Mr. Capizzi presented his petition for a Special Permit to construct a 25' x 45'
garage at 1645 Newtown Road, Cotuit in an -RF zoning district. The proposed con- •
struction is to add the slab garage with storage above and to construct a gambrel
style roof over the existing barn, for office and storage use. The petitioner
also needs the garage for space in which to repair his vehicles. The existing
building will have a second floor to connect a roof common to both the new addition
and the existing, and there will be two or three offices above the existing building.
At the present time, there are two offices, one in the house and one in the warehouse.
There are- two buildings on the five-acre site. There is no retail business conducted.
on the premises, it is only to allow the petitioner to perform services including
repair. There is a. problem p with parking, expecially trucks, there is concern `
because it is not unusual to see trucks parked not only on the property, but across.
the street as well. The petitioner did not present any evidence that a legal non-
conforming use exists at the site.
Gail Nightingale made a motion to deny the petition for a Special ,Permit on the
basis that this is an expansion of a non-conforming use that is substantially more
detrimental to the neighborhood affected because of the parking problems, and also
this petition would result in the creation of two or more non-conforming uses
differing in use - Dexter Bliss seconded the motion. The Board voted unanimously
to deny the petition in view of the lack of parking, as well as the creation of
two or more uses differing in use. The Board fel that the petitioner did not
present any conclusive evidence that this is/ existing non-conforming use,
as the petitioner failed to supply any proof to the Board of its existence.
