The accessory structure is referred to as a Detached Garage, approximately 30 feet by 20 feet. From a survey supplied by the applicant the garage (labeled "Storage") is built over the property line. The applicant is proposing to change the main building from a bait shop to a bakery. Although no retail uses are permitted in the present RF District, the bait shop and other retail uses exist as a purported nonconforming use. The locus was previously zoned BL-C Business Limited C District. It was rezoned to RF on November 5, 1983 (Town Meeting Article B-1 (d)) . The Principal Structure is 21.9' from the front lot line and 4.9' from the side lot line. The accessory structure currently extends onto an adjacent lot on the west side. This is proposed to be corrected by removing an 18 sq. ft. portion of the accessory building. The RF District requires a front setback of 100 feet on Route 28, and a side setback of 15 feet. The applicant is requesting both a Variance in Appeal Number 1996-60 to the setback requirements and in this appeal, Appeal Number 1996-59 a Special Permit to alter a pre-existing nonconforming.use to establish the Bakery. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April 29, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The applicant had originally proposed to establish a bakery on site together with the ongoing bait and tackle business. After an initial hearing before the Zoning Board of Appeals, he decided to scale back his plans to include only a bakery, and proposed to discontinue the bait and tackle shop. The hearing was continued to September 11 to allow time to have the new plans reviewed by Site Plan Review. The locus was previously zoned BL-C Business Limited C District, where this use was allowed. It was rezoned to RF on November 5, 1983 (Article B-1 (d)) . The applicant was advised that the boat sales,bait and tackle shop and take-out food are too intense a use of, the site. His attorney indicated at Site Plan Review that he fully intends to discontinue the uses other than the proposed bakery, but would appreciate the ability to keep the canoe rack on the site until March or April so it can be removed to another possible business location. Recommendation: If the Board should find to grant this Special Permit, it may wish to consider the following conditions. 1. The existing storage outbuilding which infringes into the adjacent lot shall be removed as cited on the plan. Plans should be submitted showing all activities on the site and their proposed locations. If boat storage or sales are continued, plans must be submitted showing the proposed location of these activities. 3. No food service will be provided on site. Only prepared foods shall be sold from the site and there shall be / no consumption of food on the premises. 4. The applicant must meet all requirements of the Health Department. All signage shall conform to the requirements of the sign regulations provision of the Town of Barnstable Zoning Ordinance.. 6. There shall be no advertising of sales of bread and bakery products from this location. The two appeals were heard concurrently. Hearing Summary: Attorney Barry cited a correction in a typographical error on the application noting "Section 4-5.5(2)" should read "Section 4-4.5(2)". Attorney Barry stated that Leonard Coronella bought the property on July 1, 1982, at which time the property was zoned Business Limited C District. On November 5, 1983, the district was rezoned to RF Residential F Zoning. At the time of the change, the owner was operating the site as a bait and tackle business and had boats on the property that were used for consignment-"Cotuit Bait and Tackle and The Country Store'. Under the Business Limited C District, both the present use and the proposed change to a baker would have been principal permitted uses. The locus consists of a main building and an out building. The bait and tackle business was at one time in the outbuilding and is now in the main building. Mr. Barry further stated that the bait and tackle business is a seasonal business and the only one in the area, the closest other one being in Hyannis. There is a definite need for the business. As part of the business, they also sell prepared food. The applicant wants to expand the business and move the bait and tackle from the main building to the out building, and then run a bakery in the main building. Mr. Barry submitted to the file, a petition of support with approximately 75 signatures, with a majority of the people being from Cotuit. The Board questioned the food service. Attorney Barry stated the food service is prepared food and that it has been licensed for the last two years. The Board questioned if this food service was in violation of zoning. Mr. Barry stated that when the property was first purchased it was a Business Limited C. This was when the expansion to the Country Store occurred. The prepared foods occurred later. The Board questioned if that food preparation was a legal expansion given the zoning changed in the 1980s and the food use was started in the 1990s, when this area was zoned residential. The Board stressed that a business can change from one non conforming use to another non conforming use, however, on this lot there are already several non conforming uses and the Ordinance does not allow for increasing the number of non-conforming uses on a single lot. What the applicant is requesting is a Special Permit, but what is really needed is a Variance and a Variance cannot be granted on Route 28, per the Zoning Ordinance. Mr. Barry cited that all of the uses on the lot are one use- retail. Attorney Barry noted the sign says, "Cotuit Bait and Tackle and the Country Store" and all these uses can be grouped under the use allowed in a"general store'-retail. The Board noted that maybe all the uses there now could possibly fall under the category of retail however, a bakery is not a retail use. Mr. Barry suggested that the food preparation is part of the country store and not a use in and of itself. The Board reiterated that