January 14, On .........................................._.......................................................................... 1988..............., The Board of Appeals found On November 20, 1987, the petitioner, Alcott Management Company, filed an application for a Special Permit with the Town Clerk's Office seeking to change/alter a pre-existing non-conforming building as is shown on Barnstable Assessor Map 10, Lot 2, located on Route 28 in the Cotuit section of this Town. Pursuant to the provisions of Chapter 40A, all interested parties were notified and public notice of this hearing was published in the Barnstable Patriot on November 19 and 26 of 1987. A public hearing was held on this petition. on December 3, 1987. The following Board members presided: Ron S. Jansson, Chairman, Dexter Bliss, Richard L. Boy, Gail Nightingale and Luke P. Lally. FACTS: The petitioner is the current owner of locus which consists of approximately 24,000 square feet of land and is currently being utilized as a Sunoco gasoline station. Richard C. Anderson, Esquire, Attorney for the petitioner, by letter dated September 17, 1987, provided evidence that the non-conforming use of the property had been in existence since at least 1947 as evidenced by minutes of the meeting of the Board of Selectmen dated April 11, 1947 by which a prior occupant was given permission to store and sell petroleum products in two (2) underground'! tanks. Mr. Anderson represented to the Board that the service station in issue has been utilized as a gasoline station and repair station since 1947. The current building on the property contains approximately 1700 square feet as well as an island of gasoline pumps which directly abut the layout of Route 28. The petitioner also seeks to move the location the building back from the location of the initial building approximately 15 feet and to construct two new pump islands which would be set back a minimum of 30 feet from the layout of Route 28. The existing pump islands would be eliminated entirely. All of the lighting for this gasoline station would come from underneath the new canopy as a result of which there would not be any glare resulting to any of the adjoining premises or roadways. The petitioner also' proposes to construct a 50' x 10' wide buffer planter along the edge of Route 28 and a 50' x 7' planter along the easterly boundary of the property. The petitioner contends that the building itself would not be a convenience store and is requesting permission to sell only impulse items therein which would warrant a reach-in cooler as opposed to a walk-in cooler. This cooler would be in lieu of any vending machines whatsoever. Mr. Anderson represented that the current hours of operation at the present location are from 6:00 a.m. to 11:00 P.M. The, petitioner presented a detailed "Traffic Impact Study' dated December 1987, by H.W. Moore Associates, Inc. The Report indicated that the addition of a self- serve pump island along with the availability of more pumps would significantly reduce the lengthh, of vehicles coming into the gas station itself and thereby would eliminate the potential of vehicles backing up onto Route 28. Furthermore, the • report concludes that the construction of a landscaped island so that two clearly defined roadways are formed would eliminate the existing unregulated traffic flow to and from Route 28 from the premises. The Report further provided that although there would be an increase in traffic to and from the site, it was felt that most of the increase would be from motorists already on Route 28 and that the increase in traffic entering the site should not affect the through traffic flow on Route 28. On ..............January....14.................... ............................................... 1A§............., The Board of Appeals found A letter was received from Paul Frazier, Chief of the Cotuit Fire Department dated December 14, 1987 indicated that the Fire Department had reviewed the proposed revisions of the petitioner and had found the Plans to be acceptable with respect to fire detection and supression equipment. The petitioner further indicated that the current underground storage tanks were recently installed and comply with all the requirements of the State Fire Marshall. The petitioner has provided six (6) parking spaces on site for employees and customers. The petitioner does not intend to increase the storage capacity on the site$ nor, will the petitioner engage in any repair service on the site. The petitioners architect testified that there is a positive limiting barrier designed to contain any spill from pump runoffs and to prevent spillage into the adjoining areas. A representative from the Cotuit/Santuit Civic Association indicated that he thought the renovations were an improvement, but he had some concerns as to the location of this project in conjunction with a zone of contribution. There was no information submitted to this Board as to whether or not the project fell into. a zone of contribution. BARNSTABLE 7-23329 The drive must be constructed on a minus grade from the edge of the hardened surface of the State highway. The Grantee are responsible for the disposal of all surface water from the proposed drive. Under no circumstances is any of .this surface water to enter the State Highway Layout. If the Grantee should. paint any curbing or curb returns within the State Highway Layout, the paint must be white and must be applied at the time the drive is installed. The Grantee shall indemnify and save. harmless the Commonwealth and its Department of Public Works against all suits, claims or liability of every name and nature arising at the time out of or in consequence of the acts of .the Grantee in the performance of the work covered by this permit and/or failure to comply with the terms and conditions of this permit whether by themselves or their employees or subcontractors. All required signs and traffic warning devices shall be furnished by the applicant. All signs and devices shall be in accordance with the Massachusetts Manual on Uniform Traffic Control Devices. The number and location of all signs and devices shall be' as deemed necessary by the Engineer for the safe and efficient performance of the work and the safety of the travelling public. All warning devices shall be subject to removal , replacement and/or repositioning by the applicant as often as deemed 'necessary by the Engineer. %Cones or non-reflectorized warning devices shall not be left in operating position ,on the highway when the daytime operations have ceased.' If it becomes necessary for the department to remove any construction warning devices or their appurtenances from the project due to negligence by the applicant, all costs for this work will be charged to the applicant.
