Summary: Overruled the Building Commissioner Applicant: Laurie C.Bailey-Gates Property Address: 1089 Main Street,Cotuit,MA Assessor's Map/Parcel: Map 034 as Parcel 011 Zoning: Residential F Zoning District Relief Requested &Background: The property at issue is a 0.34-acre lot developed with a 1,617 sq.ft. two-bedroom single-family dwelling originally constructed in 1903. The applicant,Laurie C.Bailey-Gates,purchased the property in 1992. In December of 2001, she applied for a building permit to"construct a detached 24'x 24' two car garage with storage room above—576 sq.ft." Plans for the garage were also submitted with the building permit application showing the proposed structure would be a detached structure located to the far rear of the lot. The architectural plans note that the second level was to be for storage only and the application cited that the structure would be unheated. On December 11,2001 the Building Division,issued Building Permit 57643 for the development of the accessory detached garage in accordance with the application made. The building was constructed in 2002. From the records of the Building Division,it appears that a violation in the construction was cited on May 16,2002 with regards to the exterior stairs. The lack of a handrail and a concrete pad were cited. The 2005 Assessor's record describes the accessory building as a"Garage/Quarter"and notes a one- bedroom of 375 sq.ft., finished with drywall and heated by hot air exists within the accessory building. In March of 2005,the applicant sought a building permit to finish the area above the garage for a bedroom, bathroom and sitting room_ . On March 22, 2005,Jeffrey Lauzon,building inspector issued a letter to Ms Bailey-Gates denying the building permit,citing not only the May 16,2002 violations,but noting that the Building Commissioner has also determined that the proposal would constitute a second principal structure in violation of Zoning. At the request of Attorney John R.Alger,the Building Commissioner reissued the March 22,2005 letter on October 18,2005 and further noted in that letter that the structure at issue"is essentially another dwelling on a single lot." In Appeal 2005-104 the applicant has appealed that March 22,2005 and October 18, 2005 denial of a building permit seeking to have the Zoning Board of Appeals overrule the Building Commissioner and allow °'' the interior finishing of the structure. Procedural &Hearing Summary- This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 13,2005. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 16,2005, at which time the Board found to overrule the Building Commissioner. Board Members deciding this appeal were,Daniel M. Creedon,Ron S. Jansson,Randolph Childs,James R.Hatfield, and Chairman Gail Nightingale. . Attorney John R. Alger represented the applicant,Laurie C.Bailey-Gates,who was also present at the hearing. Mr. Alger explained the history of the property and the development of the accessory structure. He cited that detached accessory buildings are allowed under the ordinance and the finishing and use of the structure is also permitted under zoning provided that the unit does not constitute a second principal living unit or an independent living units. He stated that this building interior finishing would not have a kitchen and therefore not an independent living unit. It would be used only as accessory to the principal single- family dwelling and therefore subordinate to it. Mr.Alger concluded that the applicant should be entitled to the building permit as-of-right. The Board reviewed Section 240-43 that defines accessory buildings and uses,noting that they are permitted "provided that any such use or building is customarily incidental to, subordinate to and on the same lot as the principal use it serves ..." Mr. Alger presented photos of the building and its interior noting that he had taken those photos just today and that they clearly show that the interior is not finished as cited on the Assessor's record. Ms Bailey- Gates stated that she thinks that originated when an appraiser from the Assessor's Office inspected the . structure shortly after it was built and she had noted to him of her intensions to finish the interior and heat the unit. She surmised that it was entered into the record at that time based on their conversation. Ms. Bailey-Gates reiterated that the interior of the structure is unfinished. With regard to the number of bedrooms,Mr.Alger stated the single-family dwelling has only two bedrooms and the existing on-site septic system is sized for three. The existing system can handle the interior finishing of the accessory structure with an accessory sleeping area. The Board reviewed the issue of the filing, its timeline and nature of the letters cited,that being one issued by a building inspector and the second letter issued by the Building Commissioner. The Board concluded that they could proceed. Findings of Fact: At the hearing of November 16, 2005, the Board unanimously made the following findings of fact: 1. Appeal 2005-104 is that of Laurie C.Bailey-Gates. The subject property is addressed 1089 Main. Street, Cotuit,MA and is shown on Assessor's Map 034 as Parcel 011. It is in a Residence F Zoning District. The applicant has appealed the decision of the Building Commissioner to deny a building permit to complete construction of an existing building on the property. 