Sethares Address: 622 North Henry Street, Madison WI 53703 Applicants Request: Variance to Section 3-1.4(5) Bulk Regulations, Minimum Lot Area of 1 Acre, to permit a 0.30 acre lot to be buildable. Procedural Provisions: Section 5-3.2 (3) Variances Background: This decision concerns the petition submitted by James C. Sethares, who had appealed to the Zoning Board of Appeals for a variance to section 3-1.4(5) Bulk Regulations, minimum lot area to allow a 0.30 acre lot to be buildable. Procedural Summary: The application was filed in the office of the Town Clerk and at the Zoning Board of Appeals office on October 02, 1992. A public hearing, duly noticed under M.G.L. Chapter 40-A, was opened on October 22, 1992, at which time the hearing was closed and a decision rendered. The petition was heard by Board Members: Gail Nightingale, Ron Jansson, Luke Lally, Dexter Bliss and Chairman, Richard Boy. James C. Sethares, father of William A. Sethares, who is the property owner represented the petition before the Board. He explained the history of the lot in question, citing that his family once owned gn adjacent lot, Assessor's Map/Parcel No. 020/030. The lots were held in the family from the time of purchase, 1956. In 1983 lot #030 was sold. During that time, the lot in question, #141 was transferred to William A. Sethares. James Setheres presented the Board with a diagram of the lots and time frames the of transfers. He also submitted photos showing the lot in question. Decision and Notice Appeal No. 1992-62 The applicant noted that this is the last remaining undeveloped lot in the area. In 1990 a percolation test was completed on the lot and it was determined that the lot could support a septic system. The lot is assessed as a buildable lot. The Board presented questions and determined that the- lot, for the purposes of zoning, had been considered with the neighboring lot #030 due to the changes in the minimum lot area. The property was originally zoned RD-2 (requiring 20,000 sq.ft. area) and was rezoned in 1973 as RF (requiring one (1) acre lots) . The public was asked to comment and the following neighbors spoke in opposition to the request. Dr. David Elmer noted the poor drainage in the area and on the lot. Donald Curran mentioned to the Board that the property had been under a purchase and sales agreement and that it was the intention of the applicant to sell the property. Nancy Allen noted that this is a very small lot. Abigail Burlingame stated that building on the lot would be very difficult. David Hendric a realtor, speaking in favor of the applicant noted that the neighborhood has had the benefit of this undeveloped lot without the financial hardship. Find of Facts Based upon the evidence presented and the testimony given at the meeting of October 22, 1992, the zoning Board of Appeals finds as follows: 1. The petitioner purchased the properties referred to as Lots #030 and #141 as individual lots in 1953. Lot #030 was developed with a home and was subsequently conveyed out in 1976 2. Lot #141, the lot in question is assessed for tax purposes as developable land. 3. The lots size is consistent with the lots found in the neighborhood. 4. The petitioner's lot is unique in that it is a corner lot, having two front yard areas, it slopes down from the roadway and it has been noted that it is subject to flooding. 5 in granting the relief sought this would be consistent with the spirit and intent of the zoning ordinance and would not be detrimental to the neighborhood affected. The vote on the findings was as follows: Aye: Ron Jansson, Luke Lally, Dexter Bliss and Chairman, Richard Boy. Nay: Gail Nightingale Conclusion: Decision and Notice Appeal No. 1992-62 Accordingly based upon the information supplied, a motion was duly made and seconded that, Appeal No 1992-62 be granted a variance for lot #141 to the required minimum lot area of one (1) acre to permit it to be considered buildbale for zoning purposes at 0.30 acres. The vote was as follows: Aye: Ron Jansson, Luke Lally, Dexter Bliss and Chairman, Richard Boy. Nay: Gail Nightingale Order: Appeal No 1992-62 is granted for a variance from Bulk Regulations, Minimum Lot ,Area Required. Appeals of this decision, if any, shall be made pursuant to MGL Chapter 40A, Section 17, and shall be filed within twenty (20) days after the date of the filing of this decision in the office of the Town Clerk. This variance must be recorded at the Registry of Deeds and the petitioner has one year in which to exercise the relief granted. i Any person aggrieved by this decision may appeal to the Barnstable Superior Court, as described in Section 17 of Chapter 40A of the General Laws of the Commonwealth of Massachusetts by bringing_.an action within twenty days after the decision has been filed in the office of the Town Clerk.
