' for Joseph S. cerretanill, by Baxter & Nye, Inc. , dated September 22, -1993, revised Sept. 28, 1993. Procedural Summary: The application was filed in the Offices of the Town clerk and at the Zoning Board of Appeals office on November 15, 1994. A public hearing duly noticed.under M.G.L. Chapter 40-A was opened on January 5, 1994, at which time the hearing was closed and a decision was rendered by the , Board. The petition was heard by Board Members; Gail Nightingale, Robert Thorne, Emmett Glynn, Dexter Bliss, Richard Boy. The applicant was represented by Attorney Michael Ford. The variance was as petiti on p n for Bulk Regulation, Sideyard Setbacks to permit an addition not in conformance with the required side yard setback of 15 feet. The proposal is for a bay window that juts out three feet from the main structure. Attorney Michael Ford representing the petitioner stated that the bay window intensifies the non-conforming nature of the structure, however being only a three foot encroachment he does not consider it to be . substantially more detrimental for the neighborhood. Attorney Ford discussed the lot, its narrow shape, proximity to wetlands, . the harbor and the limitations imposed on its ability to conform to setback requirements. Attorney Ford also presented a Board of Health permit and an approval by the Conservation Commission. The public was invited to speak on the proposal and Mr. Alan Dow Heiser from the Prudential Committee with statutory responsibility for Freedom Hall (an Historic Building) expressed concern -regarding the historic significance of the Freedom Hall. Another member of the public, Susan Downing, abutter, expressed her appreciation of the petitioner not to build the balcony that was initially proposed but later withdrawn. Attorney Ford submitted a letter from the abutters (the Buckleys) which states no objection. Find of Facts: Based upon the evidence submitted and the Testimony given at the public hearing on Appeal No. 1994-02, The Zoning Board of Appeals unanimously found the lot is in compliance with the requirements of Chapter 40A with respect to` soil conditions, shape and .topography which in themselves create the hardship. There is a substantial drop in the- land, there are wetlands that inhibit the direction of any expansion of the house. The property is essentially landlocked, extremely narrow and is unusual in the neighborhood. There is no local designation of historic district in this area and the request is for a minimal intrusion into the sidelines. The proposed window will; be on the Northerly side of the structure and will not be 'visible from the.Freedom Hall. The relief requested can be granted without derogation of the .spirit and intent of the Zoning ordinance. e Conclusion: Accordingly,"!`based 'upon the findings, a motion was duly made and seconded that ,Appeal .No. 1994-02 for a variance be granted 'as per the January 5 ' 1994 revised plan entitled Plan of Land in (Cotuit) .
