Leveroni Trustee At a regularly scheduled hearing held on February 11, 1988 , notice of which. was duly published in the Barnstable Patriot , and notice. of which was forwarded to all interested parties pursuant to Chapter 4.OA of the General ;-:aws of Massachusetts, the Petitioner requested a -Special Permit of Section 4-4 .2 of the Town of Barnstable Zoning bylaws to ,. relocate a non-conforming structure away from the property lines located at 845 Main Street , Cotuit . In support of this petition, the petitioner presented evidence that the following conditions applied which would warrant granting the Special, Permit : The petitioner owns a 50 , 174 square foot lot which contains a structure with two summer apartments as is shown on Plan of Land entitled: "Plan of Land in Barnstable, Massachusetts (Cotuit ) for Daniel W. Leveroni, dated August 11, 1987 , "The petitioner had previously hadtusland subdivided into two lots consisting of 50 , 174 square feet and 43, 606 square feet . The Board determined that the size of the building is 30x42 feet and that there will be no increase in the size of Uie bUil:iag when it is- relocated. Based upon the evidence submitted, the Board of Appeals voted to grant a special permit to permit the existing 30x42 foot structure to be relocated away from the side lot lines to a location on the same lot that is in conformance with the sideyard setback requirements of the zoning bylaw . The reasoning for this is that a relocation of the building would be more in conformance with the zoning bylaws than the existing location and would be beneficial for the neighborhood. -2- In granting the Special Permit , the Board did not make any findings regarding the non-conformity of the use on said lot . At a public hearing held on March 31, 1988, the Zoning Board of Appeals voted by a majority vote to grant the Special Permit sought . The following members voted on the petition: In Favor Opposed Ron S. Jansson, Chairman Paul Brown Dexter Bliss Helen Wirtanen Richard L. Boy The Zoning Board of Appeals has imposed the following conditions , the breach of which shall invalidate the Special'. Permit being granted: 1) That the plan entitled "Plan of the Land in Barnstable, Mass . (Cotuit ) for Daniel w. Leveroni, dated August 11, 1987 , a copy of which is on file with the Zoning Board of Apeals be fully complied with unless otherwise noted herein, especially as it relays to the proposed setback from the sidelines; 2 ) that the building not be building' s current enlarged and that the,/size be maintained as 30x42 feet in size; 3 ) it is to be noted that in granting this special permit the Zoning Board of Appeals has specifically not acted upon any relief which may be subject to the provisions of Chapter 41, 81L. Any person aggrieved by this. decision may appeal to the Barnstable Superior Court or Land Court of the Commonwealth of Massachusetts, as prescribed in section 17 of Chapter 40A of the General Laws of Massachusetts . by filing a Complaint In said Court(s) as well as a notice of action with the Barnstable Town Clerk, within twenty (20) days of the filing of this decision with the Barnstable Town Clerk' s Office.
