John Anderson, Chairman of the Cotuit Fire District , was present on behalf of the Cotuit Fire District Water Department. Mr. ' Anderson stated that his..department requests that, to the extent that it is practical , the septic systems and reserve leaching areas be located outside the .four hundred foot (400 ' ) radius of the neighboring pub Pic supply- well . The department also requests that the proposed systems comply with Title V of - the State Environmental Code and al'1 Board of Health regulations . Mr. Cain stated that Caroi McCarey' s father bought the property, with, two (2) existing cottages, in 1964. , Mr. Cain submitted two (2) plans to the file. One Plan is a "1951 Cotuit Fire District Plan. The other is a 'P l-an for Elizabeth Grover Sha.fer,. dated' 1963 , showing a main house and -two (2) cottages Mr'. ' Cain stated that the subdivision creating the lot exists only by --deed; there' -is no subdivision plan-on file. FINDINGS OF FACT: Based upon the evidence- presented' the -Zoning µBoard of Appeals made the following findings of fact 1 . Procedural Summary: The application was filed on Dec. 16, 1994'and scheduled for Zoning Board of Appeals Hearing of Jan: 18, 1995.Board members sitting on.this appeal are:Ron Jansson,Elizabeth Nilsson,Emmett Glynn, Gene Burman,Chairman Gail Nightingale. 4 - Mark Robinson representing the owners informed that the house is an old Sea captain's home built over 100 years ago. They acquired a Purchase and Sales agreement last fall. The buyer's attorney saw a defect in the title but they have been able to hold the buyer through winter so far. The boundary line has a problem with clarification needed. Thirty years ago the purchase from Elizabeth Glover had not engineered survey done and the deed overlaps the boundary lines with the neighbors also no plot plans were recorded. They need to seek a variance first and then go to the Planning Board for approval of an . ANR plan. The Client is asking that ZBA would agree in principle then they will get the Engine-ering done and then get the ANR from the Planning Board. Their proposed plan is Exhibit F and a Special Permit 1990-74 Decision effects the second parcel 036-012. The Board informed the applicants that it appears the buildings were not built in accordance with the 1990 permit. The Board suggested that the applicant go to an engineer and then show this Board what they.want to do. The plans in the file do not show what this Board is specifically voting on. It-is up to the applicant to submit a plan. Zoning Board of Appeals L..,clsion and Notice _ Appeal Number 1995-10—Robinson and Chase Argument ensued between the Board and the applicant regarding the adequacy of the information given. The Board feels the information is not adequate to grant a variance because they do not have a certified plot plan showing the new proposed lot line changes. The applicant wishes this Board to advise them as to what would be granted and then go to the surveyor to have the plan drawn. The Building Commissioner asked regarding an 80L exemption plan and asked if it was recorded. He explained that no plan was on record and in 1963 the land was conveyed by deed but not surveyed and therefore there were two different descriptions of boundaries in two different deeds. Zoning Board of Appeals Hearing of February 1,1995: Mark Robinson represented his mother Elizabeth Robinson and Kevin Chase again represented himself. He explained there never was a legal lot line under zoning created between the two lots. Now they would' like to correct the deficiency. Both lots are undersized under present zoning. They are seeking a variance to the bulk regulations to deal with this problem. They submitted the new survey that the Board had requested. There is a pending Purchase and Sale agreement for the Robinson lot therefore there will be a significant,financial hardship if this variance is not executed. . Staff checked the zoning at the time in 1963 and the area required 20,000 sq.ft. Looking at Lot number 13,it is shy of that requirement. Therefore in 1963 there should have been some relief granted by the Zoning Board of Appeals and some nature of a plan filed. Nothing was ever filed in 1963 other than the exchanging of deeds. So under zoning those lots were never documented to exist and today do not conform. Ron Jansson said that there was a Chase lot because there was a deed out to.create it: Whether or not at the time the Chase lot complied with zoning appears to be the issue. Obviously it did not comply with zoning-at that time. There is only one plan recorded at the registry of deeds that shows the two lots as one. They are looking