As we are all well aware,this location had been a gasoline service station for many years and has not been functioning-as an active business for quite some time.My wife and I purchased.the property directly across Main Street from this property in January of 2002, prior to that we lived at 349 Little River,Road in Cotuit for five years.During this:entire period I do not recall ever seeing Cotuit Oil Co. operate their gas pumps to sell gasoline to the public. I have had several meetings.with Chief Frazier to discuss the issue of the abandoned underground storage tanks. Chief Frazier has always been very informative and helpful with regard to the ongoing efforts to try to get the current owners of this property to comply with the law concenning the removal of abandoned underground storage tanks. Based on our conversations it sounds as though Chief Frazier is not getting any Cooperation from the owners. - I have attached a copy of the Massachusetts Board of Fire Prevention Regulations 527 CMR 9.00.Therein you will that,I have highlighted just a,few of the regulations that are in violation with regard to'Cotuit Oil Co. The Scudder Gas Station is an international style commercial building, almost square (46 x 44) , of 2,144 square feet, one story high. On the east face toward Main St. are two service doors, and a smaller 7 x 3 entrance to the right. Originally the plate glass windows wrapped around the northeast corner along School St., but the north side is now boarded up with plywood. A service island for two pumps is located near the corner parallel with School St, replacing the original island which was canted ESE-WNW farther back from the street. There are two outbuildings, a small pump shed to the west, and a large one-story garage on the adjoining parcel to the southwest. HISTORICAL NARRATIVE see continuation sheet Discuss the history of the building. Explain its associations with local(or state)history. Include uses of the building, and the role(s)the owners/occupants played within the community. This. corner was vacant until 1889 when Lucy A. Crosby, wife of Capt. William of High St. sold it to Eugene Howard Savery (1863-1941) , son of Samatras Savery and Lydia Sturges of Little River. He was to build his house next to this at 911 Main St. (CTB 84), but before this two buildings were constructed, perhaps by his builder brothers, George and Alonzo Savery. On corner: Small hay & grain store of Capt. John R. Sturges (1831-1916) , whaler, son of Daniel of Little River, with hay scales in front. Sturges kept a catboat on which he took tours to Martha's Vineyard. The store was moved to SE corner by 1890s to form the nucleus of the Coop. This was replaced by the shoe store of Eugene Savery (see photos) until he moved to Woods Hole. This was probably built by his brother Alonzo, valued at $350 in 1911. It was �a simple one-story gable ended store, hipped roof at the back, with an open porch on four turned Victorian pillars, center door between 4/4 windows. There was a back door onto a boardwalk along School St. Here also was the cobbler shop of Wampanoag Fontanella Coet (Cowett) , b. '1846 (EL30) . The whole corner was taken over in' 1919 by Alice P. Handy family as a variety store which sold "notions" like pins and greeting cards. A screened porch on the back (south) was later enclosed with a show window facing Main St. Alice Handy , widow of Frank lived in Santuit .(CTA 3) . Cynthia Handy's camera shop ("L" on Scudder's map) . Savery's store was bought 1934 by Walter Scudder, and moved across the street for a bakery, then Israel Holzman's tailor shop, later moved to mid-Main St. (EL40) . Behind this, about on the present building site ("L") was a one-story shed roof wooden building with high front on. School St. This was probably built by Alonzo Phinney as a shop and office of his building business, valued at $550 in 1911. By 1910 it was the office of Cotuit Oyster .Co. in postcard with two large square show windows to the left of a large entry door, and twin windows to the right. . It became the Telephone Co. Office by 1923. The Christian Science Reading Room moved from the church on Main St. to this building owned by Cynthia Handy and the church trustees to 1934, when it was bought by Scudder, who built the present structure around the old frame. Long building opp. Kettle Ho "M": A building about 38 ft. along the street, with boardwalk in front, built by Howard Dottridge by 1918, owned by the Handys.. East end was rented to Leah Savery, wife of Grover of Little River who had dress goods and pastry bakery. By the 1920s it was the grocery of Herbert H. Scudder bought the building from Alice .Handy 1936 (SM) . East of Irwin House (CTB 31) : Pioneer Market behind present gas station; Eugene Savery leased it to A&P until its move to NW corner by 1932. Scudder bought it in late 140s from Roger Savery, razed and used for new building. The Intersection of School and Main Streets had a standard with a yellow blinker in the 1920s, matching a similar one a quarter of a mile north at Maple and Main Streets. In Sept. 1931 Cotuit's only traffic light was erected on the corner telephone pole at the intersection where the state highway 28 turned left onto Main St., but was abandoned after one winter when everyone ignored it. The whole of the former Savery property was reassembled between 1934 and 1942 by Walter8 Crosby Scudder (1911-86) from the distinguished Osterville family (Walter Scott7, Freeman6, Josiah4-5, Ebenezer3, John1-2) . Coming to Cotuit in 1932, he took over Irwin's Cotuit Transportation Co., which provided express, mail and passenger transport in wooden station wagons to and from the West Barnstable station. He also started Walter C. Scudder fuel company. Active in civic affairs he was Chairman of the Prudential Committee for ten years, director of two banks, and commander of Cape Cod Power Squadron. In 1950 Walter Scudder tore down all the old buildings and had Santuit builder John "Bucky" Rogers Botello (19.14-1982) built the present International Style service station. It opened as a Socony station, which changed name to Mobil in 1956, then briefly Richfield and finally as Esso station. In 1977 Scudder sold the corner lot of .22 acre and service station to Air Force Major Bernardo J. Procopio (b. Providence, 1919) , who operated it as Citco station. He replaced