In this scenario, the applicants are requesting a permit to allow for the expansion of a non-conforming building and structure. • The existing single-family dwelling does not conform to the required side and front yard setback for the district. Procedural.& Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on November 28, 2000. An extension of time for hearing the appeal and filing the decision was executed between the applicants and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on January 10, 2001. Board members hearing this appeal were Dan Creedon, Gail Nightingale, Tom DeRiemer, Jerry Gilmore and Chairman Ron S. Jansson. At the opening of the hearing, Attorney John Alger explained the nature of this request and an accompanying request for a Variance Appeal 2001-05. He determined that it would be in the best interest of the applicant and Board to proceed with the Special Permit for the substantial remodeling of the home. Mr. Alger requested Appeal 2001-05 be withdrawn without prejudice and requested the hearing on Appeal 2001-06 be continued to allow the applicant's architect Peter Pometti, to address the neighbors concerns regarding the proposal. At the hearing on March 21, 2001, Mr. Alger, representing the petitioner, stated that the architect had • meet with the neighbors and had revised the plans to address their concerns regarding the destruction of this building. Copies of the revised plans dated February 26, 2001, had been submitted to the board on March 6, 2001. These new plans illustrate the changes.that were agreed to by the abutters and the • architect. He further stated that the fagade of the building facing onto Main Street will be maintained. There will be a minimum of ten feet on the sideline where the new plans show a single-car garage. There will not be any more trees removed from the property. Findings of Fact: At the hearing of March 21, 2001, the Board found the following findings of fact in Appeal 2001-06: 1. The applicants are Barbara A. Kern and Jill Phelps Kern. The property is located at 701 Main Street, Cotuit, MA, Assessor's Map 036, Parcel 010. The location is Zoned Residential F and is located in the Wellhead Protection Overaly District 2. The applicant's request is for a special permit in accordance with Section 4-4.3(2) Non- Conforming Buildings and Structures used as a Single or Two- Family Dwelling to allow for the expansion of a non-conforming building and structure. The proposed changes to the structure would not infringe more into the established side and front yard setbacks. The applicant proposes to substantially remodel and renovate the existing dwelling and construct a garage. 6. The applicant's architect has worked with the neighbors in the development resulting in an acceptable plan for the remodeling and renovations. No opposition to those plans has been expressed from the neighbors. 7. That application falls within a category specifically excepted in the ordinance for a grant of a Special Permit. 8. That after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the • Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. The dwelling is an historic structure and alterations were required to be approved by the Historic Commission of the Town. In that process,the Commission required that the front historic section of the home not be realigned and remain as is on the site. This requirement necessitated a redesign and new layout of the structure on the lot that is not exact to the one approved by the Zoning Board. I have reviewed the proposed new elevations and proposed new site plan. Those changes required by the Historic Commission although not exact to the plans present to the Board are in keeping with the intent of the permit issued and do not represent a substance deviation from those plans presented to the Board I would hope that you would concur with this and not require the applicant to seek the Boards review and approval of the newer plans. If these variances are granted the petitioners would then demolish the existing dwelling and deck and build the new dwelling and garage in approximately the same location as the present structures are situated. Background: The locus of this appeal is a 0.24 acre site located at the intersection of Main Street, Cotuit, and an un-. named way that accesses the two back lots, and a Cotuit Fire District wellhead lot. The locus is developed with a 1 &1/2 story, 3,184 gross sq.ft.,4 bedroom single-family dwelling. The structure has an attached garage included in the gross area. Also on site is an existing open-air deck of 20'x 24'. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on November 28,2000. An extension of time for hearing the appeal and filing the decision was executed between the applicants and the Board. A public.hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on.January 10, 2001. At.the opening of the hearing,Attorney John Alger explained that nature of this request and an accompanying request for a Special Permit-Appeal 2000-06. He determined that it would be in the best interest of the applicant and Board to proceed with the special permit for the substantial remodeling of the home. Motion: At the January 10, 2001 hearing, a motion was duly made and seconded to grant the petitioner's request to withdraw their application for a variance without prejudice.
