Re: Request for Determination of Buildability of Undersize Lot
Locus: Lot 5, 335 Main Street, Cotuit MA
Parcel Identification: R022-031
Land Area: 0.55 acres
Dear Mr. Crossen:
This office represents Mr. Jeffrey Johnston, of Cotuit, Massachusetts,regarding a
proposed purchase of the above-referenced lot of land. I am writing to request a determination
from you that for zoning purposes the subject propertty is a "non-conforming lot"exempted from
the current minimum lot size provisions of the Barnstable Zoning Ordinance.
Thefacts about the'subjec`t lot-are as follows:
L The lot was'established on a plan of land dated October 19, 1945 and recorded at
the Barnstable County Registry of Deeds on December 13, 1945 at Plan Book 72
Page 47..
2. The subject lot has 21,240 square feet (a photocopy of the plan is enclosed for your
records.
3. On March 29, 1973, by Article 159 of the Town Meeting,the minimum lot size was
changed from 20,000 square feet to 40,000 square feet.
4. That at the time of the change in zoning from 20,000 square feet to 40,000 square
feet said lot was held in ownership separate from that of any adjoining land located
in the same residential district.
5. - From the change in zoning in 1973 to present this lot has been held in separate
ownership from that of adjoining land located in the same residential district.
Based on the foregoing, I believe that under Section 4-4.5 of the Town of Barnstable
Zoning Ordinance,this is a lot which was lawfully laid out on a plan which complied at the time of
recording with minimum area, frontage,width and depth requirements of the Zoning By-law; and
as there has been no`common ownership with that of adjoining land located in the same residential
district, this lot is "grandfathered" and may be built upon for residential use if the lot conforms
with sections 4-4.5(3) and(4) of the Zoning Ordinance.
Please let me know by return letter as to whether or not, in your opinion, this lot may be
built upon for residential purposes. Thank you for your attention.
