DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside, on which there is,or is intended to be,a one or two-family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work porformed under the building permit. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. Zoning: RF Residential F Zoning District Groundwater Overlay: GP Groundwater Protection District Applicant's Request: Modification of Special Permit Number 1987-110, 1992-13 and 1993-38 Background: Norbert and Mary Crothers have appealed to the Zoning Board of Appeals for a Modification of previously issued Special Permits to Thomas & Bonnie Campbell. The.locus of this appeal is a 2,104 sq.ft. building located on a 37,848 sq.ft. lot fronting on Route 28 in Cotuit. The building houses an owner occupied Single Family Residence and a 900 sq.ft. travel agency office. Zoning Permit History: In 1987, the Board denied Appeal No. 1987-004 to John and Gaile McShane to permit the existing two- family structure to be razed and rebuilt the dwelling into several offices. The entire parcel at that time . contained two structures with a total of three dwelling units on a 77,694 sq.ft parcel. Again in 1987, the same applicant resubmitted a new Appeal No. 1987-110 to the Board for the conversion of the two-family dwelling to an office use and a single-family dwelling. That appeal was granted. The relief was sought under the Non-conforming section of the Zoning Ordinance at that time. The Board found that the entire site consisted of three dwelling units in two buildings and that the non-conformity was a legally established non-conforming situation that predates the adoption of zoning. The second dwelling on the property remained and was conditioned to be rented as lower and moderate income residential rental unit for the town. In 1992, the then owner of the property., Boston Federal Savings Bank, requested (Appeal No. 1992-13) and was granted a modification to Special Permit to allow the permit to be transferable to another. Again in 1992, the owner, Boston Federal Savings Bank and.a proposed buyer, Tower Cohtracting Corp. attempted to modify the Special Permits on the property to permit-a contractors office and yard. That Appeal No. 1992-072 was denied. Later in 1992 Thomas and.Bonnie Campbell sought and were granted a modification of special permits on the property. They were granted Special Permit No. 1992-38 for the reuse of the office as a travel agency and residential owner occupancy of the principal structure. The second dwelling on the property remained as a lower and moderate income residential rental unit. In 1996, the Campbell's applied to the Board for three types of relief: 1. Appeal No. 1996-26, to allow the property to be divided into two lots. That was granted. 2. Variance No. 1996-64 to sanction the two under sized lots and the other lots lack of minimum frontage. Zoning Board of Appeals-Decision and Notice Appeal No.97-18 - Crothers Modification of Special Permit Number 1987-110, 1992-13 and 1993-38 3. Appeal No. 1996-65 for a Modification of the Special Permit to remove the condition imposed on the smaller dwelling that it be affordable housing( Today,.the non-conforming use is situated on a 37,848 sq:ft. lot identified as"Lot A"on the recent plan for the division of the lot Titled "Plan of Land in Barnstable Massachusetts prepared for Thomas and Bonnie Campbell", dated March 13, 1996. That lot contains the 2104 sq.ft. structure with a single family dwelling and a 900 sq.ft. office space within. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on December 27, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened February 19, 1997, at which time the Board found to grant the Special'Permit with conditions. Board Members hearing this appeal were Emmett Glynn, Gene Burman, Elizabeth Nilsson, Thomas DeRiemer, and.Chairman Gail Nightingale. Attorney Albert Schulz represented the applicants, Norbert and Mary Crothers, who were also present. Hearing Summary: Attorney Schulz submitted the Purchase and Sales Agreement to show standing. Attorney Schulz reported the requests is for a modification to the existing Special Permit to change the use allowed on the property from a travel agency to a custom drapery and wall covering shop. They currently operate under the name Windows and Wallflowers. Mr. & Mrs. Crothers intend to relocate their business to this building and intend to reside on the premises. Attorney Schulz gave the history of the site and referenced the Special Permits and Variances connected to the parcel. The conditions suggested by the staff are agreeable to the petitioners. The only request is to change the use. The new use will be less detrimental•to the area as the drapery shops owners conduct most of their business off site'and the use will generate little- if any traffic-retail traffic.. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: Based upon the testimony given during the public hearing on this appeal, the Board unanimously found the following findings of fact: . 1. The applicants are Norbert and Mary Crothers. The property in issue to located at 4464 Falmouth Road (Route 28), Cotuit, MA as shown on Assessor's Map 024, Parcel 018 and in the RF Residential F Zoning District. 2. The applicants are requesting a Modification of Special Permits Number 1987-110, Number 1992-13 and Number 1993-38. 3. The applicants wish to create a drapery facility as part of this building in which they also intend to reside. 4. A signed Purchase and Sales Agreement has been submitted 5. The request is to change the use from a previously allowed travel agency to a custom drapery shop. 6. The use will be utilized by Mr. &Mrs. Crothers. 7. Most of the traffic generated will be from the applicants exiting the site and driving to locations as opposed to customers coming onto the site. . .8. The applicants have agreed to screen the one delivery van with a business sign they own from neighbors and from the,public way (Route 28) to further protect the character and limit signage in the neighborhood. 9. The proposed use will not be more detrimental to the area affected. 10. Background Information: Thomas and Bonnie Campbell have appealed to the Zoning Board of Appeals for a Clarification or Modification of a Special Permit 1993.