for a variance overall regarding the problems. If this were done appropriately it would have been to subdivide this land with a 41L division because there had been several pre-existing structures that pre-date zoning on this one lot. Now we have a chance to correct this problem. Legally there maybe two lots that have been created although there is no plan.There is a problem with zoning on the two lots in that if those lots exist they do not meet minimum lot area requirements. FINDINGS: Ron Jansson—Regarding Appeal Number 1995-10--Robinson and Chase: 1. The property at issue is located in an RF Residential Zoning District and it consists of two lots consisting of.62 acres and.59 acres according to what the petitioner has presented. 2. Both of these lots were created by a deed out from the major lot back in 1963 when the lot'at that time consisted of approximately 1.2 acres and contained three buildings. 3. Each of those three buildings,based upon the prior testimony that we have received,predated zoning. 4. The petitioner has been the beneficiary of a special permit 1990-47 for which they have not fully complied which has created part of the hardship for which they seek relief. 5.. The relocation of the boundary line as is proposed in the plan entitled,"Revision Plan Lots 12A _ and.13A Main Street Cotuit, (Barnstable)MA"for Kevin and Carol Ann McCarey Chase and Elizabeth Robinson dated January 24, 1995,would not be in derogation of the'spirit and the intent of our zoning ordinance. ` 6. After the discussion concerning the re- configuration of the lot line between lots 12 and 13, staff researched the case further. From this research it appears that the real issue in this appeal is the fact that under zoning the two lots in this case are one for the purposes of zoning. The property line does not exist. The division by deed in 1963 did not conform to the established zoning of the locus. Zoning in 1963 required a minimum lot area of 20,000 sq.ft. Lot 13 at 18,000+/-sq.ft. did not conform to that minimum. Furthermore,no variance was obtained to permit an undersized lot to exist,no Approval Not Required(ANR)plan was endorsed by the Planning Board and no recording of an 8 1 L plan exists. For the purposes of zoning,the two lots (numbers 12 and 13) still exist as a single lot. The discussion about relocation of the lot line apparently has little or no bearing on this appeal. The fact is the two lots w_ere.never created legally under zoning and for the purposes of zoning appear to still be one. Concerning Appeals 1995 11 through 14- Shell Oil Company Concerning the staff report, after discussion with the applicant's traffic engineer,Mr.Blumenthal, staff would like to correct the reported estimating turning movements into and out of the locus as being 824 to 1,360.- This was a double count and the figures from staff range from 412 to 680. Concerning staff question No. 1 -how many new turning movements into and out of the site?-The number is 315 added new turning movements over the 24 hour period as estimated by Mr. Blumenthal's report. ITE numbers would be slightly lower. From discussion with Mr.- Blumenthal,the AM peak hours on West Main Street on p. 6 of the consultant's report were a typo and should reflect 48 existing and 54 total cars. ADDENDUM to Zoning Board of Appeals Application for -a Variance 15 December 1994 Petition of Elizabeth C. Robinson, Owner, 689 Main Street, Cotuit Kevin P. Chase & Carole A. McC. Chase, Owners, 699 Main St., Cotuit Facts: 1) Elizabeth Glover Shafer (now, deceased) surveyed her property at 689 Main Street, Cotuit in 1963 (see Plan Book 187/113; —�T77tetV� Exhibit A) This is the only plan on record in the Registry of Deeds. , The plan shows the main house near the street (which dates to about 1870, according to the. Cotuit - Santuit Historical Society) and two small cottages in the rear. The three structures are shown on a 43,600 square foot lot. The minimum lot size for this part of Cotuit in 1963 was 20,000 square feet, according to .Barnstable Planning Dept. staff. 2) In 1964 Shafer sold McCarey/Bradlee her rear land with the two cottages on it. (See Deed Book 1265/570.) No new survey was drawn or recorded. The deed description describes the rear land to be conveyed as beginning .165 feet west of Shafer's Main Street corner bounds. The southerly boundary is described as being 229.07 feet long, which added to the remaining 165 feet equals 394.07 feet. This combined distance is 7.00 feet longer than the 387.07 feet distance given in- the 1963 survey. The 229.07' distance is repeated in each successive instrument (deeds, mortgages) conveying interests within the McCarey/Bradlee family. Present owner Carole McCarey Chase inherited the land from her father and cousins in 1989. .