Information and Instructions '
Massachusetts General Laws chapter 152 requires all employers to provide workers' compensation for their employees.
Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract of hire,
express or implied,oral or written."
An employer is defined as"an individual,partnership,association,corporation or other legal entity,or any two or more
of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the
receiver or trustee of an individual,partnership,association or other legal entity,employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the
dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer."
local agency MGL chapter 152,§25C(6)also states that every state orlicensing shall withhold the issuance or
renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any
applicant who has not produced acceptable evidence of compliance with the insurance coverage required."
Additionally,MGL chapter 452,§25C(7)states"Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority"
Applicants
Please fill out the workers' compensation affidavit completely,by checking the boxes that apply to your situation and,if
necessary,supply sub-contractor(s)name(s),address(es)and phone number(s)along with their certificate(s)of
insurance. Limited Liability Companies(LLC)or Limited Liability Partnerships(LLP)with no employees other than the
members or partners,are not required to carry workers'compensation insurance. If an LLC or LLP does have
employees,a policy is required. Be advised that this affidavit may be submitted to the Department of Industrial
Accidents for confirmation of insurance coverage. Also be sure to sign and date the affidavit. The affidavit should
be returned to the city or town that the application for the permit or license is being requested,not the Department of
Industrial Accidents. Should you have any questions regarding the law or if you are required to obtain a workers'

Per our conversation yesterday about my Antique Shop (i.e. Junk Dealer's license)
located"Downstairs—45 Main Street Cotuit", I am submitting documentation to you
to verify that since the year 1900 (and earlier!),the property has been a business
downstairs with owners' quarters above. It has never been anything but a store
downstairs.
Enclosed are the following documents for your consideration:
. A two page transcription of the history written by Dr. James Gould, Historian;
(Historical Society of Santuit&Cotuit) and his original one page document of the
same text, followed by a one page document with the handwritten wording.

For the record,there used to be information in the 45 Main Street file at your office. I
say that because I had to clear everything with your department first back in 2003
prior to being able to move down the line getting each department to sign off, until I
was finally able to submit an application to the Licensing Division. Without your
prior approval,they would never have let me apply, let alone granted the license in
the first place. I have further information that can substantiate this, but am hoping the
enclosed documents will reveal what you need to know about the property's
consistent history as a store.
Since the property tends to get confused with 93 Main Street(aka"the old post
office"), do you suppose the 45 Main Street paperwork was accidentally slipped into
that folder instead? Or was it possibly removed for review one time when my annual
Junk Dealer's license was renewed? Somehow, content is missing.Now that you see
the depth and breadth of the property's commercial and mixed use history, I'm
hoping that you'll understand how surprised I was to find zero trace of that history on
file. Just trying to help solve the mystery. O

The following document was prepared in 1999/2000 by Dr.James Gould, the Historian at
the Historical Society of Santuit&Cotuit. [The.original is attached for verification, but is
also transcribed below with larger print and paragraph breaks to facilitate reading.]

The Lapham store is a two and a half story commercial building, gable end close to the
street, with vernacular Greek Revival returns. The ground floor is entered through a
center door between single windows on a wooden porch sheltered by a slightly pitched
hip roof. Above, on the second floor, is a three sided under a shallow hip roof; above this
in the gable end is a small window. At the west end a two story addition of the same
height attaches to a 2 1/2 story barn lying SW of the house„ the main entry in the south
side of the gable end facing east, with two double doors left of center, and smaller loft
doors onto the center of the second floor. At the north side of the barn is a one story
shop under a shed roof. The second story of the store is a rental unit reached by an
open staircase on the north side leading to an open balcony under a shed roof. There
are thin brick chimneys at the peak of in the house and back of the barn, and concrete
block chimney on the north side of the north workshop. The exterior is shingle clad,
painted grey with grey trim and brick red shutters on south side door. The barn is
unpainted shingle, with white trim and brick red shutters and window frames. Its
foundation of the main store is brick pillars, and the barn's is concrete block piers. All
roofs are composition shingle.

