The parcel has two residential structures on it, described in the Assessor's Records as; • a one-story, 3 room ranch built in 1945 and containing 660 sq.ft. living area and 1 bedroom, and • a one-story, 2 room cottage built in 1968 and containing 544 sq.ft. living area and 1 bedroom. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 20, 2000. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on June 07, 2000, at which time the Board granted the Varaince requested. Hearing Summary: Board Members hearing this appeal were Gail Nightingale, Gene Burman, Richard Boy, Tom DeRiemer, and Chairman Ron S. Jansson. Attorney John Alger represented the applicants, King F. and Delores K. Lowe. Attorney Alger reviewed the lot in issue. As originally laid out, these were two lots that did not comply with zoning and were merged into a single parcel. In Appeal Number 1965-50, permission was granted to construct a second single family dwelling on the lot. Therefore, by virtue of a Variance, there now exists two single family residences on one lot. The petitioners are seeking permission to divide locus into two separate parcels with one home on each lot. This would increase the conformity as there would now be one house on each lot. In Mr. Alger's opinion, this division of the land into two lots would not adversely affect the area, but rather would enhance the property as it would allow the land to be sold to separate owners would could personally maintain their homes. Attorney Alger reported that any construction will comply with Board of Health Rules and Regulations and they will comply with Title V. If the Board was concerned about overintensification on the lot-the petitioner would be amicable to a restriction that any expansion of either dwelling would require further relief from the Zoning Board of Appeals. . Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of June 07, 2000, the Board unanimously found the following findings of fact as related to Appeal Number 2000-47: 1. The applicants are King F. Lowe and Delores K. Lowe, Trustees. 2. The property.address is 25 Lewis Pond Road, Cotuit, MA as shown on Assessor's Map 020, Parcel 018, and located in an RF Residential F Zoning District and the AP Aquifer Protection Overlay District. 3. The subject locus is a developed 0.48 acre parcel fronting on two streets, Lewis Pond Road and Lake Street in Cotuit. 4. The parcel has two residential structures on it, described in the Assessor's Records as; • a one-story, 3 room ranch built in 1945 and containing 660 sq.ft. living area and 1 bedroom, and • a one-story, 2 room cottage built in 1968 and containing 544 sq.ft. living area and 1 bedroom built pursuant to a Variance granted by this Board, on Appeal 1965-50. 5. The buildings already exists. They have been in existence for more than ten (10)years. 12. The division of the lot into two separate lots with one building on each lot is a better use of the houses as they can be owned separately and not necessarily rental units. 13. No one spoke in opposition to the proposal. 14. The relief may be granted without substantial detriment to the public good or neighborhood affected and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance Decision: Based on the findings of fact, a motion was duly made and seconded to grant the relief being sought in Appeal Number 2000-47 subject to the following terms and conditions: 1. Division of the lot shall be as presented to the Board and as shown on plan titled "Sketch Plan Showing Proposed Lot Division in Barnstable (Cotuit), Mass. prepared for King F. & Dolores K. Lowe" dated 28th of February, 2000 and drawn by CapeSurv. 2. An Approval Not Required (ANR) Plan shall be prepared and presented to the Planning Board for its approval along with a copy of this decision. The plan shall reference this decision and when approved both the plan and Zoning Board of Appeals Decision shall be recorded together. 3. The dimensional Variance is issued to the existing structures only and any new additions including additional stories shall be required to meet the requirements of zoning which include a 30 foot front yard setback and a 15 foot side setback and a 15 foot rear yard setback. Any expansion to the existing structures would require modification of this Variance. 4. The accessory structure(a wood shed) located on Parcel B is not permitted to be expanded. If it is moved or altered, it shall be required to conform to the required setbacks of the district. 5. The driveway access to the rear lot- Parcel B shall be off Lake Street. There shall be no access over Parcel A for Parcel B. 6. The buildings thereon shall be brought up to existing Title V standards. Variance Findings: In consideration for the Variances, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board should find to grant the requested Variances, they may wish to consider the following conditions: 1.