(See Deed Book 7021/224.) She now owns the lot with her husband Kevin P. Chase. (See Deed Book 7340/340; Exhibit B) In 1990 they received a special permit from the ZBA to relocate and reconstruct the two cottages. The western cottage was demolished, removed and reconstructed in 1990. The eastern cottage remains intact. The eastern cottage is 10± feet from the sideline setback. (See Exhibit C.) Shafer retained `the remaining 18,300± square feet around the main house in 1964. 3) In 1966 Shafer sold the front lot with the- main house to Robinson (See, Deed Book 1354/416; Exhibit D.). The southern and northern boundary lines are described in deed as being 165 feet long, running .back from Main Street. Again, no new survey was made- to show the division line between McCarey .& Robinson. In 1982 Robinson secured a building permit'- to reconstruct an attached garage and tool room (see Exhibit E). In 1994 Robinson entered into a purchase and sales agreement to sell the front lot and house. .This agreement has been extended to February 1995, pending favorable clearing of the title. ISSUES: 1 3 S G a EAZ ff.. . ..A t'-_ 1) Robinson seeks a variance to conform with minimum lot size: • The Robinson lot consists of about 18,300 square feet, less than the minimum lot size now of 40,000 square feet, but, also, less than the 20,000 square feet required in 1963. Robinson cannot meet . either area requirement. 2) Chase seeks to reach agreement on altering the lot" line to enable the sideline setback from Robinson to be met: • The Chase lot exceeds 20,000 square feet, but does not exceed 40,000 square feet. The remaining cottage does not meet the. 15 feet sideline setback requirement (from the Robinson lot or the lot to the north) under present zoning. 3) Both parties wish to clarify the corner of a common boundary: • The distance of the southerly boundary of both the Robinson and Chase lots does not conform with the 1963 survey. Robinson believes the distance of her boundary line is 165 feet; Chase's deed and survey claims that the Robinson line is only 159 feet long. PROPOSED RESOLUTION: Robinson and Chase are jointly, petitioning the ZBA for relief from zoning requirements in. an attempt to meet the standards as best as . possible given the ancient history of these lots. Robinson and Chase are cooperating on this venture. , Both parties wish to see the pending Robinson sale be consummated with this agreement between the neighbors. 1) Robinson and Chase agree to petition the- ZBA and Planning Board 7",ft jointly to resolve the undefined boundary line and secure variances. The proposed new boundary line (see Exhibit F will: . • 'split tig4 difference in the seven feet discrepancy in the distance of the southerly boundary; and, then, • pivot the westerly Robinson. line six feet\in a southwest- northeasterly direction to enable Chase to meet or exceed the 15-foot sideline setback from the eastern cottage and to enable Robinson to include on her lot all of her driveway and the forsythia hedge (planted by Robinson 20 years ago) between the two properties; and, • not affect any other adjacent properties or rights of way. 2) Based upon assumed approval of a variance from the ZBA, , Robinson .and Chase agree to petition the Planning Board for° an Approval Not Required survey showing the new permitted boundary line. This ANR survey will be recorded in 'the Registry of Deeds. 3) Robinson and Chase agree to sign and' record a boundary line agreement based upon favorable. outcome of the ZBA and Planning Board decisions. ' 4) Time is of the essence in this entire process so as not to jeopardize Robinson's pending purchase and sales agreement. Mr. Thorng stated that the lot contains two } 2 (2) existing cottages and two (2) cesspools . The .applicants propose to upgrade the cottages by demolishing the existing cottages and rebuilding them. Mr. Thorng stated that the cottages will be rebuilt with basically the same square footage and footprint. The applicant will be reducing the total number of bedrooms between the two (2) cottages from five (5) to three (3) : One cottage will have two (2) bedrooms and the other will have one ( 1 ) bedroom. The applicant will be upgrading the septic systems so that they comply with Title V regulations. John Anderson , Chairman of the Cotuit. Fire District, was present on behalf of the Cotuit Fire District Water Department. Mr. Anderson stated that his department requests that, to the extent that it is practical , the septic systems and reserve leaching areas be