the Zoning Ordinance does not allow for increasing the number of non- conforming uses on a single lot. Public Comment Summary: Paul and Grace Beattie, abutters to the west, stated they would not be opposed to the bakery but they are against expansion of retail use on the property. They cited that lot is already overcrowded with 4 or 5 businesses on a single lot. They are looking for limits and restriction to the expansion and assurances for adequate parking. Lenny Coronella explained that he is having a hard time making a living on the Cape and this is an opportunity for him to have a partner(Ernest Dewing), who is an expert baker. In rebuttal, Attorney Barry stressed that the business on the location is a country store. At the country store they sell many different things. They want to go from prepared food that they already sell to food they make on their own. A bakery is a logical progression of the country store. The Board suggested that the Petitioner should reconsider the many uses on the lot and come back to the Board with new plans that"fine tune'what uses are wanted. Attorney Barry stated that the Applicant would be willing to discuss this and come back. The hearing was continued these appeals to August 7, 1996. 2 l Zoning Board of Appeals-Decision and Notice • Appeal No.1996-59-Special Permit -Leonard Coronella and Ernest Dewing At the continuance of August 7, 1996, Attorney Richard Barry submitted a memorandum to the Board and reminded the Board what had transpired at the previous hearing. The Applicants would like to have a bakery at the site and are willing to cease the operation of the bait and tackle business. Therefore, they are requesting to modify their appeal from Section 4-4.5(2) Expansion of a Pre-Existing Nonconforming Use to Section 4-4.5(1) Change of a Nonconforming Use to Another Nonconforming Use. The Board asked Attorney Barry if this new project has received Site Plan Review approval. He replied that the previous plan had been approved, however, the single use of the site as a bakery has not been before Site Plan Review. There was a discussion as to whether this new appeal should be re-advertised to notify the public of this change. The Board agreed that the Applicant did not have to re-file their appeal but they did want it re-advertised to give the public adequate notice and requested the plan be forwarded for Site Plan Review. Appeal Number 1996-59 was readvertised on August 22, 1996 and August 29, 1996. The Appeal was continued to September 11, 1996. At the September 11, 1996 continuance, Attorney Barry reviewed the history of these appeals. He noted that Site Plan Review approved the new plan with conditions on September 5, 1996. He stated he will comply with all the requests. The non conforming use will change from the bait and tackle business to a bakery. There is a request to leave the out building itself on the lot temporarily or convert it into a shed. The building encroaches on the property line. The Board asked and the applicant agreed to"cut off' that section of the building that encroaches. The Board stressed that the Applicant must at all times comply with the Zoning Ordinance which allows only one use on the site-the bakery. Attorney Barry spoke with the Applicant and he agreed to the conditions. It is anticipated that the bakery will be approximately 85% retail and 15%wholesale. Public Comment Summary: Mr. Dewing spoke in favor. No one else spoke in favor or in opposition. Finding of Facts: Based upon the testimony given during the public hearing on this appeal, the Board unanimously found the following findings of fact with reference to Appeal Number 1996-59: 1. The property in issue is 4424 Falmouth Road, Cotuit, MA in an RF Residential F Zoning District. The locus consists of approximately .86 acres of land. 2. The Petitioner is seeking a Special Permit for this site pursuant to Section 4-4.5(1)to allow the change from one nonconforming use to another nonconforming use. 3. The prior use of the property was a bait shop. This bait shop preceded the change of zoning in the area, at which time this use was allowed as a matter of right. The bait shop is a pre existing nonconforming use. 4. The Petitioner has obtained the approval, with conditions, of the Site Plan Review Committee. 5. The Petitioner seeks to convert the principle structure on this site which is approximately 1,350 square feet from a bait shop to a bakery. 6. There has not been any evidence presented to the Zoning Board of Appeals that would indicate that the change of use as proposed would be substantially more detrimental or objectionable to the neighborhood involved. In particular, the area does abut Route 28, a highly traveled road. 7. There is ample parking on the site and the site is in compliance with the parking regulations of the Town of Barnstable for the proposed use. Decision: Based upon the positive findings a motion was duly made and seconded to grant a Special Permit for the change in a non-conforming use with-the_following conditions: 1. The only' use to be conducted on the site shall be a bakery. All other uses must cease. 2. The canoe rack must be removed from the site where it is located-and either relocated on the site to an area where it will not encroach on the side line, or it must be removed from the site completely. The building labeled on the plan as storage building may continue to be used as a building, but that portion of the building which encroaches upon the adjourning neighbor's property shall be removed and that portion of the building shall be enclosed in. There shall be no further encroachment on the neighboring property. 5. No food service shall be allowed on site, that is, the site shall not be used as a restaurant. 6. The Petitioner shall comply with all sign regulations within the Town of Barnstable Zoning Ordinance and if any sign is greater than what is allowed is requested, the Petitioner may come before the Zoning Board of Appeals for additional relief if needed. The Vote was as follows: AYE: Ron Jansson, Richard Boy, Emmett Glynn, Elizabeth Nilsson, and Chairman Gail Nightingale. NAY: None Order: Special Permit 1996-59, has been granted with conditions. