The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less aAd
to allow homeowners to engage an individual for hire who does not possess a license,provided that the owner acts as
supervisor.
DEFINITION OF HOMEOWNER
Person(s).who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to
be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner"shall submit to the BuildingOfficial on a form acceptable to the Building Official,that he/she shall be
responsible for all such work performed under the building permit. (Section 109.1.1)

HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions
of this section(Section 109,1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such
work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,
'Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly s'
when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed
Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,
that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by
several towns. You may care t amend and our adopt such a form/certification for use in Y community.

Dear Ms. Uranus:
This letter is a follow up to.our recent telephone conversation in which we explained to you the problem
that exists in our neighborhood because of the signs that are displayed on the house and property of
Ashley Child at 78 Lake Street in Cotuit opposite our home.
The problem is increasing with signs recently added which show greater hostility and more explicit sexual
terms. The earlier signs: "Thief in the Neighborhood" and "Land Grabbing Street Drain" referred to his
claims that his coin collection had been stolen and that the town has neglected to restructure the street
drain in front of his house. But the later signs, "4Q" painted in large black lettering on his white chimney,
"My Neighbors Words - Screw You" and "Save the Prepuce" on the front of his house, show more
irrational hostility and anger personally directed towards specific neighbors.
This has resulted in increased tension and fear in the neighborhood. We feel that his irrational behavior is
now becoming harassment and is therefore more threatening to our personal safety.
Besides affecting our immediate neighborhood,this also has had effects on the school children who drive
by that house on their school bus every day. This is evident in the recent graffiti marking of street signs
on Coolidge Street which imitate the sign on his chimney.
We have tried on numerous occasions to reason with Ashley about these signs. Once last year we
convinced him to take down the sign "Save the Prepuce" but, he recently put it back up. Lately he
refuses to discuss them and seems to blame us for not preventing or reporting the break-ins he claims took
place in his house recently, accusing us of lying when we stated that we had seen nothing.
We have heard that in a previous incident the Barnstable Police came and made him remove or paint over
the signs he had then, so it must have been considered a police matter at that time. Please help us to
resolve this situation before further problems develop in a neighborhood that once was very peaceful.

Dear Mr. Barry:
We are writing to you as our Cotuit councilor as well as our neighbor to ask your help in resolving
what has become an increasingly difficult situation regarding the signs on the house of Ashley Childs
at the corner of Highland Avenue and Lake Street in Cotuit.
We recently contacted Gloria Urenas of the Barnstable Zoning Division about this matter and she
suggested we also meet with you as our local town councilor to discuss the matter further. We would
like to set up an appointment to meet with you and will call to try and set up a convenient meeting
time. Our neighbors, Jim and Lisa Supka,have expressed a desire to attend the meeting with us.
During the six years we have lived here we have had reasonably friendly relations with Ashley, our
neighbor across the street;however, a few years ago he claimed that someone had stolen his coin
collection. Because he assumed that it was someone in the neighborhood,he began to put signs on his
house announcing the theft. Other signs followed becoming more hostile, obscene, and now
personally directed. We and other neighbors are feeling personally threatened as the hostility he
expresses becomes more direct. There is an element of harassment and intimidation expressed by these
signs.
We are also deeply concerned about the impact these signs are having on young people and on the
school children who ride their bus by this house every day. The graffiti that has appeared on street
signs on Coolidge Street which mimic the sign painted on Mr. Childs chimney reflects an escalating
problem. Other neighbors with children or grandchildren have commented on their asking the
meaning of the signs. Relatives, friends and casual visitors have expressed concern for the safety of
the neighborhood.

Dear Ms. Urenus:
This letter is a follow up to our recent telephone conversation in which we explained to you the problem
that exists in our neighborhood because of the signs that are displayed on the house and property of
Ashley Child at 78 Lake'Street in Cotuit opposite our home.
The problem is increasing with signs recently added which show greater hostility and more explicit sexual
terms. The earlier signs: "Thief in the Neighborhood" and "Land Grabbing Street Drain" referred to his
claims that his coin collection had been stolen and that the town has neglected to restructure the street
drain in front of his house. But the later signs, "4Q" painted in large black lettering on his white chimney,
"My Neighbors Words - Screw You" and "Save the Prepuce" on the front of his house, show more
irrational hostility and anger personally directed towards specific neighbors.
This has resulted in increased tension and fear in the neighborhood. We feel that his irrational behavior is
now becoming harassment and is therefore more threatening to our personal safety.
Besides affecting our immediate neighborhood,this also has had effects on the school children who drive
by that house on their school bus every day. This is evident in the recent graffiti marking of street signs
on Coolidge Street which imitate the sign on his chimney.
We have tried on numerous occasions to reason with Ashley about these signs. Once last year we
convinced him to take down the sign "Save the Prepuce" but, he recently put it back up. Lately he
refuses to discuss them and seems to blame us for not preventing or reporting the break-ins he claims took
place in his house recently, accusing us of lying when we stated that we had seen nothing.
We have heard that in a previous incident the Barnstable Police came and made him remove or paint over
the signs he had then, so it must have been considered a police matter at that time. Please help us to
resolve this situation before further problems develop in a neighborhood that once was very peaceful.
