I am satisfied with the stated .retail products except items 7, 9 and 10 as -listed in your letter.. These items, listed as custom storm windows., fireplace accessories and. shower doors appear to be products which would be manufactured on -premise. Should this be the case, they would not meet the zoning requirements and there- fore would not be permitted. As you and I have discussed numerous times, this- is an area which must maintain some of the residential character and business must be limited. There will be absolutely no neon signs anywhere on the premises. Further, there would be no exterior changes to the existing building which is clearly residential in style and fits in with the character of the surrounding neighborhood. As you are. well aware, the zoning district allows a small re- tail business- to a residence district. I think that the proposed business certainly meets: the criteria of your previous interpreta- tion of the -meaning of the word "retail" in. that. there will be a wi,de. variety of items to be purchased on the premises by consumers. Town Clerk Board of A eals Applicant Town Barnst le Persons interested Building Inspector Public Information By Board of Appeals Chairman APPEAL NO. 1985 - 43 RODNEY and NANCY AMES This is an application for a Special Permit under Section P4 to increase the size of an existing non-conforming use and, under Section P6, to change a non-conforming use to one not more detrimental to the neighborhood. The premises are located in an RF zoning District. The premises were remodeled in 1978, and have been used since then for commercial purposes. After operating as a .real estate office, the premises became a retail store, and have - continued as such to the present. Glass was first sold from the premises, and .then, until March of 1984, retail heat saving devises were-sold. ' (See Lease annexed hereto as Exhibit A) . From then on, Ames Electric has operated its retail business from the premises. Since the premises were operated for retail purposes at the time of the zoning change, the premises are a protected non-conforming use. It is the_ Petitioner's position that, with respect to the existing build- ing, it is allowed to operate its business as a matter of right, without a per .- mit to change, a non-conforming use. What is protected is the right to operate a retail business, not the specific product. It makes no difference whether glass, curtains or .lights are sold, as long 'as the activity is retail. ; The - change of a product is not a change of a non-conforming use. See e.g. Bridge- water v. Chuckran, 217 NE 2d 726, 351 Mass 30 ( 1966). Since this is the case, the issue before the Board is whether to issue a Special Permit under Section P4 to increase a non-conforming use. The test is whether the addition will result -in the creation of any use or structure more objectionable or substantially detrimental to the neighborhood. It is submitted that it will not. Initially, the Building Inspector issued a Building Permit for a six hundred (600) foot addition on. May 31 , 1984 (See Exhibit B) . Work on the addition was commenced, but was stopped at the request of the Building Inspector, who indicated that he felt that Board of Appeals approval was required. Consequently; the Petitioner filed this present Petition. It is submitted that the proposed addition will not result in a use sub- stantially more detrimental or objectionable to the. neighborhood. The addi- tional. space is to provide office and storage space as .incidental to the exist- ing use. This results in little--impact to the----existing use--since,-its purpose is to support the present use. The retail space will not be increased. The hours of operation or the type of operation will not change. Although there may be additional employees added, there is ample parking because the building occupies only four (4%) percent of the total lot area. The Petitioner owns the two (2) abutting lots .(Lots 24 and 26, See Exhibit C) , so there is little, if any, effect on the neighborhood by this addition. In the case of Bridgewater v. Chuckran, the standards are set forth with respect to whether a change in a non-conforming use is more detrimental to the neighborhood. Basically, the case states that the change must be in kind rather than degree and have a different effect on the neighborhood, as opposed to a greater effect. 2 - Since the proposed addition is nothing more than storage and office space, it is submitted that the change, if any, will be in degree not in kind and the effect may be greater but not different. Thus, it is submitted that the Special Permit as requested can be granted without a detriment to the public good, and since the use is the same the granting of the Permit will not result in a use more objectionable to the neighborhood.