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. At the time of the change, the owner was operating the site as a bait and tackle business and had boats on the property that were under consignment to the"Cotuit Bait and Tackle and The Country Store". The buildings exist today as they did at that time. When a survey was conducted, an encroachment to the setbacks was discovered. Attorney Barry submitted a plan entitled "Plan of Land for John H. Fish"compiled from a plan dated September 1946, that shows there were two buildings on the lot that predates the inception of zoning. Mr. Barry submitted to the file, a petition of support with approximately 75 signatures, with a majority of the people being from Cotuit. With reference to Section 4-4.5, the buildings do not presently conform to the now required setbacks and the outbuilding encroaches over the neighboring lot. That section of the building that encroaches over the lot will be removed and brought back to the lot line. The unique shape of the lot and the financial restraint to actually move the outbuilding lead to the Variance conditions. In terms of the use changes, the Petitioner is seeking to change the use of the property to a bakery which is the subject of Appeal No 1996-59. Lenny Coronella, the applicant, noted to the Board that he discovered at Site Plan Review Committee that his outbuilding was encroaching on someone else's property and that he intended to remove that section of the structure. Board Members continued these appeals to August 7, 1996 to permit the applicant to reconsider aspects of the Special Permit request. At that continuance, the Board expressed concern for the notification and its relationship to the original advertising and notice. It was determined to continue the appeal to September 11, 1996 to permit re-notification and advertising to the change section reference and to permit a second Site Plan Review given the proposed alteration of the request. Appeal Number 1996-59 was readvertised on August 22, 1996 and August 29, 1996. f At the continuance of September 11, 1996, Attorney Barry reviewed the history of these appeals. He received Site Plan Review approval with conditions on September 5, 1996. He stated he will comply with all the requests. The non conforming use will change from the bait and tackle business to a bakery. There is a request to leave the out building itself on the lot temporarily or convert it into a shed. The building encroaches on the property line. The Board asked and the applicant agreed to"cut off- remove that section of the building that encroaches. Public Comment Summary: Mr. Dewing spoke in favor of the requests. No one else spoke in favor or in opposition. Finding of Facts: Based upon the testimony given during the public hearing on this appeal, the Board unanimously found the following findings of fact with reference to Appeal Number 1996-60: 1. The property is located at 4424 Falmouth Road, Cotuit, MA in an RF Residential F Zoning District and is approximately 0.86 acres. 2. The lot has the benefit of two existing buildings. The first building is to be used as a bakery and does not comply with the setback requirements of the district. The side line set back is 15 feet and the front line setback is 100 feet along Route 28. The second, accessory building is a storage shed and it encroaches on the neighboring lot and therefore it too does not comply with the setback requirements. 3. The buildings are preexisting and have existed for a significant period of time. 4. The fact that the buildings have existed for this long period of time and not through an intentional act that violated the Zoning Ordinance, causes a unique topographical feature. Attorney Barry submitted a memorandum to the.Board and reminded the Board what had transpired at the previous hearing. The Applicants would like to have a bakery at the site and are willing to cease the operation of the bait and tackle business. Therefore,they are requesting to modify their appeal from Section 4-4.5(2)Expansion of a Pre- Existirig Nonconforming Use to Section 4-4.5(l)Change of a Nonconforming use to Another Nonconforming Use. The property was purchased in July 1, 1982 and the area was zoned BL-C. in 1983,an allowed use was"place of business of a bakes." Mr.Barry stated that all other uses on the premises will be eliminated and the only use would the bakery. The Board asked Attorney Barry if this new project has received Site Plan Review approval. He replied that the previous plan had been approved but just this single use of the site as a bakery has not been before Site Plan Review. The Building Commissioner stated that the project could go before Site Plan on August 22, 1996. There was a discussion as to whether this new appeal should be readvertised to notify the public of this change. The Board agreed that the Applicant did not have to refile their appeal but they did want it readvertised to give the public adequate notice. Attorney Barry corrected a typographical error,the application reads"Section 4-5.5(2)"but it should read"Section 4- 4.5(2)" Attorney Barry stated that Leonard Coronella bought the property on July 1, 1982. At that time the area was zoned Business Limited District C.. On November 5, 1983,the Town changed the zoning to RF Residential F Zoning District. At that time,the owner was running a bait and tackle business and had boats on the property that were used for consignment. Under the Business Limited C District, an allowed use was baker. The locus consists of a main building and an out building. The bait and tackle business was at one time in the outbuilding and is now in the main building. The businesses on the locus is called,"Cotuit Bait and Tackle and The Country Store". When a survey was conducted,an encroachment to the setbacks was discovered. Attorney Barry submitted a plan entitled"Plan of Land for John H..Fish"complied from a plan dated