I ran an auto body/auto repair business there from 1984 until the end of 2011. Poor health and a complete disability lead me to not reopen the business after the end of December 2011. The property was listed for sale and was foreclosed upon the end of 2014. 1 lived at the property from 2005 until earlier this year,after the foreclosure, until I could relocate my residence. I let my friends use the garage to fix their cars upon occasion. I did not run a business there and had no income from same and filed no taxes. The current owner will not remove my signage from the building as I have asked him to do. I have not and will not give anyone permission to use my name for his or for any business in the future. It has now come to our attention that the garage reopened under Michael Medeiros' business permit. The old business seemed to operate day and night, sometimes 7 days per week,with loudly revving engine noises and cars peeling in and out of the parking lot at all-times. It was also a gathering place for non-business related activity.There is a zoning noise requirement under Barnstable county Chapter 133. Will it be enforced? Unusual noise and activity to be reported to the BPD. M There doesn't appear to have been any continuous business operated at this location for the past five years. Cars were parked outside for a period of weeks to months i without movement prior to foreclosure and over the last 6-9 months following transfer of th e deed. A letter is on file with the Town of Barnstable addressed to Thomas Perry from Michael Medeiros stating that he had not conducted business since 2011. If commercial under a non-conforming use permit, does the property not revert back to residential usage if the business was not active during a 36-month look-back period prior to sale/foreclosure? We never received a response to our October 20, 2015, letter to Thomas Perry, in which we posed this, and several other questions. It has been determined that the non-conforming rights were not sacrificed. M Are there tax returns that can substantiate a continuous business revenue during the years in question? Regulatory Services does not require nor request tax returns. 17 This location also seems to have been the occasional residence of the prior owner(Mike).- Is this property zoned as both residential and commercial? This is a non-conforming commercial property located in a residential zone. The current use is limited to commercial only until and unless the property owner seeks to officially change it. In his letter, Mr. Medeiros indicates.that repairs continued until he moved out.There is also a letter from Chief Olsen-Cotuit FD-dated 8-10-15 that to the best of his knowledge, 505 Main St., "has not ceased to exist has(sic) an Automotive Business within the past three years." He went on to state that, "The Cotuit Fire Rescue Department has been doing inspections on the property for an automotive business since 2008_."Then commissioner Perry acknowledged this letter. On October 2,4, and 20 letterswere sent to this office from citizens in the area indicating their belief that the pre-existing, non- confojrming use had been abandoned.This perception appears to be based upon an unsigned letter/petition which states in part, "The use of that property has reverted back to residential with the foreclosure and the lack of a permit and no business run therefor over 3 years." It goes on to-suggest to send letters to the Cotuit/Santuit Civic Association and to the President of the Town Council. Listed below are our concerns and questions regarding this property and its usage.At the time of my initial phone call.to you and the drafting of many of these questions,we were under the impression that a new business owner would be meeting with Mr. Romo to register and license his business at the property. It has now come to our attention that the garage has been reopened under Michael Medeiros' business permit. If true, this adds another layer of concern to this situation due to lack of full disclosure,constantly . changing information and process, q and inadequate communication with the neighbors. We request your attention to the following: 0 Has there been a 21E environmental site assessment/study done for the property(to determine the location buried tanks, oil leaks,fuel spills)?This property previously had a - junk yard full of vehicles behind the building for many, many years.There is very likely a substantial amount of hazardous materials located at the property given the quantity and condition of the vehicles on the property over the many years. If not required under current permitting, is the business required to submit to any kind of regular environmental inspection? A 21E is not required by Regulatory Services. 0 Is it fact that no matter who owns or operates an auto repair at the location,the state of Massachusetts Project Manual for Auto Shops must be followed and reviewed by the .appropriate personnel and Regulations met? Regulatory Services does not have jurisdiction over this matter. Has an oil separator been installed at the facility? Referred to Heath Division. 0 Have all storage permits been submitted for storage of vehicles and hazardous waste materials on the premises? Referred to Health Division. M Why weren't the abutting neighbors notified of the reopening of the business?This is not a required action. Abutters are notified of appeal actions only. M What will be the allowable days/hours of operation for any new business conducted at the ' property? Regulatory Services does not impose operational restrictions unless there is specific language in the ordinance, a zoning decision,a legal agreement or court order. The old business seemed to operate day and night, sometimes 7 days per week,with loudly revving engine noises and cars peeling in and out of the parking lot at all times. It was also a gathering place for non-business related activity.There is a zoning noise requirement under Barnstable county Chapter 133. Will it be enforced? Unusual noise and activity to be reported to the BPD. . 