The applicant also noted that access to the site would be limited to ingress and egress for Sandalwood Road only. All access on to Route 28 are illustrated as closed and landscaped as per site plan review and approval. The plan proposes 12 parking spaces for the retail activity to be located in the front of the building. The architectural elevation drawings (revised) show double hung windows, low positioned skylights and exterior building covering to match the existing structure. The concerns of the Health Department were raised and the applicant cited that to comply with the requirements of the "330 Rule" (General ordinance Regulation of wastewater Disposal within a Groundwater Protection District), the proposed residential uses would be limited to a total of two (2) bedrooms. One (1) of the bedrooms is to be within the principal structure and the second bedroom would be within the accessory structure which has an apartment use on the second floor. The applicant also noted that the apartment had existed for over 25 years. The Board questioned if a Special Permit for the non-conforming use had ever been issued. Board Members recall that one was issued to spencer Gray for a business known as the "Sail Loft". The Board continued the hearing to review materials on the case and to review the earlier Special Permit. At the June 10, continuance, the Board reviewed Special Permit No. 1988-58, issued to Mr. Gray for The Sail Loft. That permit allowed a retail store to be changed into three (3) professional office suites, to employ not more than' nine (9) persons. It also limited the apartment use to a one.-bedroom apartment. After review of the petition, it appears that the Special Permit was not implemented and consequently has become void in accordance with Section 5-3.3 (3) of the zoning Ordinance. The property was purchased by Mr. & Mrs. Taylor, the current owners, within two-years and that the nonconformity of use had not expired. The petitioner never exercised the 1988 Special Permit Questioned were also raised in referred to the renovation and its compatibility with the existing architectural significant structure.