September 1946,that shows there were two buildings on the lot. The bait and tackle business is a seasonal business and the only one in the area,the closest other one being in Hyannis. There is a definite need for the business. As part of the business,they also sell prepared food. The applicant wants to expand the business and move the bait and.tackle from the main building to the out building,then run a bakery in the main building. Mr.Barry submitted to the file,a petition of support with approximately 75 signatures,with a majority of the people being from Cotuit. With reference to Section 4-4.5,the expansion,the building does not presently conform to any setback. The building does not meet any setbacks and the outbuilding encroaches on the neighboring lot. That section of the building that encroaches will be removed and brought back to the lot line. The expansion will be on the same lot as the principal building. The unique shape of the lot and the fmancial restraint to actually move the outbuilding lead to the Variance conditions. The Board asked Attorney Barry what food service exists there now? He stated the food service they offer is prepared food and he has been licensed for last two years. The Board asked how that was not a violation as the area is zoned residential. Mr.Barry stated that when the property was first purchased it was a Business Limited C and that this is an expansion to the Country Store. Ron Jansson questioned if this was not an illegal expansion because the zoning changed in the 1980s and the food use was started in the 1990s,when this area was zoned residential. The Petitioner is seeking to add a bakery and Mr. Barry is suggesting that the change from the selling of prepared food to a bakery is the change of one non-conforming use to another non-conforming use. The Petitioner was issued a license from the Board of Health but they do not take zoning issues into consideration. The Board stressed that a business can change from one non conforming use to another non conforming use,however,on this lot there are already several non conforming uses and the Ordinance does not allow for more than one non conforming use on a single lot,especially in a residentially zoned area. What the applicant is requesting is a Special Permit,but what is really needed is a Variance and a Variance can not be granted on Route 28,per the Zoning Ordinance. When asked,the Building Commission stated that the origin of some of the uses on the site could not be established. There was a business use and they are selling pre packaged food but they can not tell exactly when each use has started. The bait and tackle use being the oldest. The other uses are newer. The Assessor's records say there was a business but does not tell you what the business is. Site Plan Review knew that food was there and they considered this an expansion of the food service,however a bakery is different than the food that it there now. Again,the Board asked Mr.Barry how the applicant went from one allowed non conforming use on the lot to the many different uses that are presently there. Attorney Barry suggested that the sign says,"Cotuit Bait and Tackle and the Country Store"and all these uses can be grouped under the use allowed in a"general store". All these uses fall under a retail use. Board Member Ron Jansson agreed that maybe all the uses there now could possibly fall under the category of retail use however,a bakery is not a retail use. Mr.Barry suggested that the food preparation is part of the country store and not a use in and of itself. The Board again stressed that the Zoning Ordinance does not allow for more than one non conforming use on a single lot. And again,Mr.Barry said that the many uses should all fall under the category of Country Store,a use that is allowed now. Public Comment: Paul and Grace Beattie,abutters to the west,stated they would not be opposed to a nice clean bakery but they are against expansion of retail on this property. The lot is already overcrowded with 4 or 5 businesses on a single lot. They are looking for limits and restriction to be put in place. Also,there is a concern for parking. Lenny Coronella,the applicant,told the Board that he has refinished the main building,painting and cleaning. He found out through the Site Plan Review Committee that he was encroaching on someone else's property. He said the boat in the back is his personal boat. He explained to the Board that he is having a hard time making a living on the Cape and this is an opportunity for him to have a partner(Ernest Dewing),who is an expert baker. All the itemshe sells are related to the bait and tackle industry. They are all necessary for him to make a living. No one else spoke in favor or in opposition. In rebuttal,Attorney Barry stressed that the business on the location is a country store. At the country store they sell many different things. They want to go from prepared food that they already sell to food they make on their own. A bakery is a logical progression of the country store. Board Member Ron.Jansson at this time asked if the Board could take the appeal under advisement as the Board can only act on what the Zoning Ordinance allows. Maybe,the Petitioner should reconsider the many uses on the lot and come back to the Board with new plans. They should"fine tune"what uses the Petitioner wants and come back at a later date. Attorney Barry stated that the Applicant would be willing to discuss this and come back. The Petitioner is seeking a Special Permit for this site pursuant to Section 4-4.5(1)to allow the change from one nonconforming use to another nonconforming use. 3. The prior use of the property was a bait shop. This bait shop preceded the change of zoning in the area,at which time this use was allowed as a matter of right. The buildings are preexisting and have existed for a significant period of time. 4. The fact that the buildings have existed for this long period of time and not through an intentional act violate the Zoning Ordinance,causes a unique topographical feature.
