail sales area proposed. The use is located on the same lot and in the same location as when it became nonconforming. 5. After an evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. There will be no substantial change to the use of the property. The use and development of the property has continued in compliance with the conditions of Special Permit No. 1993-17. 6. The transfer of the permit and the continuation of retail sales on the property will be no more detrimental to the neighborhood than the uses permitted with Special Permit No. 1993-17. The use and development of the property will not change as a result of the transfer of the permit. The vote to accept the findings was: AYE: Brian Florence,Alex M. Rodolakis,George Zevitas, David A. Hirsch, Robin Young NAY: None Decision Based on the findings of fact, a motion was duly made and seconded to grant Special Permit No. 2015-055 subject to the following conditions: 1. Special Permit No. 2015-055 is granted to Russell &Judith White to allow retail sales in the commercial portion of the existing building at 4015 Falmouth Road/Route 28, in addition to the one-family residence at 12 Windmill Lane, Cotuit. 2. The retail use of the property shall be limited to retail sales of specialty items, including antiques, clothing, furniture, and home accessories, new or on consignment. Retail sales of automobiles, restaurant/food service uses, retail sales of gasoline,and convenience stores are prohibited by this permit. 2 Town of Barnstable Zoning Board of Appeals-Decision and Notice Special Permit No.2015-055-White 3. The number of commercial tenants on the property shall be limited to one. 4. The retail.and residential uses shall operate within the existing structure. No expansion of the retail sales floor on the property shall be permitted without proper permissions from this Board. 5. Site access shall be limited to Windmill Lane;direct access to the property from Route 28 is prohibited. 6. Hours of operation of the retail use shall be limited to 10:00 a.m.to 6:00 p.m. Monday through Saturday;and from 12:00 noon to 5:00 p.m.on Sunday. 7. Signage shall be limited to one sign and a trade flag in conformance to the Sign Code. 8. The placement of other objects to attract customers within the front yard areas of the building is prohibited. All sales and display of merchandise shall be contained within the structure. 9. Parking for the property shall be prohibited on Windmill Lane. 10. No more than three (3) people shall be employed on the site. 11. This decision shall be recorded at the Barnstable County Registry of Deeds and copies of the recorded decision shall be submitted to the Zoning Board of Appeals Office and the Building Division for this special permit to be in effect. Backgrounds This decision concerns the petition submitted by Attorney Michael D. Ford on behalf of the applicant Barbara Irving, requesting a special Permit to allow a change in a non-conforming use. The applicant is seeking to permit retail sales: of antiques and residential use of the site and structures, commonly addressed as 12 windmill Lane, Cotuit, MA. According to the Assessor's Records, the lot is 0.47 acres, `and is developed with two attached structures. one is 28, X 401, the other 36, X 161. They are 1.5 and 2 stories high. The previous use of the structures and site was for the Cotuit Hardware, and was granted by special Permit #1984-31. Presently the buildings and site is vacant. Procedural Summary: The application was. filed in the offices of the Town .Clerk and at the zoning Board of Appeals office on February "11, 1993. A public hearing duly noticed,.under M.G.L. Chapter.40-A was opened on March' 11, 1993, at which time the. hearing was closed and a decision was rendered by the Board. The petition was heard by Board Members: Ron Janson, Elizabeth Nelsson, Eugene Burman, Emmett Glynn and Chairman, Richard Boy. Appeal .No. 1993-17 Decision and Notice Attorney Michael D. Ford represe_nt_ed the_petition before the Board. He presented a memorandum in support of the appeal to the Board and initiated his presentation with a short description of the building and site. He�ctedYthat=the-buldingrcontained�1170 sf. in the basement, 1,696 of. on the ground floor and 896 of. in the loft area of the roof. He discussed the history of zoning for the site, noting that the Business Limited C District was rezoned to Residential F District in 1983 which caused the non-conformity in use of the structure. It was later expanded in 1984 by Special Permit #1984-31 for the retail sales of hardware On February 12, 1993, the Site Plan Review_ Committee approved, with five (5) conditions, a plan titled; "Existing Building Location, Proposed Parking Location, Lot 17 Windmill Lane", dated 8/06/92 (SPR No. 04-93) . The applicant has agreed to satisfy all of those requirements