The property consists of a seven bedroom house containing approximately 4,688 sq. ft. in size built approximately 1793.. 4. The property abuts Old Kings Rd., Sampson House Nob, and the King's Grant Tennis Courts. The only remaining land which abuts the property is owned by an owner who was present at tonight's hearing who indicated he had no objection to the relief being sought. 5. Owing specifically to the unusual nature of the building itself, in particular the fact that the building is as large as it is, and as old as it is, and these are conditions not normally found in this Zoning District, the literal enforcement of the zoning ordinance would be a significant hardship to this petitioner because the failure to be able to rent this house to ten lodgers would pose a significant financial hardship which would prevent the petitioner from being able to maintain this house, and its loss would be a great loss to the town. 6. Public Comment: Sidney McPherson, a direct abutter, stated the current owners have done a magnificent job and he would not like to see the number of guests nor the number of rooms for rent increased. Relocate the detector near the front door to the hallway area (between the kitchen door, bottom of stairs and bedroom door). This was requested because of the lack of wiring access and to position the detector where it will cover the area required and be less prone to false alarms. I have eliminated the detector shown to be located immediately outside the kitchen to the potential for false alarms and because it would be very close to the relocated detector above. 2. Eliminate the pull station and horn/light shown in the "Summer Kitchenette" area as it is not easily accessible from the dining room or other guest areas and an approved exit is located very close to the same area. This area is also for"staff only" and not used by guests. 3. Eliminate the pull station from the Cape Cod basement as it is a service area with no public access and is accessed only from the outside of the building. 4. To improve coverage, the owner has added heat detector in the unheated "den area , shown on the plan near the attached storage shed. Zoning: RF Residential F Zoning District Groundwater Overlay: GP Groundwater Protection District Filed,February 19, 1997 Public Hearing,April 2, 1997 Decision Due: Permit-July 1, 1997; Variance-May 21, 1997 Background: The property that is the subject of these appeal consists of a 1.00 acre lot located in the RF Residential F Zoning District. The parcel is improved with a seven bedroom, 4,688 sq. ft. house built in 1793 according to Assessor's records. In a recent historic survey the structure was described as"the finest example of Federal period style in Cotuit."' The house was known as the Crocker Manor and was originally built as an inn. Later, the structure became the club house of the Crocker Manor Golf Club (late 1940's or early 1950's through 1973)2. The home is now proposed to be used as a five room, ten lodgers, Bed and Breakfast. The plans have been found approvable by Site Plan Review on January 30, 1997 with the one condition that"all building and fire codes must be met." The Health Division raised a concern about the possible use of a first floor study as a bedroom, and the applicant agreed to some modifications which would prevent its use as a bedroom. Zoning Relief Requested In this instance, the applicant has sought the following Appeal No. 97-35A Special Permit Pursuant to Section 3-1.4 (3) (B) Renting of rooms to 6 Lodgers. Appeal No. 97-35B Special Permit Pursuant to Section 4-4.5, Non-Conforming Use to permit renting of rooms to 10 lodgers. Appeal No. 97-36 Use Variance to Section 3-1.4(1)(A) Principal Permitted Uses and to Section 3-1.4(2)(A)Accessory Uses to permit renting of rooms to 10 lodgers. 'Mass.Historic Commission Inventory Form provided by Barnstable Historical Commission 2 Inventory Form&Petitioners'summary,Zoning Board of Appeals File 1980-73 Town of Barnstable-Planning Department Staff Report-Hughes Appeal No.97-35 Special Permit Pursuant to Section 3-1.4(3)(B)Renting of rooms to 6 Lodgers Appeal No.97-36 Use Variance to Section 3-1.4(1)(A)Principal Permitted Uses In this Zoning District, lodging for up to six lodgers is currently allowed as a Conditional Use by Special Permit(Appeal No. 97-35A). To go beyond that number of rooms or lodgers will require additional relief (Appeal No. 97-35B or Appeal No. 97-36). Also the Board should note that a new Bed & Breakfast amendment(TC No. 97-090)to the Zoning Ordinance was approved on February 20, 1997, the day after this appeal was clocked-in at the Clerks Office and the Office of the Zoning Board of Appeals. Although the applicant may have rights to utilize that new section, staff would caution the Board on issuing a Special Permit under that section given the public notice and application. The text of that amendment is attached should the Board desire to utilize any of the restrictions in it, as conditions to this appeal. History of Use: The applicant has provided a letter from the prior owner, Nancy T. Marcus(from September 1981 to April 19963) stating that seven rooms on the property were rented to guests. It appears the business use of this structure began prior to the inception of zoning for this village of the Town. A previous appeal (Appeal No. 1980-73) on this property has documented some