2. The Building Commissioner issued an October 18,2005 letter denying a building permit to allow the interior finishing of the existing detached accessory structure. That letter was also accompanied 2 by a March 22, 2005 letter from Building Inspector,Jeffrey Lauzon. Pursuant to MGL Chapter 40A, Section 8, the Board is authorized to act on appeals"taken by any person aggrieved by reason of his inability to obtain a permit ... from any administrative official, ... or by any person ... aggrieved by an order or decision of the inspector of buildings, or other administrative official ...". The Building Commissioner is an administrative official under the Zoning Act. Both the letter of the local Building Inspector and that of the Building Commissioner can be appealed, and this appeal is properly before the Board. .3. The letters have cited that a building permit will not be issued as the Inspector and Commissioner have determined that the second structure would constitute a second principal building on a single lot and the Zoning Ordinance of the Town of Barnstable only permits one principal structure -that being one single-family residential dwelling—on a single lot. 4. The applicant seeks to improve the second structure with interior finishing of the 375 sq.ft. loft area over the first floor garage with a bathroom, sitting room and bedroom. This Board has maintained that unless the unit constitutes a self-contained living unit for independent living, and is separate and independent of the principal living unit and capable of self-sufficient human habitation, it is not a principal separate living unit. There is no indication or plans that the proposed fmishing of the loft area will include a kitchen or any cooking facilities. Therefore, it is this Board's fmding that the unit does not constitute a second principal structure or a second single-family use,provided that there are no kitchen facilities incorporated into the structure. Decision: Based on the findings of fact, a motion was duly made and seconded to overrule the Building Commissioner's denial of a building permit for the interior finishing of the accessory structure. From that conversation,Mr. Perry cited his growing concern that accessory structures and uses must satisfy the zoning definition as expressed in Section 240-43. That is, "accessory uses or accessory buildings are permitted, provided that any such use or building is customarily incidental to, subordinate to and on the same lot as the principal use it serves ...". In this particular situation, the 0.34-acre lot supports a one-plus story, 1,004 sq.ft., three-bedroom structure. The detached accessory structure is a one and one-half story building with a gross area of 1,017 sq.ft. There certainly appears to be a question with respect to the size of the new structure being "incidental to and subordinate to". In addition,Building Permit No. 57643 was issued for the construction of a detached two-car garage of 576 sq.ft. with storage above. The March 22, 2005 Building Division stop work order was issued when the Division observed the area above the garage being finished into habitable space consisting of a bathroom,bedroom and sitting area. The permit did not authorize any increase in the number of bedrooms on the lot, nor the finishing of the second floor for human habitation. In response to your question on what nature of zoning relief you should seek,I would state it is not Staff's responsibility to determine this issue,but rather your decision based upon your clients' final intensions for this structure and its use. If the intent is to have an accessory structure to the principal structure perhaps a variance to Section 240-7(F)(1) -Number of Buildings Allowed per Lot could accomplish this. However if the intent is to have a second independent living unit, then a use variance to Section 240-14(A)may be more appropriate. r t As you are aware, other options also exist with respect to an appeal of the Building Commissioner's decision, or perhaps seeking of a Comprehensive Permit under the Accessory Affordable Housing provisions of the Code of the Town. Summary: Overruled the Building Commissioner Applicant: Laurie C.Bailey-Gates Property Address: 1089 Main Street,Cotuit,MA Assessor's Map/Parcel: Map 034 as Parcel 011 Zoning: Residential F Zoning District Relief Requested &Background: The property at issue is a 0.34-acre lot developed with a 1,617 sq.ft. two-bedroom single-family dwelling originally constructed in 1903. The applicant,Laurie C.Bailey-Gates,purchased the property in 1992. In December of 2001, she applied for a building permit to"construct a detached 24'x 24' two car garage with storage room above—576 sq.ft." Plans for the garage were also submitted with the building permit application showing the proposed structure would be a detached structure located to the far rear of the lot. The architectural plans note that the second level was to be for storage only and the application cited that the structure would be unheated. On December 11, 2001 the Building Division,issued Building Permit 57643 for the development of the accessory detached garage in accordance with the application made. The building was constructed in 2002. From the records of the Building Division, it appears that a violation in the construction was cited on May 16,2002 with regards to the exterior stairs. The lack of a handrail and a concrete pad were cited. The 2005 Assessor's record describes the accessory building as a"Garage/Quarter"and notes a one- bedroom of 375 sq.ft.,finished with drywall and heated by hot air exists within the accessory building. In March of 2005,the applicant sought a building permit to finish the area above the garage for a bedroom, bathroom and sitting room. On March 22,2005,.Jeffrey Lauzon,building inspector issued a letter to Ms Bailey-Gates denying the building permit,citing not only the May 16, 2002 violations,but noting that the Building Commissioner has also determined that the proposal.would constitute a second principal structure in violation of Zoning. At the request of Attorney John R.Alger,the Building Commissioner reissued the March 22,2005 letter on October 18,2005 and further noted in that letter that the structure at issue"is essentially another dwelling on a single lot." In Appeal 2005-104,the applicant has appealed that March 22, 2005 and October 18, 2005 denial of a building permit seeking to have the Zoning Board of Appeals overrule the Building Commissioner and allow the interior finishing of the structure. i e Procedural &Hearing g"umniary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 13, 2005. