In December of last year, we appeared before the Barnstable Town Council seeking approval of a Conservation Restriction on behalf of the Trust. Pursuant to the terms of the proposed Restriction, the Trust would donate all further development rights on 1372 Main Street to the Barnstable Land Trust. Ultimately, the Council looked unfavorably on the Restriction and it was withdrawn from consideration in February of this year. While the hearing on the Restriction was pending, however, we understand that Town Attorney Ruth Weil mentioned to the Barnstable Land Trust's Executive Director, Jaci Barton, that she believed the property located at 1372 Main Street was unbuildable. The Board refused our abatement application. During the hearing, the Chairman noted that until we received a zoning determination that the lot was unbuildable, the Assessors would not change the assessing classification for this property. Therefore, your determination on this building permit application is very important to our client. While it is hoped the lot is buildable (as it has been assessed as such for many, many years), if it is not buildable, the family would like the assessing classification changed to reflect its true status under Barnstable's zoning bylaw. This Memorandum is written in support of the Trust's application for an abatement, filed with your office on January 30, 2009.' We understand this matter has been scheduled before the Board of Assessors at its April 28, 2009 public meeting. In the Fall of 2008, the Trust appeared before the Barnstable Town Council, seeking approval of a Conservation Restriction which would limit the development rights of the McCowan Property. During the course of this proceeding, the issue was raised as to whether the McCowan Property•was buildable. Generally, adjacent nonconforming lots in common ownership will normally be treated as v single lot for zoning purposes so as to minimize nonconformities with the dimensional ' requirements of the zoning bylaw or ordinance. Vetter v. Zoning Board of Appeals of Attleboro., 330 Mass. 628, 630-631, 116 N.E.2d 277, 278 (1953); Sorenti v. Board of Appeals of Wellesley, 345 Mass. 348, 353' 187 N.E.2d 499, 502 (1963); Vassalotti v. Board of , Appeals of Sudbury, 348 Mass. 658, 661, 204 N.E.2d 924, 926 (1965). This is known as the doctrine of merger. Because the lots were held in common ownership in 1973 at the time of the zoning change, they would have merged for zoning purposes at that time. In light of the foregoing, it would appear that the 1973 zoning change rendered the McGowan Property unbuildable at that time. The lots have been held in separate ownership since the mid-1970's and, therefore, have been properly assessed as separate lots. However, it does not appear that the McCowan Property has been buildable since 1973. We have requested a buildability determination from Building Commissioner Tom Perry, but to date have not heard a response. Accordingly, the Trust is seeking an abatement for the FY 2009 Real Estate tax bill. Enclosed herewith is an Appraisal Report prepared by licensed Massachusetts Appraiser Joseph M. Clancy of Clancy Appraisal Company, Inc. As you can see, it is a retrospective appraisal report as of January 1, 2008, and it values the property as an unbuildable parcel at Five Hundred ($500,000) Thousand Dollars.