located outside the four hundred foot (400 ' ) radius of the neighboring public supply well . The department also requests that the proposed systems comply with Title V of . the State Environmental Code and all Board of Health regulations . Mr. Anderson recommended to the Board that the piping for one of the leaching pits be extended so as to remain outside the four hundred foot (400 . ) radius. The Board asked if the cottages will be year-round rentals. Mr. Chase responded that he will be living in -the ,one ( 1 ) bedroom cottage and .the other cottage will be rented on a year-round basis . Presently, Mr. Chase resides in the two (2) bedroom cottage and he rents out the three (3 ) bedroom cottage in the summer. Attorney Richard Cain spoke in favor of the application. Mr. Cain stated that Carol McCarey' s father bought the F, property, with two (2) existing cottages, in 1964. Mr. Cain submitted two (2) plans to the file. . One Plan is a 1951 Cotuit Fire District Plan. The other is a Plan for Elizabeth Grover Shafer, dated 1963, showing a main house and two (2) cottages . Mr : Cain stated that the subdivision creating the lot exists only by deed; there is no subdivision plan on file. The Board asked if the lot would be further subdivided and Mr. Thorng stated that it would not be 4 FINDINGS OF FACT: ` Based upon .the evidence presented, the Zoning Board of Appeals made the following findings of fact : 1 . The., proposed plan conforms more to the Town of Barnstable Zoning Bylaw than the existing dwellings , due. to the. fact that the existing_ dwellings .are located on the property line; „ 2 . It would. be more beneficial to the community for the lot to have septic systems that comply with' Title V regulations as opposed to ,the cesspools that now exist; and 3 . The Board has received testimony that the total number of bedrooms between the two (2) cottages will be three (3) as opposed to the total of five (5) existing bedrooms. J. Massachusetts , the applicants , Carol McCarey and Kevin Chase,. applied to the Board for a Special Permit pursuant to Section 4-4. 2 of the Zoning Bylaw, Change from one non-conforming use to another, in order to rebuild and relocate two (2) existing cottages . SUMMARY OF EVIDENCE: The following material evidence was submitted to the Zoning Board of Appeals file: Staff report prepared by the Department of Planning and I Development; Plan entitled "Proposed Location of Dwelling and Sewage System Dwellings 'A' & 'B' 699 Off Main Street , Cotuit , prepared by Arrow Engineering Inc. , dated March 22, 1990 ; Letter from the Cotuit. Fire District Water Department dated August 8, 1990 ; Plan entitled "Plan of Land in Cotuit-Barnstable-Mass . for the Cotuit Fire District" , prepared by Charles N. Savery, dated November 1951 ; and Plan entitled "Plan of Land in Cotuit , Barnstable, Mass . belonging to Elizabeth Glover Shafer" , prepared by Nelson Bearse - Richard Law Surveyors, dated November 20, 1963 . George Thorng of Arrow Engineering was present to represent the applicant . Mr. Thorng stated that the lot contains two 2 (2) existing cottages and two (2) cesspools . The applicants propose to upgrade the cottages by demolishing the existing cottages and rebuilding them. i Mr. Thorng stated that the cottages will be rebuilt with basically the same square footage and footprint. The applicant will be reducing the total number of bedrooms between the two (2) cottages from five (5) to three (3) . One cottage will have two (2) bedrooms and the other will have one ( 1 ) bedroom. The applicant will be upgrading the septic systems so that they comply with Title V regulations. John Anderson , Chairman of the Cotuit Fire District , was present on behalf of the Cotuit Fire District Water Department. Mr. Anderson stated that his department requests that, to, the extent that it is practical , the septic systems and reserve leaching areas be located outside the four hundred foot (400 ' ) radius of the neighboring public supply well . The department also requests that the proposed systems comply with Title V of the State Environmental Code and all Board of Health regulations . Mr. Anderson recommended to the Board that the piping for one of the leaching pits be extended so as to remain outside the four hundred foot (400' ) radius . The Board asked if the cottages will be year-round rentals . Mr. Chase responded that he will be living in the one ( 1 ) bedroom cottage and the other cottage will be rented on a year-round basis . Presently, Mr. Chase resides in the two (2) bedroom cottage and he rents out the three (3) bedroom cottage in the summer. Attorney Richard Cain' spoke in favor of