the plate glass facing the street with board in 1980. "Joe" had been pilot of B-17 bomber "Stardust" out of Parnham AFB England 1943, hit by AA fire over Berlin, glided to landing in Sweden where he was interned for 6 months. Before retiring in 1964 ran the Jenney station at 505 Main St. for two years (EL 32) . The business was managed by his wife Gayle A., who died in 1998, leaving it to their five children, Francis J., Rebecca Ewton, Carla Linda Dane, Peter R. and Mark G. Mark has continued to manage the Cotuit Oil business and repair service, but discontinued sale of gasoline. The two other Scudder properties continued to be owned by Walter's brother Howard of Brockton and his son (the house and west land) . In Oct. 2001 Mark leased the station to auto mechanic John Rojee (b. 1968) of Furlong Way, Cotuit. I had a lengthy discussion with Mr. Procopio and his sons about the activities at the site. The building is a service station and has all the components of a full service facility. It is equipped to do all types of automotive and engine repair including oil changes, mufflers, tire repairs, brake work, etc. . The service station has been in operation since early 1940. - In addition the property also conducted sale and delivery of heating oil, ran a taxi service and school busses. The sidewalk question has been addressed by our Engineering Depart- ment. They have done the survey, painted a white line and "guess what", there is no sidewalk and has never been -one. Since the entrance to the gas station and the parking area behind the garage are part of this parcel this certainly would not -be a safe area for a sidewalk: There is a side- walk directly across the street which services the shops and is safe for pedestrians. As for the message on the sign, perhaps the "good conversation" is not as effective to some as it should be. I have asked the owners to consider a new sign "General Repairs" and they are considering my suggestion at the present time. But, as a violation I certainly would not rule that there is one. I did mention, however, that the cutting of logs on the site would be a violation of the Town of Barns a _ e By-law. Wood, as late as 'the mid nineteenth century met a out 90 per cent of the fuel needs of the United States. Since fuel oil was sold on this site for many years, wood as a solid fuel serves the same purpose. I trust this explains the activities at the Exxon station. Jos D. The 40 foot highway layout made by the State in 1916 has no bearing or effect on this easement of passage. The dictionary states, "enamored, infatuated, meaning passionately in love". At this stage in life I think it would be overemphasized, and secondly I am not sure of the connection. In any case, this saga twill undoubtedly continue. On Thursday afternoon Mr. Savery parked and locked his car across their driveway, which created a "crowd" and a couple of police cruisers plus a foot patrolman were there. ,- It appears that this is a personal matter with Mr. Savery and, perhaps, he should keep it as a private matter. Procopio Trustee/Gayle A. Procopio Trust d/b/a/ the Cotuit Exxon at the corner of School and Main Streets in Cotuit, has during the week of Feb 4 and Feb 11 , and from May 8 to May 24, had two automobiles for sale. At the present time still has one for sale. I should not have to tell you that this is a violation of the zoning by-law on two counts: 1 ) Sale of automobiles in a residential area and 2 ) Extension of a non-conforming use. As a matter of fact I have been complain-ing to you of this activity for almost two years now. I recognize that you have other duties that you might consider more important. Also I do not expect you to sit on the Corner of School and Main Streets waiting for a violation to occur. However, you have an assistant that lives in Cotuit and has been passing these violations on his way to and from work as long as I 've been watching them. I might add that his vision should be even better than mine. If he is not reporting these violations to you he is not carrying out his duties as your assistant. On the other hand if he is reporting these violations to you then you have not been carrying out the duties of your office for the past two years that I know about. Your continued reluctance to stop the zoning-by-law violations at this location and by this person is somewhat baffling to me. Are -you intimidated or enamored when you come to Cotuit! DaLuz, Building Commissioner RE: Cotuit Exxon Service Station On Wednesday, July 18th I reviewed the complaints re the Cotuit Exxon Station. I had a lengthy discussion with Mr. Procopio and his sons about the activities at the site. The building is a service station and has all the components of a full service facility. It is equipped to do all types of automotive and engine repair including oil changes, mufflers, tire repairs, brake work, etc. . The service station has been in operation since early 1940. In. addition the property also conducted sale and delivery of heating oil, ran a taxi service and school busses. The sidewalk question has been addressed by our Engineering Depart- ment. They have done the survey, painted a white line and "guess what", there is no sidewalk and has never been one. Since the entrance to the as station and the g parking area behind the garage are part of this parcel this certainly would not be a safe area for a sidewalk. There is a side- walk directly across the street which services the shops and is safe for pedestrians. The sign on the premises reads as follows: MASSACHUSETTS INSPECTION STATION TIRE & WHEEL BALANCING OIL CHANGE & LUBE MUFFLERS & EXHAUST SYSTEMS MAJOR & MINOR REPAIRS BATTERIES & ACCESSORIES BRAKE WORK SNOW PLOWING GOOD CONVERSATION Board of Selectmen July 23, 1984 Page 2 The sign is approximately 3' x 4' and a permit. was granted. As for the message on the sign, perhaps the "good conversation" is not as effective to some as it should be. I have asked the owners to consider a new sign "General Repairs" and they are considering my suggestion at the present time. But, as a violation I certainly would not rule that there is one. I did mention, however, that the cutting of logs on the site would be a violation of the Town of Barnstable By-law. Wood, as late as the mid nineteenth century met about 90 per .cent of the fuel needs of the United States.
