The lot containso21. 573 square feet and is shown on a plan dated September .'7, 1972 and approved as "Approval not Required" by the B�_rnstable Planning Board on September 11, 1 At that time the land in that area was zoned for 20, 000 square foot ts. On February .8, 1973, prior to. the change in zoning, this lot, was conveye to Marian E. Hines , and Juice w`_ H;n G by deed'.-recorded in Book 1805, Page, 274. Although I have _not examined the title which I understand is not required by you, it is' my understanding that the Hines and their successor in title, Inez Brady, never owned any other lots within the subdivision. This being so, it is my opinion that the lot complies with the provisions of the Barnstable zoning bylaw and can be built upon for single family 'residential purposes provided - the necessary permits for sewage disposal .can be obtained and provided that any buildings or other structures erected on the premises comply with. the existing zoning bylaw as. to sideline requirements. My opinion is based on the following provision of the bylaw: Any lot lawfully laid out by a plan or .deed duly recorded, as defined ,in section eighty-one L. of chapter forty-one, or any lot shown on a plan endorsed with the words "approval under the subdivision control law not required" or words of similar import, pursuant to section .eighty-one of chapter forty-one, - 2 - Mr. Slater W.
