The subject property is a 0.47-acre lot on L:ovell's Pond and accessedm fro a dirt chive off Loll's Road;Cotuit. The property is owned by Anthony J.Erena and Barbara R. Thompson who"purchased it in October 1997 " from the estate of Henry J.Unger. The lot supports four.structures,three of which are single-family dwellings and the fourth is an accessory detached garage.It is a non-conforming use on the undersized lot, The applicants propose to expand the existing"main dwelling"to create a two-story dwelling with a first floor area of 1,182 sq.ft.plus a deck of 376 sq.ft. and a screen porch of 186 sq.ft. The total footprint would be 1,738 sq.ft. The second floor is to be 860 sq.ft..with a deck of 180 sq.ft. The total living area of the new q structure would be 2,222 square feet. Plans presented with the application show it to have two:bedrooms, three full bathrooms,a family room and a 136 sq.ft. loft area on the second floor. In 1962,part of today's lot owned by Henry I Unger and Lillian M.Unger was granted a variance to allow the then existing cottage structure to be expanded into a"guest cottage". The variance was granted with the condition that the cottage not be used for rental purposes. (see Appeal 1962, 44): Procedural&Hearing Summary: ' 's Office and at the Office of the Zoning Board of Appeals on This appeal was filed at the Town Clerk Novernber 15,2004. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened January 05,2005, at which time the Board found to grant the appeal. Board Members deciding this appeal were,Jeremy Gilmore,Gail Nightingale,James Hatfield,Randolph Childs and Chairman Daniel M. Creedon III. Attorney John R.Alger represented the applicants before the Board. Mr. Alger explained the proposal to the Board presenting the plans for the expansion of the main dwelling on the property. He noted that the other two structures are cottage structures that constitute independent living units however,the buildings and site is used only by the applicants and their family—much like a single-family use. "Mr. Alger stated-thatit is the applicants' intent to only use the buildings for family and they would not be rented. The lot, as we see it on today's Assessor's Map with the three dwellings on it was created in January of ` 1968. It is a combination of two previous lots: t' j 7.
