The parcel is developed with a one-story 968 sq.ft. structure that is used as a real estate office and apartment. The structure and use predates the 1950 zoning of this area of the Town. In 1973, the Board issued Special Permit 1973-15. According to the file,the site had a history of non-conforming uses that included an ice cream parlor,variety store and souvenir shop. In 1973,the Board permitted the use to change from a wig shop to a real estate office and to retain the residential apartment that was also located within the structure. In 1979,the property was again before the Board seeking a Modification of the 1973 Special Permit. Special Permit 1979-68 was issued to permit a total of three (3) `brokers'to be employed on the premises. The application before the Board proposes to demolish the existing structure on the property and construct a new 3-bedroom single-family dwelling with a 400-foot"in-home" boat/real estate broker's office. The proposed new structure will be 2,500 sq.ft., accessed from Oyster Place Road. The applicant is seeking two forms of relief: Appeal 2001-92 Modify the existing Special Permit to allow the continuation of both the office and residential use of the site. Appeal 2001-91 Vary the bulk regulations to permit the undersized lot of 9,467 sq.ft.to be buildable under zoning when acre is required and to site a structure on it not in conformance to the required front yard setbacks. The required 30 foot front yard setback onto Oyster Place Road is to be reduced to 9.5 feet. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 08, 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly 1 • f advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August.22, 2001, at which time the Board found to grant the variance with conditions: Board Members deciding this appeal were Richard L. Boy, Thomas A. DeRiemer,Ralph Copeland, Jeremy Gilmore, and Chairman Ron S.Jansson. Attorney Michael Ford represented the applicant,who was also present, before the Board. Attorney Ford explained the proposal,noting that single-family use would be the dominant use of the property in keeping with the underlying zoning and that the proposed office use would be accessory to the residential use. Mr. Ford presented the plan for redevelopment of the site and elevations of the proposed structure. Site improvements include a new Title V on-site septic system, a new driveway into the site, drainage, and an on-site parking area. The new driveway and parking located on the site is depressed below the existing grade. The first floor elevation of the building is at 28 feet and the basement garage will be about 20 feet. The new structure has been shifted to a more centered location on the lot. It is placed with a 30-foot setback from Main Street, 10.6-foot setback from Oyster Place Road and 15-foot setback to the side yard. Mr. Ford noted that the mixture of residential with a"home" occupation is in keeping with traditional village centers and the proposed would be in keeping with the goals of the village plan for Cotuit and the Local Comprehensive Plan. Robert Hayden spoke in favor of the application. The Chairman noted that two letters of support were also received. Findings of Fact: At the hearing of August 22, 2001,the Board unanimously made the following findings of fact: 1. With reference to Appeal 2001-91,the applicant Don MacEachern has applied for a variance to Section 3-1.4 (5) Bulk Regulations. The applicant seeks to demolish the existing structures on the premises and construct a new primary residence and in-home office. The property is show on Assessors Map 035,Parcel 091, addressed 904 Main Street, Cotuit,MA in a Residential F Zoning District, Groundwater Protection Overlay District and the Resources Protection Overlay District. 2. The application before the Board proposes to demolish the existing structure on the property and construct a new 3-bedroom single-family.dwelling with a 400-foot "in-home" boat/real estate broker's office. According to the application,the proposed new structure will be 2,544 sq.ft. 3. The proposed change in the primary nature of the use is to a single-family dwelling, more in keeping with the underlying zoning of the area. 4. The shape of the lot is triangular in nature,with frontage on Main Street and Oyster Place Road and is unique in the general zoning district. The shape of the lot is such that in order to meet the setback requirements from both streets for the proposed dwelling with a home office,it cannot be located on the site to comply with all applicable yard setback requirements, since two 30-foot front yard setbacks are required. The proposed structure is 9.5 feet from the layout of Oyster Place Road. 5. As a result of the shape of the lot and the two frontages,the petitioner suffers a hardship in attempt to relocate and reconstruct the existing non-conforming structure that is located only 3.8 feet from Main Street and 2.5 feet off of a neighbor's sideline. The proposed structure complies with the front yard setback from Main Street (30 feet) and the side yard setback (15 feet). 