Driscoll and Alexis C. Burns Ladies and Gentlemen: This correspondence is submitted on behalf of the Applicants, Agnes D. Driscoll and Alexis C. Burns with reference to their applications for special permit and variance, respectively, relating to their property located at 801 Main Street, Cotuit, .Massachusetts. Background The Applicants are currently the owners of the property depicted as Lot.103 on Assessors' Map 35. The property consists of 1.02 acres of land with an existing single family home located on the far eastern side of the property. A copy of the Assessors' Map is attached hereto as Exhibit A. The subject property is highlighted in yellow. The Applicants seek a special permit and/or variance in order to allow for subdivision of the existing parcel into two parcels (Parcels B and Q. Parcel C would contain 28,362 square feet (.65 acres) which would be retained by the Applicants. Parcel B which would be created would contain 16,287 square feet (.37 acres) and would deeded to the adjacent land owners, Dr. and Mrs. Michael Lazor. A copy of the proposed ANR Plan is attached as Exhibit B. The Applicants have authorized the filing of this application and a copy of the authorization dated April 29, 2000 is attached hereto as Exhibit C. 0 y 5 r NUTTER, McCLENNEN & FISH, LLP J Zoning Board of Appeals May 30, 2000 Page 2 The current owner, Agnes D. Driscoll, purchased the pro per ty on August 19, 1977. A copy of the deed into Mrs. Driscoll is attached hereto as Exhibit D. The property was. previously owned by Chandler and Faye Robbins who purchased the property in 1967. Subsequent to her purchase, Mrs. Driscoll conveyed a one-half interest to her daughter, Alexis C. Burns, and Mrs. Driscoll and her daughter now hold the property as joint tenants. See deed attached hereto as Exhibit E. The parcel derives from a subdivision of land approved as an ANR Plan on November 1, 1976, a copy of which plan is attached hereto as Exhibit F. At the time of creation in 1976 and conveyance to Mrs. Driscoll in 1977, the subject property had frontage totalling 129.19 linear feet. The subject property is located in the RF Residential District and in accordance with Section 3-1.4, the current minimum lot frontage is 150 feet. Immediately adjacent to the south of the westerly portion of the Driscoll lot is a property consisting of .28 acres owned by Dr. and Mrs. Michael Lazor. That property is rt denoted as Parcel 66 on Assessors' Map 35 attached hereto as Exhibit A, and is highlighted in pink. Dr. and Mrs. Lazor wish to purchase Parcel B as shown on the proposed ANR Plan attached hereto as Exhibit B. The Lazor family has a long standing relationship to the Town of Barnstable and the Village of Cotuit. Three generations of the family have lived in the Village of Cotuit and several are currently buried at Mosswood Cemetery. The Lazors, in conjunction with the Applicants, wish to add a small addition to their existing single family house located at 60 Nickerson Lane. The proposed transfer of land will result in an increased conformancy with the current non-conforming set back of the garage and existing single family home on the Lazor property. The proposed transfer will also make more.conforming the Lazor lot, while at the same time maintaining a significant lot size'(in comparison with the neighborhood) for the Driscoll property. Further, the additional land to be located in Parcel B will allow the Lazors greater flexibility to upgrade the current septic system serving their residence. Special Permit Criteria The Applicants seek a special permit in order to allow for conveyance of .37 acres (a/k/a Parcel B as shown on Exhibit B) to the abutting property owner at 60 Nickerson Lane by an Approval Not Required Subdivision Plan, resulting in an already legal, non-conforming lot becoming more non-conforming. As noted above, the Driscoll parcel currently is a non- conforming lot in that it does not meet frontage.;requirements. Accordingly the lot and buildings located thereon are deemed "non-conforming." While maintaining the existing frontage, the proposed subdivision and transfer will result in a reduction of the total amount of lot size. At the same time, the proposed transfer of the property to the Lazor property will r NUTTER. McCLENNEN & FISH. LLP Zoning Board of Appeals May 30, 2000 Page 3 result in an increase in the amount of acreage and will make the Lazor property conforming as it re lates to set back requirements.q ents. Under Section 4-4.3, the alteration or expansion of a non-conforming building or structure utilized as a single family residence may be allowed by special permit, if the alteration will not be substantially more-detrimental to the neighborhood than the existing building or structure. The Lazor property is currently non-conforming as to set back. The transfer of Parcel B as shown on Exhibit B will create a conformity