Page 3 Findings of Fact Based on the evidence submitted, the Zoning Board of Appeals made the following findings of fact: Desirable relief may be granted without substantial detriment to the public good because: a) Both the lots will meet the minimum lot area requirements for the Zoning District for which they are located unlike the vast maiority of lots in this particular neighborhood. b) A newly created lot will be exclusively accessed off Main Street and, therefore, no further curb cuts will be created on either Shell Lane or Plain Street . c) The variances r`quested are only from the dimensional requirements of the Bylaw and not use variances inasmuch as the use is residential which is in keeping with the character- of the zoning district in which the property is located. This shape is unique, particularly given the long panhandle out to Shell Lane and the shape of the rear of the other lots in the immediate zoning district have a similar shape. b) The structures on the remaining lots were all constructed sometime prior to 1930. A literal enforcement of the applicable Bylaw would involve substantial hardship, financial or otherwise to the Petitioner because: a) If the relief is not granted the Petitioners will not be able to utilize fully the upland area of their lot. In support of this petition, the petitioner presented evidence that the following conditions applied which would warrant relief: the property has been owned and occupied by the petitioner's family since the 1930' s. At present there are three structures on the lot which were constructed before 1930. One building is a single-family year-round dwelling which the peititioner occupies , the second is a structure containing two apartments , one one-bedroom and one two-bedroom, and the third is a seasonal single unit with one-bedroom. The petitioner' s lot contains a total of approximately three acres . The peititioners are proposing to divide the lot into two lots , one containing the three structures and the remainder to b_come a separate building lot for the applicant ' s caughkler and family.