For over a half century this wasthe principal store at the heart of Santuit village. For a
short time it was the site of the last barrel cooperage and for the past half century it has
been an antique shop.
The Lapham store was opened here in 1882 by Sears C. Lapham (1835-1907), who
moved the building from East Sandwich. Born in Dartmouth in 1834 to Perry Lapham, he
took a job as a clerk in Sandwich in 1852, and opened his own business in South
Sandwich in 1866, where he bought land in 1870 in Farmersville on the Farmersville Rd.
near the Ephraim and Freeman Percival properties. In 1857 he married Cynthia Meiggs
(1833-75), daughter of Calvin, from [a] South Sandwich family, by whom he had one
son, Elmer W.
In 1880 he moved to Cotuit and opened a store in a small building south of the Santuit
church. Two years later he moved the building from an unknown location in East
Sandwich, perhaps from his Farmersdale [sic: Farmersville] property (cont. pg.2)

that he bought from Heman Crocker. Sears married twice, in 1886 to Mercy F. Percival
(1846-89), daughter of Ephraim F. Percival, and after her death in 1889 to Harriet E.
Percival (1850- [date illegible] ), daughter of William & Eliza. He is buried in Boardley
Cemetery in Farmersville.
The business and house was inherited on his death in 1907 by his only son Elmer W.
(date illegible], who ran the principal store of the village, selling groceries and shoes in
the front, kerosene in the back extension, and gay and grain in the barn, where he
stabled his horses and delivery wagon. Elmer had married in 1883 the daughter of the
next door neighbor to the north, Lucy S. Ames (1859-1917), living in the house she had
inherited (CTA 13). They had one child Rebecca (1863 - 1972), who married in.1915 the
golf pro Albert Grauer(1889 - 1962), and lived upstairs over the store. At other times the
apartment was rented to a Nickerson, and others.
After Elmer's death in 1937, his daughter Rebecca Grauer sold the building in 1949 to
local cooper Stephan S. Richards (1883-1948)who had worked for Victor Anderson
several houses south of here. Richards lived upstairs with his wife, Linda Alice Bearse
(1886- 1946). Richards made wooden barrels for the Cotuit Oyster Co., for Crosby
Oyster Co. in Osterville, and Sam Cahoon Fish Market in Woods Hole, as well as
cranberry boxes.
When Richards died in 1948 his neighbor down the street Udell Perry carried on the
business briefly. In 1950 Richard's estate was sold to electrician Malcolm Linwood °
Fraser(1898- 1967) and his wife Laura (nee Bradford, 1898 - 1982) of Brockton for'an
antique shop specializing in Sandwich glass and lamp parts. In 1980 Mary Hall Hamblin
(b. 1921), daughter of Gyda Gunderson Hall who ran the Scandinavian shop two doors
to the north bought the shop as guardian of Laura Fraser. Mary married Newton Seth9
Hamblin of Newtown. She continues business under the name "Antiques of Tomorrow".

" [...] I found some information in the archive room that will likely interest you and I
made copies of it-'that is, there was a cooperage on Ty-dee Lane that got moved to
Lapham's and worked in the back of the store for years. Did you know about that? I
have the names of the people as well and plan to call Ed Davignon who lives in the
former cooperage on Ty-dee La. later this afternoon. [...]"

Per our conversation yesterday about my Antique Shop(Le' Dealer's license)
located"Downstairs—45 Main Street Cotuit';;I am submitting documentation'to you
to verify that since the year 1900 (and earlier!),the property has been a business
downstairs with owners' quarters above. It has never been anything but a store
downstairs.
Enclosed,are the following documents for your consideration:
1.A two page transcription of the history written by-Dr. James Gould,Historian;
(Historical Society of Santuit& Cotuit) and his original one page document of the
same text, followed by a one page document with the handwritten wording
"CORRECTED 9 Aug. 2000 (plus signature) at the top.
2.An historic map showing the Lapham Store. (Map date 1910,though this is just a
newer print of a 1905,map'which I canalso submit if you need it).
3. One page'describing a bit more about the cooperage prior to 1950. .'
4. One photo with caption showing the Fraser Antique Shop,(1950-1980).
5. One vintage photo showing 93 Main Street(Post Office)—versus—45 Main Street
in business as"Antiques of Tomorrow" (1980-2000);
6. One page Realtor's.description showing 45 Main Street as an'antique shop.
7. One photo/property inspection cover sheet when we bought the property,which
was``Antiques of Tomorrow''until'the day we bought it
8.One page from the Assessor's'department dated 2000 at the time of purchase.
Please note: I have documentation verifying that the property was owned by.Simeon
L. Ames (my cousin through our,mutual Mayflower.ancestor),in the 1800s, but will
submit only what's relevant dating back to Elmer W. Laphain(who married Simeon's
daughter;Lucy S. Ames), since Dr. Gould's history focuses primarily on that. F ''
For the record,there used to be information in the 45 Main Street file at your office. I
say that because I had to clear everything with your department first back.in 2003
prior to being able to move down the line getting each department to sign off,until I
was finally able to submit an application to the Licensing Division. Without your
prior approval,they would never have let me apply, let alone granted the license in
the first place. I have further information that can substantiate this,but am hoping the
enclosed documents will reveal what you need to know about the property's
consistent history as a store.
Since the property tends to get confused with 93 Main Street(aka"the old post
office"), do you suppose the 45 Main Street paperwork was accidentally slipped into
that folder instead? Or was it possibly removed for review one time when my annual
Junk Dealer's license was renewed? Somehow, content is missing.Now that you see
the depth and breadth of the property's commercial and mixed use history, I'm
hoping that you'll understand how surprised I was to find zero trace of that history on
file. Just trying to help solve the mystery. O
If you require,further documentation,please let me know. And thanks so much once
again for taking the time yesterday to look over all of my licenses,renewals and other 'µ
related business documents pertaining to my shop. Since designing and submitting
plans for approval of my business SIGN is the last missing piece of the puzzle to