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 16,2005, at which time the Board found to overrule the Building Commissioner. Board Members deciding this appeal were,Daniel M. Creedon,Ron S. Jansson,Randolph Childs,James R.Hatfield, and Chairman Gail Nightingale. . Attorney John R.Alger represented the applicant,Laurie C.Bailey-Gates,who was also present at the hearing. Mr.Alger explained the history of the property and the development of the accessory structure. He cited that detached accessory buildings are allowed under the ordinance and the finishing and use of the structure is also permitted under zoning provided that the unit does not constitute a second principal living unit or an independent living units. He stated that this building interior finishing would not have a kitchen and therefore not an independent living unit. It would be used only as accessory to the principal single- family dwelling and therefore subordinate to it. Mr.Alger concluded that the applicant should be entitled to the building permit as-of-right. The Board reviewed Section 240-43 that defines accessory buildings and uses,noting that they are permitted "provided that any such use or building is customarily incidental to, subordinate to and on the same lot as the principal use it serves ..." Mr.Alger presented photos of the building and its interior noting that he had taken those photos just today and that they clearly show that the interior is not finished as cited on the Assessor's record. Ms Bailey- Gates stated that she thinks that originated when an appraiser from the Assessor's Office inspected the structure shortly after it was built and she had noted to him of her intensions to finish the interior and,heat the unit. She surmised that it was entered into the record at that time based on their conversation. Ms. Bailey-Gates reiterated that the interior of the structure is unfinished. With regard to the number of bedrooms,Mr. Alger stated the single-family dwelling has only two bedrooms ~ and the existing on-site septic system is sized for three. The existing system can handle the interior finishing of the accessory structure with an accessory sleeping area. The Board reviewed the issue of the filing,its timeline and nature of the letters cited,that being one issued by a building inspector and the second letter issued by the Building Commissioner. The Board concluded that they could proceed. Findings of Fact: At the hearing of November 16, 2005, the Board unanimously made the following findings of fact: 1. Appeal 2005-104 is that.of Laurie C.Bailey-Gates. The subject property is addressed 1089 Main Street Cotuit MA and i> s show n on Assessor's Map 034 as Parcel 011. It is in a Residence F Zoning District. The applicant has appealed the decision of the Building Commissioner to deny a building permit to complete construction of an existing building on the property. 2. The Building Commissioner issued an October 18, 2005 letter denying a building permit to allow the interior finishing of the existing detached accessory structure. That letter was also accompanied 2 by a March 22,2005 letter from Building Inspector,Jeffrey Lauzon. Pursuant to MGL Chapter 40A, Section 8,the Board is authorized to act on appeals "taken by any person aggrieved by reason of his inability to obtain a permit ... from any administrative official ... or by any person ... aggrieved by an order or decision of the inspector of buildings, or other administrative official ...". The Building Commissioner is an administrative official under the Zoning Act.- Both the letter of the local Building Inspector and that of the Building Commissioner can be appealed, and this appeal is properly before the Board. 3. The letters have cited that a building permit will not be issued as the Inspector and Commissioner have determined that the second structure would constitute a second principal building on a single lot and the Zoning Ordinance of the Town of Barnstable only permits one principal structure -that being one single-family residential dwelling—on a single lot. 4. The applicant seeks to improve the second structure with interior finishing of the 375 sq.ft. loft area over the first floor garage with a bathroom, sitting room and bedroom This Board has maintained that unless the unit constitutes a self-contained living-unit for independent living, and is separate and independent of the principal living unit and capable of self-sufficient human habitation, it is not a principal separate living unit. There is no indication or plans that the proposed finishing of the loft area will include a kitchen or any cooking facilities. Therefore,it is this Board's finding that the unit does not constitute a second principal structure or a second single-family use,provided that there are no kitchen facilities incorporated into the structure. Decision: Based on the findings of fact, a motion was duly made and seconded to overrule the Building Commissioner's denial of a building permit for the interior finishing of the accessory structure.
