This is to allow a variance from the minimum lot size requirement of one acre for a lot of.8 acre. Background Information: Dexter N. & Catherine Locke have petitioned the Zoning Board of Appeals for a Variance to Section 3-1.4(5) Bulk Regulations, Minimum Lot Area Requirements of one acre. The lot is 0.8 acres in size and was created by an Approval Not Required (ANR) Plan endorsed by the Planning Board on April 23, 1973. The plan was dated by the surveyor March 22, 1973. The change in the minimum lot area required in this area from 20,000 sq. ft. to 43,560 sq. ft. was passed at the Town Meeting on March 24, 1973. The date of the first publication of the Notice for this zoning change was February 14, 1973. Procedural Summary: • This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on January 10, 1996. A Public Hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on February 28, 1996, at which time the Board found to grant the appeal with conditions. Board members hearing this appeal were Ron Jansson, Emmett Glynn, Gene Burman, Elizabeth Nilsson, and Chairman Gail Nightingale. Attorney Richard Largay represented the petitioners, Dexter&Catherine Locke. He noted that relief at this locus would require a Variance from minimum lot area as well as minimum frontage. He cited that both are Variances to Section 3-1.4 Bulk Regulations and were specified in the legal advertisement. He maintained that both minimum lot area and frontage relief could be granted by the Board. The Board Members agreed that both could be granted within the frame work of his petition and the public notice. Attorney Largay distributed a memorandum in support of this appeal. He cited that the nature of the variances is from minimum lot size for a 0.80 acre lot where one acre is required and from lot frontage for the lot with 125 feet where 150 feet is now required. The lot is part of the Kings Grant Development, a 112 lot subdivision approved in 1973. He cited that almost all the lots in the subdivision are under one acre and this 0.80 acre lot is one of the larger lots. Mr. & Mrs. Locke purchased the lot in 1980 for their retirement. Later they purchased and moved into another house in the development several lots away and decided to retain this lot as an investment. The two lots are not contiguous. In 1995 they entered into a Purchase and Sales agreement for the lot in question and it was determined that it did not conform to zoning and was unbuildable. Grandfathering expired for this lot and all the other lots in the development in 1978. All of the 13 lots on the ANR plan except this one had building permits issued after grandfathering had expired on the subdivision expired. All of the neighboring lots were built on illegally with regards to grandfathering and with respect to the ANR plan which was submitted after the date of the first publication of the Notice for zoning changes in this area. • It would be a financial hardship if the lot was considered unbuildable. The Locke's paid fair market value of $16,500 in 1980 for the lot. The literal enforcement of zoning in this instance would involve a substantial hardship to the Petitioners. With reference to the uniqueness, all of the abutting lots have been developed and no vacant land exists that would permit the lot to be added to in size or in frontage. It is the last undeveloped lot in this Zoning Board of Appeals-Decision and Notice Appeal Number 1996-21 Locke division that would have access on Old Kings Road. Granting the relief would not be in derogation of the Zoning • Ordinance as the majority of the lots in this neighborhood are under one acre in size, and many have less than the frontage required today. Public comment was requested and no one spoke in favor or in opposition. The Chairman read letters from abutters John Harvey and Richard Mullin. Mr. Harvey was in support of the appeal, and Mr. Mullin expressed concern for the wildlife in the area. Finding of Facts: Based upon the testimony given during the Public Hearing on this appeal, the Board unanimously found the following findings of fact: 1. The property is located at 80 Old Kings Road, Cotuit, MA on Assessor's Map 22, Parcel 97. 2. The Zoning District is Residential F Zoning District which requires a minimum of one acre in lot size and 150 feet of frontage. The lot in issue is 0.80 acre and has 125 feet of frontage. 3. The lot was created by an ANR Plan endorsed on April 23, 1973. Zoning has changed in the Town of Barnstable and the protection afforded by this ANR Plan has expired. 4. The adjoining lots are all developed and built upon and there is no additional opportunity to increase lot size or the frontage. 5. The bulk of the lots in this area are of the same size or smaller than the petitioner's lot. 6. Owing to topographical conditions, that is overall size of the lot and the shape of the lot, this lot cannot be. added to in view of the fact that the topographical features have been defined by the boundary lines of the adjoining lots which have been built upon. As a result, no further land accretions are possible for this lot making it is a somewhat unique lot, in that the lot cannot be increased in size. 7. Granting the relief would not be in derogation of the spirit and intent of the Town of Barnstable Zoning Ordinance nor would it be detrimental to the neighborhood. Decision: • Based upon the positive findings a motion was duly made and seconded to grant a Variance from minimum lot area and frontage to permit the lot of 0.8 acres and 125 feet of frontage to be buildable under zoning with the following conditions: 1. This Variance must be recorded at the Registry of Deeds and the Variance is only good for one year. 2. The building on the lot must comply with the Board of Health General Ordinance Article XLVII, "Regulation of Wastewater Discharge" (commonly termed the"330 rule")as this property does not have town waste water disposal available. The Vote was as follows: AYE: Ron Jansson, Emmett Glynn, Gene Burman, Elizabeth Nilsson, and Chairman Gail Nightingale NAY: None. Order: Variance Number 1996-21,from minimum lot size and minimum frontage requirements has been granted with conditions. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. Dexter N.&Catherine Locke Applicants Address: 80 Old Kings Road,Cotuit,MA •- f. Assessors Map/Parcel: 22/97 Zoning: RF, Residential F Zoning District Applicant's Request: Variance to the Zoning Ordinance,Section 3.1.4(5)Bulk Regulations,Minimum Lot Area. This is to allow a variance from the minimum lot size requirement of one acre for a lot of.8 acre. Background Information: Dexter N. &Catherine Locke have petitioned the Zoning Board of Appeals for a Variance to Section 3-1.4(5) Bulk Regulations, Minimum Lot Area Requirements of one acre. The lot is 0.8 acres in size and was created by an Approval Not Required (ANR) Plan endorsed by the Planning Board on April 23, 1973. The plan was dated by the surveyor March 22, 1973. The change in the minimum lot area required in this area from 20,000 sq. ft.to 43,560 sq. ft. was passed at the Town Meeting on March 24, 1973. The date of the first publication of the Notice for this zoning change was February 14, 1973. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on January 10, 1996. A Public Hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on February 28, 1996, at which time the Board found to grant the appeal with conditions. Board members hearing this appeal were Ron Jansson, Emmett Glynn, Gene Burman, Elizabeth Nilsson, and Chairman Gail Nightingale. Attorney Richard Largay represented the petitioners, Dexter&Catherine Locke. He noted that relief at this locus would require a Variance from minimum lot area as well as minimum frontage. He cited that both are Variances to Section 3-1.4 Bulk Regulations and were specified in the legal advertisement. He maintained that both minimum lot area and frontage relief could be granted by the Board. The Board Members agreed that both could be granted within the frame work of his petition and the public notice. Attorney Largay distributed a memorandum in support of this appeal. He cited that the nature of the variances is from minimum lot size for a 0.80 acre lot where one acre is required and from lot frontage for the lot with 125 feet where 150,feet is now required. The lot is part of the Kings Grant Development, a 112 lot subdivision approved in 1973.. He cited that almost all the lots in the subdivision are under one acre and this 0.80 acre lot is one of the larger lots. Mr. &Mrs. Locke purchased the lot in 1980 for their retirement. Later they purchased and moved into another house in the development several lots away and decided to retain this lot as an investment. The two lots are not contiguous. In 1995 they entered into a Purchase and Sales agreement for the lot in question and it was determined that it did not conform to zoning and was unbuildable. Grandfathering expired for this lot and all the other lots in the development in 1978. All of the 13 lots on the ANR plan except this one had building permits issued after grandfathering had expired on the subdivision expired. All of the neighboring lots were built on illegally with regards to grandfathedng and with respect to the ANR plan which was submitted after the date of the first publication of the Notice for zoning changes in this area. It would be a financial hardship if the lot was considered unbuildable. The Locke's paid fair market value of $16,500 in 1980 for the lot. The literal enforcement of zoning in this instance would involve a substantial hardship to the Petitioners. With reference to the uniqueness, all of the abutting lots have been developed and no vacant land exists that would permit the lot to be added to in size or in frontage. Granting the relief would not be in derogation of the Zoning Ordinance as the majority of the lots in this neighborhood are under one acre in size, and many have less than the frontage required today. Public comment was requested and no one spoke in favor or in opposition. The Chairman read letters from abutters John Harvey and Richard Mullin. Mr. Harvey was in support of the appeal, and Mr. Mullin expressed concern for the wildlife in the area. Finding of Facts: Based upon the testimony given during the Public Hearing on this appeal, the Board unanimously found the following findings of fact: 1. The property is located at 80 Old Kings Road, Cotuit, MA on Assessor's Map 22, Parcel 97. 2. The Zoning District is Residential F Zoning District which requires a minimum of one acre in lot size and 150 feet of frontage. The lot in issue is 0.80 acre and has 125 feet of frontage. 3. The lot was created by an ANR Plan endorsed on April 23, 1973. Zoning has changed in the Town of Barnstable and the protection afforded by this ANR Plan has expired. 4. The adjoining lots are all developed and built upon and there is no additional opportunity to increase lot size or the frontage. 5. The bulk of the lots in this area are of the same size or smaller than the petitioner's lot 6. Owing to topographical conditions, that is overall size of the lot and the shape of the lot, this lot cannot be added to in view of the fact that the topographical features have been defined by the boundary lines of the adjoining lots which have been built upon. As a result, no further land accretions are possible for this lot making it is a somewhat unique lot, in that the lot cannot be increased in size. 7. Granting the relief would not be in derogation of the spirit and intent of the Town of Barnstable Zoning Ordinance nor would it be detrimental to the neighborhood. Decision: Based upon the positive findings a motion was duly made and seconded to grant a Variance from minimum lot area and frontage to permit the lot of 0.8 acres and 125 feet of frontage to be buildable under zoning with the following conditions: 1. This Variance must be recorded at the Registry of Deeds and the Variance is only good for one year. 2. The building on the lot must comply with the Board of Health General Ordinance Article XLVII, "Regulation of Wastewater Discharge" (commonly termed the"330 rule")as this property does not have town waste water disposal available.