of Site Plan Review. The hours of operation were proposed to be between 10:00am to 5:OOpm Monday through Saturday and 12:00 noon to 4:OOpm on Sundays. The applicant has discussed and received the support of -the Cotuit/Santuit Civic Association. A copy of the letter dated March 10, 1993, supporting this appeal has been submitted to the file. Attorney Ford also cited that the newly formed Cotuit/Santuit Business Association also supported this application. Attorney Ford also noted that the applicant would abide by the following: 1. blocking access to the site from Route 28 and all access would be from Windmill-Lane, 2. limiting the number of employees to two (2) in-addition to the owner, and 3. limiting signage to one (1) sign measuring 28"x40", and suspended less than 8" from grade. The public was invited to speak and no one spoke in favor or in opposition to the petition. FINDING OF FACTS: Base upon ,the evidence submitted and the testimony given at the public hearing on Appeal No 1993-T7, The zoning Board of Appeals unanimously found: 1. Prior to 1983 the site was zoned BL-C, Business Limited C, allowing for retail use common to a residential area. 2. As a result of the 1983 rezoning of the area from BL-C, Business Limited C to RF, Residential F, a retail hardware store on this site was non-conforming in use. Appeal No. 1993-17 Decision and Notice 3. The non-conforming use status of lot ant structure has not lapsed under the Zoning Ordinance which requires five (5) years of not being used. A letter from Berkshire County Savings Bank, dated February 09, 1993, attest to this by citing that the Hardware closed in September of 1989. 4. The proposed use of the site and buildings as a residential home and An antique shop would not be detrimental or substantially objectionable to the neighborhood. Conclusion: Based upon the findings, a motion was duly made and seconded that Appeal No.1993-17 for a Special Permit for a change in use of an non-conforming use be granted as represented and subject to the following. conditions: 1. This Special Permit is issued to the applicant for the sale of antiques, at this site. It is not transferable to another person or for another retail sales activity without first being approved by the Zoning Board of Appeals. 2. The retail use, the selling of antiques, shall be limited 'to that portion of the structure not used for residential purposes. The residential use shall be located as presented to the Board and illustrated on, the floor plan submitted and titled "Proposed Living Area for Lower Level" (also labeled Exhibit C) . 3. The hours of operation shall be between 10:00am to 5:00pm Monday through Saturday and from 12:00 noon to 4:OOpm on Sundays. . 4. The site is to be developed pursuant to the site plan submitted, titled "Lot 17 Windmill Lane'' and in compliance with all five (5)` conditions of site Plan Review approval dictated by the Building Commissioner,' dated February 12, 1993. 5. Site access shall be limited to Windmill Lane and no direct access is to be from Route 28. Access directly from Route 28 shall be permanently closed off and any curb cut permits from route 28 shall be surrendered to the Commonwealth of .Massachusetts and the Town of Barnstable. 6. Signage shall be as present in testimony and shall be limited to only one (1) sign in conformance to the sign code. .7. The placement of any other objects to attract customers within the front yard areas of the building shall be prohibited with the exception of' one (1) display flag announcing that the shop is open for business. 8. He discussed the history of zoning for the site, noting that the Business Limited C District was rezoned to Residential F District in 1983 which caused the non-conformity in use of the structure. It was later expanded in 1984 by Special Permit #1984-31 for the retail sales of hardware. On February 12, 1993, the Site Plan Review Committee approved, with five (5) conditions, a plan titled; "Existing Building Location, Proposed Parking Location, Lot 17 Windmill Lane", dated 8/06/92 (SPR No. 04-93) . The applicant has agreed to satisfy all of those requirements of Site Plan Review. The hours of operation were proposed to be between 10:00am to 5:OOpm Monday through Saturday and 12:00 noon to 4:OOpm on Sundays. The applicant has discussed and received the support of the Cotuit/Santuit Civic Association. A copy of the letter dated March 10, 1993, supporting this appeal has been submitted to the file. Attorney Ford also cited that the newly formed Cotuit/Santuit Business Association also supported this application. Attorney Ford also noted that the applicant would abide by the following: 1. blocking access to the site from Route 28 and all access would be from Windmill Lane, 2. limiting the number of employees to two (2) in addition to the owner, and 