of the history. According to information submitted with that appeal, the structure was built around 1793. In 1920, the structure began being used as a club house for the Crocker Manor Golf Club and included "an inn and dining:facilities, gift shop, lounge and liquor license." In 1967, the club house activity and bar were relocated out side of the structure however the inn use remained.4 It is unclear to staff if the renting of rooms was discontinued for a short time in 1973. At that time, the structure was sold to Kings Grant Trust, the developer of surrounding land. Dorothy Duncklee acquired the property in 1976 and it appears that she may have rented rooms. Nancy T. Marcus, the last owner of the property has stated that she did rent up to seven rooms between 1981 and 1996. According to the Assessors Record's the structure is a 12 room, 4,688 sq.ft. single family dwelling. Draft Comprehensive Plan: The Town of Barnstable Draft Comprehensive Plan, Cotuit Vision Plan directly addresses the needed for Bed & Breakfast facilities in Cotuit. In the recent past the village has lost two of its traditional lodging facilities and in response to that loss, the plan states"There is a strong desire to protect the village center and retain it 'as it exists today'. Those businesses which exist are seen as compatible because they fulfill the need for neighborhood convenience. Other uses that should be investigated to complement the needs of the village center include cultural uses and quality bed and breakfast lodging." As evidence of this village need, the applicant has secured the support for the Bed &Breakfast facility from both the Cotuit/Santuit Civic Association and the Cotuit/Santuit Business Association. Other letters of support have been received and are in the file. The applicant has requested a Special Permit to continue the nonconforming use of renting rooms for ten lodgers. If the applicant can show that the dwelling has been continuously legally used as a nonconforming lodging house, beginning prior to adoption of the more restrictive zoning, this can be used as a basis for requesting change or expansion of a pre-existing nonconforming use by Special Permit. The Board may wish to request the applicant to submit information showing that four or more rooms were rented out on a continuing basis prior to 1987 to the present to demonstrate the nonconforming status. Staff Review/Recommendation The Planning Department generally supports the re-use option of large, old historic homes being converted or utilized as Bed and Breakfasts facilities when and were needed. Their is a need for this use with in the village of Cotuit as document by the Draft Comprehensive Plan. The location of the structure on Old Kings Road just off of the intersection of Main Street, Santuit/Newtown Road and Old Oysters Road make it ideally situated at major cross roads of the village. If the non-conforming use can be established, the department would strongly support the granting of the Special Permit for the proposed 5 bedroom Bed and Breakfast facility with restrictions. If the non- conforming use can not be established the department would recommend the Board review the conditions for granting a Use Variance based upon the unique structure of 4,688 sq.ft. not being easily accommodating to a single family use and its location adjacent to the tennis courts,with its additional noise and traffic, makes it less desirable as a single family dwelling. Recommended Conditions: If the Board finds to grant the relief requested, they may wish to consider the following conditions that would be applicable to both the Special Permit or Variance. 1. The Bed & Breakfast use within the dwelling is limited to no'more than five bedrooms to be occupied by no more than 10 lodgers. 2. The owner shall reside in the dwelling at all times when it is in use as a Bed and Breakfast. The owner shall file an affidavit with the Building Commissioner on an annual basis in the month of January stating that the property is the principal residence of the owner and that the owner is a resident at all times that the Bed and Breakfast is being operated. 3. This relief is granted specifically based upon the existing structure located on the site. If that structure is removed this permit(Variance) shall expire. 4. The number of bedrooms or size of the dwelling shall not be increased or expanded without permission from the Zoning Board of Appeals. 5. The parking areas and driveways shall be constructed of pervious material such as gravel or stone. 6. Parking areas shall be screened from view from Sampson House Nob and all neighboring residential property with a fence or dense plantings, not less than five feet in height. 7. Signage shall not be illuminated and shall not exceed four sq. ft. in area. 8. The locus shall comply with all Town of Barnstable Building and Health Divisions regulations, and Fire Department Requirements and shall be required to meet Title V without variance from the Board of Health. 