2 6. The proposed new structure is.more in keeping with the neighborhood and complies more nearly with the required setbacks for the district and as a result.the relief can be granted without substantial detriment to the neighborhood and to the public good without derogating from the purpose and intent of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the variance with the following conditions: 1. The parcel is developed with a one-story 968 sq.ft. structure that is used as a real estate office and apartment. The structure and use predates the 1950 zoning of this area of the Town. In 1973,the Board issued Special Permit 1973-15. According to the file,the site had a history of non-conforming uses that included an ice cream parlor,variety store and souvenir shop. In 1973,the Board permitted the use to change from a wig shop to a real estate office and to retain the residential apartment that was also located within the structure. In 1979,the property was again before the Board seeking a Modification of the 1973 Special Permit. Special Permit 1979-68 was issued to permit a total of three (3) `brokers'to be employed on the premises. The application before the Board proposes to demolish the existing structure on the property and construct a new 3-bedroom single-family dwelling with a 400-foot "in-home" boat/real estate broker's office. The proposed new structure will be 2,544 sq.ft., accessed from Oyster Place Road. The applicant is seeking two forms of relief: Appeal 2001-92 Modify the existing Special Permit to allow the continuation of both the office and residential use of the site. Appeal 2001-91 Vary the bulk regulations to permit the undersized lot of 9,467 sq.ft.to be buildable under zoning when 1 acre is required and to site a structure on it not in conformance to the required front yard setbacks. The required 30 foot front yard setback onto Oyster Place Road is to be reduced to 9.5 feet. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 08, 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly i a . advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August 22, 2001, at which time the Board found to grant the special permit with conditions. Board Members deciding this appeal were Richard L. Boy, Thomas A.DeR.iemer,Ralph Copeland, Jeremy Gilmore, and Chairman Ron S.Jansson. Attorney Michael Ford represented the applicant,who. was also present, before the Board. He explained the proposal noting that single-family use would be the dominant use of the property in keeping with the underlying zoning and that the proposed.office use would be the accessory to the residential use. Mr. Ford presents the plan for redevelopment of the site and elevations of the proposed structure. Site improvements include a new Title V on-site septic system, a new driveway into the site, drainage, and an on-site parking area. The new driveway and parking located on the site is depressed below the existing grade. The first floor elevation of the building is at 28 feet and the basement garage will be about 20 feet. The new structure has been shifted to a more centered location on the lot. It is placed with a 30-foot setback from Main Street, 10.6-foot setback from Oyster Place Road and 15-foot setback to the side yard. Mr. Ford noted that the mixture of residential with a"home" occupation is in keeping with traditional village centers and the proposed would be in keeping with the goals of the village plan for Cotuit and the Local Comprehensive Plan. Robert Hayden spoke in favor of the application. The Chairman noted that two letters of support were also submitted. Findings of Fact. At the hearing of August 22,2001,the Board unanimously made the following findings of fact: 1. With reference to Appeal 2001-92-Don MacEachern has applied for a Modification of Special Permit No. 1979-68. The applicant seeks to demolish the existing structures on the premises and construct a new primary residence and in-home boat/real estate broker's office. The property is show on Assessor's Map 035,Parcel 091, addressed 904 Main Street, Cotuit,MA in a Residential F.Zoning District, Groundwater Protection Overlay District, and the Resources Protection Overlay District. 2. The application before the Board proposes to demolish the existing structure on the property and construct a new 3-bedroom single-family dwelling with a 400-foot"in-home" boat/real estate broker's office. The proposed new structure will be 2,544 sq. ft. The footprint of the new structure is estimated to be approximately 1,326 sq.ft. A two-car garage will be located in the basement area of the structure. 3. The dwelling is to be accessed from Oyster Place Road. Site improvements include a new Title V on- site septic system, a new driveway into the site, drainage, and an on-site parking area. 4. The proposed mixed use development of residential with a"home" occupation is in keeping with traditional village centers and the proposal would be in keeping with the goals of the village plan for Cotuit and the Local Comprehensive Plan. 5. The application falls within a category specifically excepted in the ordinance for a grant of a Special Permit. 6. After evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 7. The site plan has been reviewed by the Site Plan Review Committee and found approvable. 2 I - _ Decision: Based on the findings of fact, a motion was duly made and seconded to grant the special permit modification to allow for the re-use and redevelopment of the site as a single-family residence with a accessory home office within, subject to the following conditions: 1. Development of the site shall be substantially in conformance with the plan presented entitled "Proposed Site Improvement Plan - 904 Main Street Cotuit, MA" drawn by Horsley & Witten, Inc., originally dated 5/30/01, last revision date of 6/14/01. 2. The structure to be developed shall be a single-family, three-bedroom, two-story dwelling not to exceed 2,544 sq.ft. A maximum of four hundred (400) sq.ft. of the building may be for a professional boat/real estate office for the owner/resident in the dwelling only. No others shall work therein. 3. Only boats registered to the owner and not for re-sale shall be permitted on the property. 4. Signage is limited to no more than one sign not to exceed four (4) sq.ft.total, mounted flat against the building or a structural wall. It shall not be internally illuminated. 5. No additional Conditional Use Permit is to be issued for the property unless this permit is surrendered. 6. Any night lighting shall not exceed that normally found in single-family neighborhoods within this part of Cotuit. 7. This permit shall run with the owner of the property.
