DaLuz, Building Commissioner Town of Barnstable 367 Main Street Barnstable, Massachusetts 02630 RE: -ROUTE "2 8 PROPERTY %44 SANTUIT, MASSACHUSETTSf j Dear Joe: - Please be advised that this office represents the Roman' Catholic Bishop of Fall River, Corporation Sole, which owns` - property in Barnstable, Santuit,, formerly the rectory of St. Jude' s parish, as well as the site -of the church itself, and surrounding property. In an effort to make the property conform to the present zoning requirements, I appeared on behalf of the Diocese before the Town of Barnstable Planning Board on July lst to seek approval of a plan drawn by Land Use Technology which in effect resubdivides the church' s land on Mariner Circle, Anchor Lane and Route 28. A copy of that plan is herewith enclosed for your convenience. Because of the existing structures and the size of the pre- existing subdivided lots, a reconfiguration of the area was done reducing the number ,of lots and increasing their size. As part of the process, because of the pre-existing structures, a new lot on Route 28 shown as Lot 5 on the plan was created removing a lot line between the two pre-existing structures. i� QUIRK AND CHAMBERLAIN, P.C. DaLuz, Building Commissioner, July 10, 1991 In effect, we had pre-existing nonconforming structures and were advised that because of the size of the lots, a merger had already occurred because the lots were not checker-boarded and the property could not be sold independently. In order to make the property saleable, Lot 5 was created thereby changing the nature of the nonconformity creating nonconformable structures on the same lot. After the Planning Board voted to approve the plan, it voted to notify you of the violation shown on the plan. I have indicated to the Planning Board that this property is on the market and depending upon the potential needs of a buyer, if a prospective buyer wants to change the configuration of the property and eliminate the structure, or if the buyers want to use both structures, I would file the appropriate paperwork and seek relief from the Board of Appeals. Presently, the structures are not occupied and certainly if that situation changed, an occupancy permit would be sought, then a variance or a correction of the violation would occur. I would ask that under the circumstances, you provide my client the opportunity to market this property on the new plan or in some other method of approach should a different use arise for the marketing before any action is taken with respect to the suggested violation. We have attempted to upgrade the property with the plan and will eliminate traffic and the access for traffic on the residen-tial subdivision roads because of this new layout which protects the entire area.