and, therefore, will not be detrimental to the neighborhood. Further, the Driscoll property will retain its general aesthetic appearance from the roadway and will not be impacted or affected by the proposed transfer. Further, the neighborhood will not be detrimentally affected in that.the number of residences will remain the same and there will be no increased impacts, visual or otherwise. The ability to upgrade the Lazors' septic system will clearly fulfill the spirit and intent of the Zoning Ordinance without substantial detriment to the public good or the neighborhood. Accordingly, the Applicants meet the criteria for the granting of a special permit under Section 5-3.3. Variance Criteria The recording of the ANR Plan and deeding of Parcel B will result in the creation of a non-conforming lot arcel C as shown on Exhibit B) as it relates to lot size. Accordingly, a variance may be required with reference to same. The standards under Massachusetts General Law Chapter 40A, Section 10, require that the proposed relief be required as the result of unique shape, soil or topography conditions on the.property and that those conditions create a hardship for the applicant which is unique as to the Zoning District. The size of the Lazor lot is substantially smaller than many of the surrounding lots within the general neighborhood. More importantly, the shape of the Driscoll property being elongated and rectangular in shape provides a hardship which is unique under the circumstances. Based upon the location of the existing structures on the Driscoll parcel, it is infeasible for the Driscolls to utilize the balance of the property for expansion of the Driscoll residential use or structures. Further, the inability to build on the Lazor property due to its size presents unique issues relating to shape of that lot in association with the Driscoll property, all of which may be considered by this Board. This represents a hardship to both the Applicants and Dr. and Mrs. Lazor which is directly related to th6shape of the Driscoll lot. In conformance with statutory requirements, the relief requested will not be a substantial detriment to the neighborhood or the surrounding properties. To the contrary, it will.allow for the retention of the same number of residential structures, greater conformity to set back requirements on the Lazor parcel and the ability to upgrade the Lazors' septic system. Further, the proposed relief will not derogate from the intent and purpose of the Zoning Ordinance. Conclusion Based on the foregoing, the Applicants would respectfully request the granting of a special permit and/or variance with such conditions as the Board may deem appropriate or necessary. The applicant is proposing to divide the one lot into two, thus allowing each dwelling to be on it's own separate lot. The plan for the division shows; • the 3 room ranch located on proposed Parcel A of 6,966 sq.ft. or 0.16 acre, fronting on Lewis Pond Road, and • the 2 room cottage located on proposed Parcel B of 13,834 sq.ft. or 0.32 acre, fronting on Lake Street. To accomplish the plan, dimensional variances are needed. Those variance appear to be as follows: 1. Variance from Section 3-1.4(5) Bulk Regulations-Minimum Lot Area-to permit two undersized lots, Parcel A to be 6,966 sq.ft. when 43,560 sq.ft is required, and Parcel B to be 13,834 sq.ft. where 43,560 sq.ft. is required. 2. Variance from Section 3-1.4(5) Bulk Regulations- Minimum Lot Frontage-to permit two lots to exist without the required frontage, Parcel A has only 80 feet of frontage when 150 feet is required, and Parcel B has only 80 feet when 150 feet is required. 3. Attorney Butler explained the relief being sought. The current owner, Agnes D. Driscoll, purchased the property in 1977 and her daughter, Alexis Burns, received a half interest in 1994. The subject property was created in 1976 pursuant to an ANR Plan with frontage totaling 129.19 linear feet. The current minimum lot frontage is 150 feet making this lot pre-existing nonconforming. Immediately adjacent to the south of the westerly portion of this lot is a property consisting of.28 acres which is shown as Parcel A on the ANR plan. The applicants are creating a new parcel of.37 acres shown as Parcel Bon the ANR plan. The remaining lot(on which the Driscoll's house sits) is labeled Parcel C. The Applicants are seeking a Special Permit in order allow this transfer of Parcel B to the abutters [the Lazors]thus creating two lots (Parcel A+B and Parcel C) both approximately .65 acres in size. The proposed transfer of the property will result in an increase in the amount of acreage for the lot making the property conforming as it relates to set back requirements. Mr. Butler indicated the transfer would allow the Lazors to upgrade their septic system to Title V. They intent to put on a modest addition of approximately 600 square feet-not a"trophy house".