the application. Mr. . Cain stated that Carol McCarey' s father bought the property, with two (2) existing cottages, in 1964. Mr. Cain j submitted two (2) plans to the file. One Plan is a 1951 Cotuit Fire District Plan. The other is a Plan for Elizabeth Grover Shafer, dated 1963 , showing a main house and two (2) cottages . Mr . Cain stated that the subdivision creating the lot exists only by deed; there is no subdivision plan on file . The Board asked if the lot would be further subdivided and Mr. Thorng stated that it would not be. FINDINGS OF FACT: Based upon the evidence presented, the Zoning Board of Appeals made the following findings of fact : 1 . The proposed plan conforms more to the Town of Barnstable Zoning Bylaw than the existing dwellings , due to the fact that the existing dwellings are located on the property line; f 3 2 . It would be more beneficial to the community for the lot to have septic systems that comply with Title V regulations as opposed to the cesspools that now exist; and i i 3 . The Board has received testimony that the total number of bedrooms between the two (2) cottages will be three (3) as opposed to the total of five (5) existing bedrooms. The vote on the findings of fact was as follows : AYES: BLISS, BOY, JANSSON, LALLY, MCGRATH NAYES: NONE DECISION: Based upon the evidence presented and the findings of fact , at a meeting held August 9, 1990, by a motion duly made and seconded, the Zoning Board of Appeals voted to grant the Special Permit with the following conditions : 1 . All state and local regulations regarding distance from a public supply well shall be met; 2 . The septic system for building A , as shown on the submitted plan, shall be located as far as can be practical from the neighboring wellfield, as requested by the Board of Commissioners of Cotuit Water District; i. 3 . All construction shall comply with the footprint as j shown on the submitted plan and the combined number of bedrooms between the two (2) dwellings shall not exceed three (3) and 4 . The septic systems , when installed, shall comply with the provisions of the Title V regulations of the Board ' of Health. The vote was as follows : AYES : BLISS, BOY, JANSSON, LALLY, MCGRATH NAYES : NONE r Any person aggrieved by this decision may appeal to the Barnstable Superior Court, as described in Section 17 of Chapter 40A of the I General Laws of the Commonwealth of Massachusetts by bringing-an action within twenty days after the decision has been filed in the office of the Town Clerk. The applicant will be upgrading the septic systems so that they comply with Title V regulations. John Anderson , Chairman of the Cotuit Fire District, was present on behalf of the Cotuit Fire District Water Department. Mr. Anderson stated that his department requests that, to the extent that it is practical , the septic systems and reserve leaching areas be located outside the four hundred foot (400' ) radius of the neighboring public supply well . The department also requests -that the proposed systems comply with Title V of the State Environmental Code and all Board of Health regulations . Mr . Anderson recommended to the Board that the piping for one of' the leaching pits be extended so as to j remain outside the four hundred foot (400' ) radius . The Board asked if the cottages will be year-round rentals . i Mr. Chase responded that he will be living in the one ( 1 ) bedroom cottage and the other cottage will be rented on a year-round basis . Presently, Mr. Chase resides in the two (2) bedroom cottage and he rents out the three (3) bedroom cottage in the summer. Attorney Richard Cain spoke in favor of the application. Mr. Cain stated that Carol McCarey' s father bought the property, with. two (2) existing cottages, in 1964. Mr. Cain submitted two (2) plans to the file. One Plan is a 1951 Cotuit Fire District Plan. The other is a Plan for Elizabeth Grover Shafer, dated 1963 , showing a main house and two (2) cottages . Mr . Cain stated that the subdivision creating the lot exists only by deed; there is no subdivision plan on file . The Board asked if the lot would be' further subdivided and Mr. Thorng stated that it would not be. FINDINGS OF FACT: Based upon the evidence presented, the Zoning Board of Appeals made the following findings of fact : 1 . The proposed plan conforms more to the Town of Barnstable Zoning Bylaw than the existing dwellings , due to the fact that the existing dwellings are located on the property line; 3 2 . It would be more beneficial to the community for the lot to have septic systems that comply with Title V regulations as opposed to the cesspools that now exist; and I I 3 .