The following document was prepared in 199W2000 by Dr.James Gould,the Historian at
the Historical Society of Santuit&Cotuit. [The original is attached for verification, but is
also transcribed below with larger print and paragraph breaks to facilitate reading.]

The Lapham store is a two and a half story commercial building, gable end close to the
street, with vernacular Greek Revival returns. The ground floor is entered through a
center door between single windows on a wooden porch sheltered by a slightly pitched
hip roof. Above,on the second floor, is a three sided under a shallow hip roof; above.this
in the gable end is a small window.At the west end a two story addition of the same
height attaches to a 2 1/2 story barn lying SW of the house,, the main entry in the south
side of the gable end facing east, with two double doors left of center, and smaller loft
doors onto the center of the second floor. At the north side of the barn is a one story ,
shop under a shed roof. The second story of the store is a rental unit reached by an
open staircase on the north side leading to an open balcony under a shed roof. There
are thin brick chimneys at the peak of in the house and back'of the barn, and concrete
block chimney on the north side of the north workshop. The exterior is shingle clad,
painted grey.with grey trim and brick red shutters on south side door: The barn is
unpainted shingle, with white trim and brick red shutters and window frames. Its
foundation of the main store is brick pillars, and the barn's is concrete block piers. All
roofs are composition shingle.

For over a half century this was the principal store at the heart of Santuit village.For a
short time it was the site.of the last barrel cooperage and for the past half century it has
been an antique,shop.
The Lapham store was opened here in 1882 by Sears C. Lapham (1835-1907), who
moved the building from East Sandwich. Born in Dartmouth in 1834 to Perry Lapham, he
took a job as a clerk in Sandwich in 1852, and opened his own business in South
Sandwich in 1866, where he bought land in 1870 in Farmersville on the Farmersville Rd.
near the Ephraim and Freeman Percival properties. In 1857 he married Cynthia Meiggs
(1833-7t), daughter of Calvin, from [a] South Sandwich family,by whom he had one
son, Elmer W.
In 1880 he moved to Cotuit and opened a store in a small building south of the Santuit
church. Two years later he moved the building from an unknown location in East
Sandwich, perhaps from his Farmersdale [sic:.Farmersville] property (cont.pg. 2)

that he bought from Heman Crocker. Sears married twice, in 1886 to Mercy F. Percival
(1846-89), daughter of Ephraim F. Percival, and after her death in 1889 to Harriet E.
Percival (1850 - [date illegible] ), daughter of William & Eliza. He is buried in Boardley
Cemetery in Farmersville.
The business and house was inherited on his death in 1907 by his only son Elmer W:
[date illegible], who ran the principal store of the village, selling groceries and shoes in
the front, kerosene in the back extension, and gay [hay] and grain in the barn, where he
stabled his horses and delivery wagon. Elmer had married in 1883 the daughter of the
next door neighbor to the north, Lucy S. Ames (1859-1917), living in the house she had
inherited (CTA 13). They had one child Rebecca (1863- 1972), who married in 1915 the
golf pro Albert Grauer(1889 - 1962), and lived upstairs over the store. At other times the
apartment was rented to a Nickerson, and others.
After Elmer's death in 1937, his daughter Rebecca Grauer sold the building in 1949 to
local cooper Stephan S. Richards (1883-1948)who had worked for Victor Anderson
several houses south of here. Richards lived upstairs with his wife, Linda Alice Bearse.
(1886- 1946). Richards made wooden barrels for the Cotuit Oyster Co., for'Crosby
Oyster Co. in Osterville, and Sam Cahoon Fish Market in Woods Hole, as well as
cranberry boxes.
When Richards died in 19.48 his neighbor down the street Udell Perry carried'on the
business briefly. In 1950 Richard's estate was sold to electrician Malcolm Linwood
Fraser(1898- 1967) and his wife Laura (nee Bradford, 1898 - 1982) of Brockton for an
antique shop specializing in Sandwich glass and lamp parts. In 1980 Mary Hall Hamblin
(b. 1921), daughter of Gyda Gunderson Hall who ran the Scandinavian shop two doors
to the north bought the shop as guardian of Laura Fraser. Mary married Newton Seth9
Hamblin of Newtown. She continues business under the name"Antiques of Tomorrow".

