The current exemption for "homeowners" was extended,to., include owner- occupied dwellings of six units or less and to allow such homeowners to engage an individual for hire who does not possess a, license, provided that the owner acts as supervisor. " Many Home Owners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q Rules for Licensing Construction Supervisors, Section 2.15`) . - This alack eoflations awareness often results in serious problems, particularly when the Home Owner hires unlicensed persons. In this case our Board cannot proceed against the unlicensed person as it would with licensed supervisor. The fi Home Owner acting as supervisor is ultimately responsible. To- ensure that the Home Owner is fully aware of his/her responsibilities, many communities require, as part of the permit application, that the Home Owner certify that he/she understands the- tesponsibilities of a supervisor. Procedural Provisions: Section 5-3.2 (3) : Variances Background Information: This decision concerns the petition submitted by Dennis Konary, requesting a Bulk Variance to allow for the creation of a lot with a frontage of 20 feet in the RF Zoning District which requires 150 feet of frontage. According to the Assessor Map Records the vacant lot is 1.09 Acres and is located on Main street, Cotuit immediately adjacent and south of the Cotuit General Store, Parcel 046, the subject of Appeal No. 1993-71. The Petitioner is proposing to re-configure ,oth parcels 007 and 046 as illustrated on the submitted plan titled "Site Plan, Cotuit, Mass for Dennis Konary" by Baxter & Nye, Inc. dated August 18, 1993, revised December 03, 1993. The end result of these adjustments being to create a "pan handle lot" of 1.31 acres for residential use with a 20, frontage as lot 2. Procedural Summary: The application was filed in the offices of the Town Clerk and at the Zoning Board of Appeals office on October 28, 1993. A public hearing duly noticed under M.G.L. Chapter 40-A was opened on December 02, 1993, at which time the hearing was closed and a decision was rendered by the Board. The petition was heard by Board Members; Gale Nightingale, Ron Jansson, Dexter Bliss, Emmett Glynn and Chairman, Richard Boy. This appeal was heard concurrently with Appeal No 1993-71, that appeal for a Special Permit to allow for the re- configuration of a lot upon which a non-conforming use is located. To accomplish the plan for the re-configuration of the lots, both the Special Permit and Variance would be required. . BOOK HmPAGE '`= PPeal No. 1993-72 Decision and Notice Mr. Alger represented the applicant, Mr. Konary. He gave a brief history of the acquisition of the parcels by Milton Crocker and presented a plan dating to that acquisition that illustrated the two parcels at that time. He cited that one lot was developed with a single family dwelling and the other with the Cotuit Grocery Store. The store pre-dates zoning and today is non- conforming in use. Mr. Alger cited that a Variance would be required to permit a lot with only 20 feet of frontage. Mr. Alger explained that the lot in its present configuration does not have sufficient frontage to meet zoning requirements and that the shape of the parcel, individually or as united with the adjoining lot northward (Lot 046) has a shape that is not conducive to a suitable building site. He also cited that the location of the land within the 400 foot radius from a public well head also creates a hardship to development. Mr. Alger explained the plan noting that the Lot 2 on the proposed plan would become 1.3 acres in size with the re-configuration of its shape. Area would also be transferred between the neighboring Lot, #046, adjacent to the north. The re-configuration of that lot, Lot, #046, would also require a Special Permit as requested in Appeal No 1993-71. The Commissioner from the Cotuit Water District was present. The Water District well is located within 400 feet of the proposed lot configuration and the district has requested of the applicant modifications and changes to the plan within the 400 foot area to assist in the protection of groundwater recharge to the well. Attorney Alger has noted that the plan revised and dated December 03, 1993 represents that desire of the district . The plan also calls for a 12 foot strip to be segmented from Lot #036 and the area transferred to three neighboring parcels to the south and fronting on to Coolidge Street. This area would further buffer the Cotuit Grocery commercial use from neighboring residential use, and increase in size the three undersized residential lots. The public was invited to speak on the proposal and Jim Adams, a neighbor spoke for the neighbors who a e in favor. No one spoke in opposition to the petition. Find of Facts: Based upon the evidence submitted and the Testimony given at the public hearing on Appeal No. 1993-72, The zoning Board of Appeals unanimously found: 1. A substantial portion of rear of the two lots in question are located within the 400 ft. buffer of the Cotuit Fire District Wellfield No. 3. 2. The lot, at one time, was developed with a single family dwelling and additional buildings that were located in close proximity to Main St. 3. The lot abuts lot #046 which contains a non-conforming use, the Cotuit Grocery Store. 4. Due to the location and configurations of the lot as they exist, as well as the 400 ft. buffer that cuts through both lots, the Variance 2 Appeal No. 1993-72 Decision and Notice conditions have been established and that shape also creates the hardship for which relief is being sought. S. Granting the relief sought would not be in derogation of the spirit and intent of the Zoning ordinance. Conclusion: Accordingly, based upon the findings, a motion was duly made and seconded that Appeal No. 1993-72 for a Bulk Variance to Minimum Lot Frontage be granted in accordance to allow the creation of a lot with 20 feet of frontage, subject to the following conditions: 1. The lots being shown as lot 1, lot 2 and parcels A, B and C be so configured and annexed as is set forth in the plan titled "site Plan, Cotuit MA for Dennis Ronary", scale 1" equals 40, and dated August 18, 1993, last revised on December 3, 1993. 2. That the proposed septic system for Lot 2 be located as close to what is shown as parcel A and parcel B as is possible and as far away from the so-called 400 ft. radius of the well field. 3. That, within a 30 ft. strip drawn parallel to the 400 ft. well head protection radius illustrated on the plan, the property shall remain in its naturally vegetated state, to the extent possible, unless there is approval by the Cotuit Fire District, 4. Within the 430 foot radius area from the well head, there be no loading on that area of pesticides, herbicides or fertilizer. 5. The proposed single family dwelling on Lot #2 shall be as designed to be 441x 28, ft. in size and shall not be located any closer to the 400 ft radius than what is shown on the plan present.