-38. The request is to modify/clarify Condition No. 10 to allow the lot to be divided into two lots for the purpose of conveyance. The lot contains 2 structures on it-one a single-family dwelling and the other a single family dwelling with 900 sq.ft. of non-conforming use of a business. This locus has the benefit of 3 existing Special Permits (No: 1987-110, No. 1992-13 and No. 1993-38). The Applicants request permission for the property to be divided into two separate lots. The Hearing was opened on March 6, 1996, at which time the Board found to Grant the Appeal with Conditions. Attorney Michael Ford represented the Petitioners, Thomas and Bonnie Campbell. Attorney Ford submitted a memorandum in support of this appeal. Mr. Ford reminded the Board Members.that this property has been before the Zoning Board of Appeals before and has the benefit.of three Speciai' Permits (#1987-110, #1992-13, and#1993-38). There are two structures Zoning Board of Appeals-DeL..-,Jn and Notice ` Appeal Number 1996-26-Campbell on the lot which is not quite two acres. The structure closest to road is the Campbell's home and travel business. To the rear is a second structure, which is a.700 sq.ft. single family two bedroom dwelling that had been rented through the Barnstable Housing Authority. The Campbells wish to divide the lot into two parcels and sell the other 700 sq.ft. home and proposed lot. They have a Purchase and Sales Agreement to sell the home; however, they need permission from the Zoning Board of Appeals to divide the land because Condition#.10 of Special Permit 1993-38 states, "the property shall remain as one lot and not be divided in the future.". Previously, this lot consisted of two lots with two structures. The lots merged into one by virtue of. the Zoning change in the area and common ownership conditions. The Petitioners want to divide the land into Lots A& Lots B as shown per plans. Lot A would be 37,848 sq.ft. and remain the Campbell's property, while Lot B would be divided into a 39,846 sq.ft. parcel. Each lot will have their own ingress/egress to Route 28 after the division of the property. Attorney Ford acknowledged that under Special Permit 1993-38, Condition#3 states the"property' shall remain rented to the Barnstable Housing Authority as affordable housing" and if the Applicant is granted the modification to Condition#10, Attorney.Ford will be back before the Zoning Board of Appeals to request to modify Condition#3 also and any other relief that may be required. The issue of any other changes to the Special Permit is not before the Zoning Board of Appeals tonight, only the modification of Condition#10. He cited that further relief would be required after that ANR Plan is approved to implement the plan with undersized lots and a lot without sufficient frontage. Also of concern at that time would be to protect the existing non-conformity in use of the front lot. The Campbells want to sell the property for$75,000 (which is below affordable market price). The main reason the Petitioners want to sell the property is because of all the problems they have had renting the property. It has been rented for the past nine years. They are hoping if they sell the property, the new owner will maintain the property. The potential buyers are aware of the restriction in the Special Permit that this property remain a two bedroom dwelling and.there are to be no additions to the home. Both structures have individual and separate, Title V Septic System. Attorney Ford indicated that the Campbell's are having financial difficulties maintaining the two homes and the selling off the back parcel will reduce their mortgage. The Board questioned if this would count towards the Towns required share of affordable housing units. Attorney Ford noted that it would not formally,count in that it would not be protected nor is it being funded under an approved program. However if this approach were to be taken, there would be no assurances that this unit would be sold to a Barnstable resident. The Board agreed that going into the affordable housing pool would not assure the unit would be purchased by local town residents. They cited that the affordable housing needs of the Town are being met in the proposal although not counted under the existing program. The spirit and intent of the other Special Permit conditions are being satisfied by this proposal. The public was requested to testify. No one spoke in opposition or in favor of this appeal. Farren, Land surveyor. The lot has access to Route 28 through an existing gravel drive. 4. The rear lot contains a 2 bedroom house which over time has been occupied by different renters. The proposed division of the lot is illustrated on a plan titled"Plan of Land in Barnstable, Massachusetts prepared for Thomas A. and Bonnie Campbell" by John R. Farren, professional land surveyor. The plan shows that the larger structure would be on Lot A of 37,848 sq.ft. with approximately 269 feet of frontage. Lot B, 39,846 sq. ft., on which the smaller structure is located would have approximately 30 feet of frontage along Route 28 where the existing driveway is located. 3. This locus has the benefit of 3 existing Special Permits (No. 1987-110, No. 1992-13 and No. 1993-38) and a.Variance as granted in Appeal No. 1996-64. In March 1996, Special Permit No. 1993-3.8 was modified through Appeal No. 1996726, which removed a condition prohibiting the lot from being divided into two lots. The owners/applicants, Thomas and Bonnie Campbell, are now applying for Modification of Special Permit No. 1993-38 to delete Condition No. 3. 4. A modification of the Special Permit is held to the same standard of no substantial detriment to the public good or the neighborhood in question. It is the Petitioners'firm belief that to delete the rental requirement and permit the property to be divided and conveyed will have benefits to the neighborhood in that ownership of the property will result, in their opinion, in the property being maintained in a better fashion than it has been by the tenants from the Housing Authority. 5. The Petitioners would suggest that the spirit and intent of the affordable restrictions of the permit are being adhered to in that the selling price of$75,000 for the unit to the individuals involved, while not subject to any formal governmental agency review, is indeed within the range of affordable price for a single family home. This location of the structure is unique to the general zoning area. 7: Each structure, as it presently exists on Lots A& B, are so located as to have access and separate frontage from Route.28. 8. The provisions of the.subdivision control law and the Town of Barnstable Zoning Ordinance provide for these dwellings to be used separately on separate lots. 9. The Variance requested is from the dimensional requirements of.the Zoning Ordinance and not the use variance inasmuch as the use is residential which is in keeping with the character of the Zoning District. 10. On December 10, 1987, the Board of Appeals determined the petitioner had sub- mitted a repetitive petition to the Board within the two years of the previous denial.