0 There doesn't appear to have been any continuous business operated at this location for the past five years. Cars were parked outside for a period of weeks to months without movement prior to foreclosure and over the last 6-9 months following transfer of the deed. A letter is on file with the Town of Barnstable addressed to Thomas Perry from Michael Medeiros stating that he had not conducted business since 2011. If commercial under a non-conforming use permit, does the property not revert back to residential usage if the business was not active during a 36-month look-back period prior to sale/foreclosure? We never received a response to our October 20, 2015, letter to Thomas Perry, in which we posed this, and several other questions. It has.been determined that the non-conforming rights were not sacrificed. M Are there tax returns that can substantiate a continuous business revenue during the years in question? Regulatory Services does not require nor request tax returns. M This location also seems to have been the occasional residence of the prior owner(Mike). Is this property zoned as both residential and commercial? This is a non-conforming commercial property located in a residential zone. There appears to be misinformation and disinformation about this property. Our files indicate that the property conveyed from Michael Medeiros(auto repairs)to Steven Gould in December or 2014. In his letter, Mr. Medeiros indicates that repairs continued until he moved out.There is also a letter from Chief Olsen-Cotuit FD-dated 8-10-15 that to the best of his knowledge, 505 Main St., "has not ceased to exist has(sic) an Automotive Business within the past three years." He went on to state that, "The Cotuit Fire Rescue Department has been doing inspections on the property for an automotive business since 2008."Then commissioner Perry acknowledged this letter. On October 2,4, and 20 letters were sent to this office from citizens in the area indicating their belief that the pre-existing, non- conforming use had been abandoned.This perception appears to be based upon an unsigned letter/petition which states in part, "The use of that property has reverted back to residential with the foreclosure and the lack of a permit and no business run there for over 3 years." It is our understanding that the property was foreclosed in late 2014 with the deed assumed by Steve Gould, and that there is intention to reinstate an auto repair shop on the premises. We have been informed by our Precinct 7 Representative,Jessica Rapp Grassetti,that you are reviewing all information as pertains to non-conforming usage versus return to residential status. We can attest that there did not appear to be a viable mechanics business since 2011. The garage, under the ownership of Michael Medeiros,was in disrepair,and an unsavory social gathering place, not a place of business. On occasion,we would see Mikes'friends use the garage to fix their cars with their own tools. To our knowledge, Mr. Medeiros did not repair cars, nor did he hire anyone on premise to service them in the past 3+years. In fact,Wayne Coluccini approached Mr. Medeiros in 2013 to fix his car at 476 Main Street;--and was told that they were not in business. Due to the property location and lack of observed business since 2011,we feel that the property should return to residential usage as per code. An active, busy garage would create repair and machinery noise, increase local traffic and perhaps lead to storage on the property(cars and equipment)which would adversely affect surrounding neighbors and the bucolic nature of Main Street. There are also concerns about potential contamination of soil and air from oil,gas and chemicals used in automotive repair. Some of us have been residents of Cotuit for upwards of 30 years and have no interest in a garage business in our neighborhood. I write regarding the Cotuit Garage, Main St. , Cotuit. -When the Barnstable Zoning By-Laws went ,into effect, this property became a valid Non-Conforming Use. At that time it was. owned-by + ' an older man, Mr. .Raymond Goodspeed. He had' a heart condition, ' and his main activity was primping gasoline. He -did only the most > . minor car repairs. And he kept the property .immaculate because it 2 ' was his home; .he lived on the same lot, thirty feet, away. By -1970, after several subsequent owners, the property had fallen into grave disrepair. And also that year the gasoline storage permit was not renewed. x Most cities and towns .in Massachusetts include in their Zoning By-Laws special procedures which a Non-Conforming Use, having been dis=continued for a period of time, must follow in order to be "re-,established" The Barnstable Zoning By-Law' provides'for this in Section "P. "(A. ) (5 ) , and sets' the period of time as three years. After three, years, the only way to validly re-establish the use,•, is by grant `of a Special Exception by the Board of' Appeals, r As Town records indicate, from 1970 through 1974 no,.gas str orage-l=i,cens was issued or enewed.', Town recordsilso indicate that the- Board of Appeals has not granted a Special Exception to this property for the re-establishment of the NonLConforming Use. Yet presently on this property is the above mentioned bus- iness, .and in Januxary 1975 you acted to issue a gas- storage license to 'ahem. Cotuit Garage does not pump gasoline.
