I have reviewed the paper road for suitability for access to construct a house on the
subject lot and have the following comments and make the following recommendations:
1. The lot only has frontage on Old Post Road. First it is recommended that the
applicant provide verification that they have rights to construct a road and use
Old Post Road as access to this lot. Secondly Old Post Road needs to be
constructed to provide adequate physical access to the property.
2. Presently Old Post Road is a dirt road that is only one car lane wide. The lot
in question is the only lot on this section of Old Post Road that is not
accessible from another street. In order to provide adequate access to this
single family residential lot I recommend that Old Post Road from Putnam
Avenue to the lot be paved and otherwise properly constructed to the
standards contained in the Planning Board Rules and Regulations. This is a
distance of approximately 1500 feet including paving the 150 of frontage
along the front of the lot on Old Post Road. Due to the steep grade (greater
than 5%) of the existing topography the road will need to be paved in order to
prevent erosion of the road.
3. The road construction needs to be properly designed by the developers
engineer to include adequate drainage to handle runoff from a 10 year
frequency storm, a sound road base consisting of 12 inches of gravel meeting
Town Specifications placed and compacted on top of compacted non frost
susceptible material that has also been compacted, and a three inch thick, 12
foot wide bituminous concrete pavement mat placed in two courses. The
binder course needs to be placed 12 feet wide and the top course placed with
a 10 foot wide traveled way with 1 foot wide "Cape Cod" style berms on each
side of the traveled way. Pavement courses shall consist of a 2" thick binder
course and a 1" thick top course. Gravel and sub grade shall be compacted
to at least 95% of standard procter density. Road shoulders shall be graded,
loamed, seeded and maintained until an acceptable stand of grass is
established.

4. Utilities including water, electric, telephone, and cable need to be designed
and installed in accordance with utility company requirements.
5. The developer's engineer needs to submit a plan of the proposed road
improvements for acceptance by the Town.
6. Once the plans are approved, the Town's Engineering office needs to be
contacted at least 48 hours before beginning work on the road to allow time .
for the Town to schedule inspections of the work within the road layout.
7. 1 note that the construction of a 12 foot wide paved access to this lot will be
adequate for only the one lot. Old Post Road will need to be widened in the
future If other land is developed that will be accessed from Old Post Road.
8. 1 would further recommend that Old Post Road be considered a driveway for
house numbering purposes and that the lot be given a Putnam Avenue
address.

I have attached a copy of my letter dated December 13, 1999 regarding accessing the
subject lot using East Road and then approximately 350 feet of Old Post Road. The
owner of the property has asked if the width of Old Post Road could be 12 feet rather
then the 16 feet requested in my letter. I have no objection to the width of Old Post
road being 12 feet providing this reduced width is adequate for the Fire Department and
the property owner records a document in the registry of deeds relieving the Town of
Barnstable from any responsibility to maintain or plow snow from this road. The form of
this document should be similar to the attached "S" form used by the Planning board on
sub-standard roads.
If a reduced width is approved for Old Post Road then Old Post Road should be
considered a driveway for house numbering purposes and that the lot be given a East
Road address until such time as Old Post road is improved to subdivision road
standards at which time the address of the property will need change to Old Post Road.
Old Post Road may never be improved to Subdivision Road Standards because there
does not appear to be any existing undeveloped lots that need to take access from Old
Post Road.

Dear Mrs. Harmon:
I have looked into the issues regarding access to your lot on Old Post Road, Cotuit (assessors
map 37 parcel 4) and have found the following:
Road improvements. In order to access your lot, the minimum requirement from the
Building Department is to widen the access road to your lot to a minimum of 16 feet wide
plus room to install ditches on both sides of the road for stormwater runoff from the road.
Access shall be widened up to your lot and for at least a distance of 50 feet along the
frontage of your lot.
At a minimum the road should be constructed of a 12" thick layer of processed gravel
conforming to Mass. DPW Specification Number M1.03.1 (compacted to 95% of
standard proctor density) and topped with a two inche thick layer of3i4 inch crushed
stone.
Old Post Road. According to our records for Mosswood Cemetery the Town owns to the
centerline of the 8 foot wide traveled way. If it is necessary to widen the road on the
north side of Old Post Road then you will need to obtain permission in the form of an
easement from the Town. You or your attorney may contact the Town's attorney Bob
Smith at 862-4620 to determine the procedure for acquiring an easement from the Town.
If you do need to obtian an easement to widen the road layout beyond the 8' wide traveled
way, and I think you will, then you may need the approval of the Planning Board under
the subdivision control law. To arrange to determine if they have jurisdictiin you should
talk to Jackie Etsten, in the Planning Department, at 862-4676 and she can arrange to
place you on a meeting agenda. If you need approval of the planning board to widen the
road layout then the requirements for the construction of the road will be determined by
the Planning Board and not the Building Department.
East Lane. East lane is a town owned road over only a portion of it's length. The
northern end of the road is privately owned. You may need to obtain rights in this private
way from the owners of the road. Your attorney is the best one to advise you on this
matter.
Scenic Road. Old Post Road is a scenic road. In order to remove any trees over 4" in
diameter you will need to obtain the permission of the Planning Board. You should
contact the Planning Board at 862-4787 to find out the procedure for filing with them for
approval.