3. limiting. signage to one (1) sign measuring 2811x4011, and suspended less than 81. from grade. The public was invited to speak and no one spoke in favor or in opposition to the petition. FINDING OF FACTS: Base upon the evidence submitted and the testimony given at the public hearing on Appeal No 1993-17, The Zoning Board of Appeals unanimously found: 1. Prior to 1983 the site was zoned BL-C, Business Limited C, allowing for retail use common to a residential area. 2. As a result of the 1983 rezoning of the area from BL-C, Business Limited C to RF, Residential F, a retail hardware store on this site was non-conforming in use. Appeal No. 1993-17 Decision and Notice 3. The non-conforming use status of lot ant structure has not lapsed under the Zoning ordinance which requires five (5) years of not being used. A letter from Berkshire county savings Bank, dated February 09, 1993, attest to this by citing that the Hardware closed in September of 1989. 4. The proposed use of the site and buildings as a residential home and an antique shop would not be detrimental or substantially objectionable to the neighborhood. Conclusion: Based upon the findings, a motion was duly made and seconded that Appeal No.1993-17 for a Special Permit for a change in use of an non-conforming use be granted as represented and subject to the following conditions: 1. This Special Permit is issued to the applicant for the sale of antiques, at this site. It is not transferable to another person or for another retail sales activity without first being approved by the Zoning Board of Appeals. 2. The retail use, the selling of antiques, shall be limited to that portion of the structure not used for residential purposes. The residential use shall be located as presented to the Board and illustrated on the floor plan submitted and titled "Proposed Living Area for Lower Level" (also labeled Exhibit c) . 3. The hours of operation shall be between 10:00am to 5:00pm Monday through Saturday and from 12:00 noon to 4:00pm on Sundays. 4. The site is to be developed pursuant to the site plan submitted, titled "Lot 17 Windmill Lane" and in compliance with all five (5) conditions of Site Plan Review approval dictated by the Building commissioner, dated February 12, 1993. 5. Site access shall be limited to Windmill Lane and no direct access is to be from Route 28. Access directly from Route 28 shall be permanently closed off and any curb cut permits from route 28 shall be surrendered to the commonwealth of Massachusetts and the Town of Barnstable. 6. Signage shall be as present in testimony and shall be limited to only one (1) sign in conformance to the sign code. 7. The placement of any other objects to attract customers within the front yard areas of the building shall be prohibited with the exception of one (1) display flag announcing that the shop is open for business. 8. There shall be no further additions to the structure. 9. The structure and site shall be improved and maintained in an orderly and attractive manner. f Appeal No. 1993-17 Decision and Notice 10. The lot. has one feature which distinguishes it from most of the lots in the area - there is a drainage easement held by the Commonwealth of Massachusetts which is aocated approx- imately in the center of the lot, as shown on the plans submitted. The Board of Appeals found On October 22, 1985 an agreement for judgment was entered in the Barnstable Superior Court by and between counsel for the Plaintiff and counsel for the Defendant, whereby it was agreed that the Zoning Board of Appeals would issue a Special Permit for the expansion of a non-conforming use in accord- ance with Plans submitted and approved by the Board for an addition to the existing structure limited to 16 x 36, or 576 square feet, as per the Plan entitled "submitted on November 4, 1985." (Paul Penepede, Cotuit lidwr. Store) The Board finds that there is an existing structure which has been located on the premises since 1981, which structure contains approxiately 1120 square feet. That since 1981 a retail hardware business has been conducted at the site. That the retail hardware business constitutes a valid non-conforming use. That changes, alterations and extensions of non-conforming uses in structures are 'specifically permitted upon the grant of a Special Permit by the Board pursuant to Sections G and Q of the Zoning By-Laws for the Town of Barnstable. That the revised proposal as provided for in the agreement for judgment will not change the character of the pre-existing, non-conforming use. That the grant of the Special Permit will not create any use of structure more objectionable or substantially detrimental to the neighborhood. That the proposed alteration is in keeping with the spirit and intent of the By-Law without substantial detriment to the public good or the neighborhood affected.