9. No cooking facilities including stoves, microwave ovens, toaster ovens or hot plates shall be available to guests. No meals except breakfast shall be served to the guests only. This use will also create low intensity accommodations for tourist and visitors and enhance the economic climate of the town. By requiring that the operation is owner occupied and managed, the town seeks to ensure that the use will be properly managed and well maintained. Bed and Breakfast, subject to the following conditions: a) The Bed and Breakfast operation shall be located within an existing, owner-occupied single family residential dwelling constructed prior to 1970 containing a minimum of four bedrooms as of December 1, 1996. b) No more than three(3) bedrooms shall be rented for Bed and Breakfast to a total of six guests at any one time. For the purpose of this section, children under the age of(twelve) 12 years shall not be considered in the total number of guests. c) No cooking facilities including but not limited to stoves, microwave ovens, toaster ovens and hot plates shall be available to guests, and no meals except breakfast shall,be served to guests. d) The owner of the property shall be responsible for the operation of the property and shall be resident when the Bed and Breakfast is in operation. The owner shall file an affidavit with the Building Commissioner on an annual basis in the month of January stating that the property is the principal residence of the owner and that the owner is resident all times that the Bed and Breakfast is being operated. If the affidavit is not filed, the operation shall cease forthwith and any Special Permit issued shall be considered null and void. The requirement for filing of an affidavit shall not apply to Bed and Breakfast operations legally established prior to October 1, 1996 e) The single family residence in which the Bed and Breakfast operation is located shall be maintained so that the appearance of the building and grounds remain that of a single-family residence. f) If the property is not served by public water, the applicant shall provide evidence to the Zoning Board of Appeals that the proposed use will not have any detrimental impact on any private water supply on-site or off-site. g) No parking shall be located in any required building yard setback, and parking areas shall be screened from adjoining residential properties by a fence or dense plantings, not less than five feet in height. Parking areas may be permitted in front of the house, not within the required building front yard setback, provided that the Zoning Board of Appeals finds that the spaces are designed and located in a manner which retains the residential character of the property. Grass overflow areas may be utilized for parking provided these are maintained with a grass ground cover in good condition. h) The Special Permit for the Bed and Breakfast Conditional Use operation shall be issued to the owner only and is not transferable to a subsequent property owner. The Sampson House is the finest example of the Federal period style in Cotuit and one of the finest in the entire town. It is a full five bay, two story structure enclosed by a hip rook with monitor and twin interior chimneys. It is extended to the west by a two story, three bay ell. The house and ell are trimmed with corner quoins and a narrow cornice. Windows have simple -.urrounds with slightly projecting sills, and contain 6/6 sash. The five bay facade Ls centered around a rather awkward entry with 3/4 side lights but no fan or porch to finish the design; it seems likely that a porch has been removed. The entry is surmounted by a three part window. The ell contains an entry with semi-circular fan. HIS'I'ORI:4L SIMIFTCANCE (Explain the role owners played in local or state history and :low :he building relates to the development of the co®mniity.) Josiah Sampson (1753-1829) was a gnetleman farmer who owned who-many had aacres smallf woodlouse and tandhis meadow. He married the daughter of Capt. Joseph par- cel Crocker in 1777. It is not known wether this house incorporates the earlier one or not. After Josiah's death, the estate passed tohis son Josiah, Jr. and then to his grandson William at which time it was converted to a two family house. In the early 20th century Hiram Crocker ran a dairy farm here. He was the husband of Rebecca Sampson, granddaughter of Josiah, Jr. 'He used the meadow east of the river fro pasture; that land is now developed with houses and a golf course. . In the 1940's and 50's the house was used as a clubhouse and inn by Raymond Crawford. In 1976 the mansion was restored as a single family hose. During the Raymondn raw probably in the 1920's, an archeological -team -from the Peabody Museem at Harvard, conducted an. investigation of the property finding many artifacts. They will not be running any other business out of this building. They would be amicable to the a condition on this modification of the existing Special Permit and Variance stating it would again not be transferable without permission from the Zoning Board of Appeals. Anthony Bexley, the broker for this property, reported the site is now connected to town water. Public Comment: Sidney McPherson, a direct abutter, stated the current owners have done a magnificent job and he would not like to see the number of guests nor the number of rooms for rent increased. If the conditions of the existing Special Permit and Variance remain in effect—he is in favor of these appeals. No one else spoke in favor or in opposition to these appeals. Findings of Fact: At the hearing of January 5, 2000, the Board unanimously found the following findings of fact as related to Appeal No. 2000-05: 1. The applicants are Leonard and Carol Carter.
