March 26, 1991 Mr. Joseph DaLuz, Building Inspector Town of Barnstable Barnstable Town Hall Hyannis MA 02601 Re: Ames Electric, .4075 Falmouth Road (Route 28), Cotuit Dear Mr. DaLuz: It has come to the attention of the Cotuit - Santuit Civic Association that the owner or owners of the Ames Electric Building located at 4075 Falmouth Road in Cotuit have erected a barn or warehouse in the rear of the premises. The premises at issue are located in an RF Zoning District which ordinarily would prohibit a retail business or a contractor's yard. However, Ames Electric Company claims to be a pre-existing non-conforming use. Under Section 4-4.2 of the Barnstable Zoning Ordinance, the ower or owners of the premises at issue are required to obtain a special pemit from the Board of Appeals as a pre-condition to the extension of the non-confrming use, which would include the construction of any new building on the premises. Our' research of the records of the Town of Barnstable to date evinces no such special permit for the construction of the subject structure has been issued. It is our opinion, after consulting with our attorney, that the construction and maintenance of this barn or warehouse. on the Ames Electric premises is a violation of the Zoning Ordinance of the 'Gown. of Barnstable- Accordingly, pursuant to Massachusetts General Laws Chapter 40A, Section 7, it is hereby requested that you enforce the Barnstable Zoning Ordinance by taking such action as is appropriate to cause the demolition or removal of the offending structure from the premises. Cotuit Dear Mr. Ames: On February 11, 1986 .this office issued a building permit for a garage, as accessory to the dwelling shown on a certified plot plan by Baxter & Nye, Inc. , Registered Land Surveyors dated April 29, 1985. The permit was for construction of a 30' x 60' single story structure. On Tuesday, August 19th, Inspector Alfred Martin did go to the site and order the project stopped. The work did not appear to be in conformance with the permit issued February 11, 1986. On Wednesday morning, accompanied by Town Counsel Robert Smith and Zoning Inspector Joseph Bartell, I inspected the structure to find that you did indeed have under construction a two (2) story structure. The building permit was issued fora single story structure. Under Paragraph A. of Section J. INTENSITY REGULATIONS- RESIDENCE DISTRICTS of the Town of Barnstable Zoning By-Laws, "one. story buildings of accessory use" are permitted. This structure is clearly a two (2) story structure and is in violation of the Zoning By-Law. In the presence of Mr. Smith and Mr. Bartell you were directed to remove the second story and advised to submit a certified plot plan showing the garage and ask the builder to come to my office to review the plans. We had our Civil Engineering Department measure the encroachment and as you can see by the plan dated 2/14/90 and enclosed, that 34' + of your building is within the easement area. We have checked the building permit plan which shows the location considerably outside the easement. Therefore, we suggest that you have your surveyor check the actual location of the building against your building permit plan and get back to me. The building will have to be moved outside the right of way as its' present location is within Commonwealth Electric Company's easement area (copy of easement enclosed and highlighted) . We wish to resolve this matter as expeditiously as possible. Please contact me so we can work out satisfactory arrangement to remove the encroachment.