Mary Hall Hamblin

peacefully with her.granddaughter,Amanda.
by her side April 3. r` .
She.was born on Toby Island in Bourne on July 6, 1921 to William L.- and Gyda Gundersen
Hall. Raised in Boston, she summered on Toby Island with her parents and sisters Elizabeth and
Nancy. Educated in Maine at the North,Yarmouth Academy, she went on college in Tennessee at, F
David Lipscomb University. She later returned to Boston and then to the'Cape to,work for her,
mother at Gyda Gundersen Scandinavian Imports. r
In 1948 she married.Seth.Robert Hamblin and settled in Marstons Mills.on the Hamblin Farm
to raise their family.
She thoroughly enjoyed her shop; Antiques,of Tomorrow,'located in Cotuit. Thursday trips
down Route 6A to Chatham and stopping,along the way at various',consignment shops was her,
joy, as was touring the Cape on yard sale Saturday. Her'love of;books also led her to be inVolved
with fundraising events to,support the Cotuit Library
s ,
She is survived by her husband of 61 years,.Seth, and'her children Martha Hamblin Love,
William Crocker Hamblin and David Seth°Hamblin all of Cape Cod; grandchildren Amanda Love
Monahan, Katelyn, Hamblin Trott, and Samantha Hamblin, and 'great..grandchildren Maya ;
'Monahan and Wesley Trott, and other family,members including Charles'Hamblin and-Mr. and
Mrs. John Hamblin.
Her-daughter, Nancy Corse Ingraham, from a previous marriage, and;her'sister Elizabeth,
predeceased her. .
Many thanks to the family of.nurses at the,Royal'Nursing Home in Falmouth for their special
all Hamblin during her final months.

INTENT: It is the intent of this section to allow the residents of the Town of Barnstable to operate a home occupation
within single family dwellings,subject to the provisions of Section 4-1.4 of the Zoning ordinance,provided that the activity
shall not be discernible from outside the dwelling: there shall be no increase in noise or odor;no visual alteration to the
premises which would suggest anything other than a residential use;no increase in traffic above normal residential volumes;
and no increase in air or groundwater pollution.
After registration with the Building Inspector,a customary home occupation shall be permitted as of right subject to the
following conditions:
• The activity is carried on by the permanent resident of a single family residential dwelling unit,located within
that dwelling unit.
• Such-use occupies-no-more-than 400-square feet of space.
• There are no external alterations to the dwelling which are not customary in residential buildings,and there is
no outside evidence of such use.
• No traffic will be generated in excess of normal residential volumes.
• The use does not involve the production of offensive noise,vibration, smoke,dust or other particular matter,
odors,electrical disturbance,heat,glare,humidity or other objectionable effects.
• There is no storage or use of toxic or hazardous materials,or flammable or explosive materials,in excess of
normal household quantities.
• Any need for parking generated by.such use shall be met on the same lot containing the Customary Home
Occupation,and not within the required front yard.
• There is no exterior storage or display of materials or equipment.
• There is no commercial vehicles related to the Customary Home Occupation,other than one van or one
pick-up truck not to exceed one ton capacity,and.one trailer not to exceed 20 feet in length and not to
exceed 4 tires,parked on the same lot containing the Customary Home Occupation.
• No sign shall be displayed indicating the Customary Home Occupation.
• If the Customary Home Occupation is listed or advertised as a business,the street address shall not be
included.
• No person shall be employed in the Customary Home Occupation who is not a permanent resident of the
dwelling unit.

Massachusetts General Laws chapter 152 requires all employers to provide workers'compensation for their employees.
Pursuant to this statute, an employee is defined as"...every person in the service of another under any contract of hire,
express or implied,oral or written."
An employer is defined as"an individual,partnership, association,corporation or other legal entity,or any two.or more
of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the
receiver or trustee of an individual,partnership, association or other legal entity,employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the
dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to bean employer."
MGL chapter 152, §25C(6)also states that"every state or local licensing agency shall withhold the issuance or
renewal of a license or permit to'operate a business or to construct buildings in the commonwealth for any
applicant who has not produced acceptable evidence of compliance with the insurance coverage required."
Additionally,MGL chapter 152, §25C(7)states"Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for.the performance of public work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority."

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less and
to allow homeowners to engage an individual for hire who does not possess a license,provided that the owner acts as
supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to
be,a one or two-family dwelling, attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be
responsible for all such work performed under the building permit. (Section 109.1.1)

Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the
State Building Code Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions
of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such
work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,
Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly
when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed
Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,
that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by
several towns. You may care t amend and adopt such a form/certification for use in your community.
