HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. Additionally, a bolt must be placed between 6"and 12"of each corner: All plates to be connected using 3"x3"xl/4" square plate washers. Floor Construction Requirements: n Sheathing to be nailed in accordance with Table 2 (8d nails, 6" spacing at the edges and 12 inch spacing in the field). Exterior Wall Requirements: All exterior wall studs to be 2 X 4, 16"on center unless noted otherwise on the contract documents. The double top plates on the exterior walls to have a minimum.splice length of 4 or 6 feet and splices to be nailed with 10/12—l6d nails in accordance with Table 6 in the WFCM 110/13 booklet. Nailing of plates to studs to be with 2- 16d nails. The bottom plate to floor box nailing is 3- 16d nails per foot on all elevations with 6"and 4"panel edge nailing requirements and 4- 16d nails per foot for elevations with 3"panel edge nailing requirements. For all door and window openings, multiple king studs are required. For openings up to 4 feet wide, 2 king studs are required, for opening 5 feet to 9 feet wide, 3 kings studs are required. Refer to the design document for specific requirements. For shear and uplift connection of the sheathing,the sheathing is to be nailed as annotated on the design documents. In order to eliminate the need for steel strap ties and hold downs per the WFCM manual, sheathing must be installed in accordance with Note 4 on'the Mass Checklist. I have researched the title to the subject lots at the Barnstable County Registry of Deeds and have found the following ° instruments of record. By deed dated October 28, 1913 , William C. Gifford and Mary A. Gifford conveyed Lots 41 and 42 to Ida Dyer, that deed having been recorded with Barnstable County Registry of Deeds in Book 330, Page 562 . The deed recites that each lot contains 4 , 000 square feet, more or less. I have enclosed a copy of the deed for your reference. It is my understanding that William C. Gifford was the original developer of the subdivision out of which Lots 41 and 42 were conveyed to • Ida Dyer. In other chains of title concerning lots in this subdivision I have seen references made to the "William C. Gifford Development off the west side of Main Street in the Village of Cotuit" . I found no documents of record relative to Ida Dyer at the Registry, of 'Deeds subsequent to the 1913 deed to her other than the Instrument of Taking for non-payment of real estate taxes dated March 10, 1972 and recorded with Barnstable County Registry of Deeds in Book 1714, Page 002 , Notice to Foreclose tax lien recorded December 23 , 1974 with said Registry Book 2133 , Page 048, Land Court Final Decree in Tax Lien Case, Town of Barnstable v. Ida Dyer, dated August 31, 1972 and recorded with said Registry May 14, 1980 in..-Book 3096, Page 285. McGavin by deed dated October 29, 1982 and recorded with said Registry in Book 3602 , Page 082 . As of the date of this letter title to Lots 41 and 42 resides in Christopher P. McGavin and Joann P. McGavin. It is my understanding that subject lots are located in an 'RD' zone and that in 1961 the minimum lot size in an 'RD' zone was 20, 000 square feet with 100' minimum frontage. Since then, the minimum lot size has increased to one (1) acre. General Laws Chapter 40A, Section 6, "Prior Nonconforming Uses", however, provides: "Any increase in area, frontage, width, yard, or depth requirements of a zoning ordinance or by-law shall not apply to a lot for single and two-family residential use which at the time of recording or endorsement, whichever occurs sooner was not held in common ownership with any adjoining land, conformed to the then existing requirements and had less than the proposed requirement but at least five thousand square feet of area and fifty feet of frontage" . An issue for consideration is what constitutes "a lot" for purposes of GLC 40A, Section 6. The Town of Barnstable zoning ordinance defines a "lot" as: " (a) single area of land in one ownership defined by metes and bounds or boundary lines, no portion of which is bisected by a street. " Under Massachusetts case law it has been established that " (t)he usual construction of the word ' lot' in a zoning context ignores the manner in which the components of a total given area have been assembled and concentrates instead on the question whether the sum of the components meets the requirements of the by-law. " Becket v. Building Inspector of Marblehead, 6 Mass. App. Ct. 96, 104 , 373 N.E. 2d 1195, 1199, further appellate review denied, 375 Mass. 788 (1978) . In that case the Marblehead zoning by-law defined "lot" as an "area of land defined by metes, bounds, or boundary lines in a duly recorded deed or shown on a duly recorded plan. " In another case the Appeals Court held that adjoining parcels of land, though acquired in separate transactions by the landowner, could be combined to meet dimensional requirements of the zoning by-law where the by-law defined a lot as a "continuous parcel of land meeting the lot requirement of the by-law for the district in which the land is situated. . . " . Heald v. Zoning Board of Appeals of Greenfield, 7 Mass. App. Ct. 286, 387 N.E. 2d 170, further appellate review denied, 378 Mass. 799 (1979) . The Appeals Court in that case summarized the case law on "assembly of parcels" as follows: l` , o- Christopher McGavin October 4, 1995 Page 3 "In the absence of specific zoning code provisions defining a 'lot' in terms of sources of title or assessor',s plans, the Supreme Judicial Court has consistently held that adjoining parcels may, and indeed, in certain instances, must be considered one lot for zoning purposes. . . Changing patterns of land use frequently require land assembly and realignment of historic lot lines. . . It would be a peculiarly restrictive zoning code which tied owners to descriptions of record. " Id. 289-90, 387 NE 2d at 173. Another case which confirms the principle that parcels may be assembled to meet zoning requirements is Vassalotti v. Board of Appeals of Sudbury, 348 Mass. 658 , 204 N.E. 2d 924 (1965) . In that case it appeared that prior to the adoption of a zoning by-law .a subdivision plan showing many lots was recorded at the registry of deeds and three of the lots, contiguous and each having an area about 2 , 500 square feet and a street frontage of about 25 feet, were conveyed by a single deed, the subsequent grantee of the three lots was entitled as a right to erect one dwelling on the three lots treated as a single lot, under the exemption in the zoning by- law and under the old G.L.C. 40A, Section 5A, even though the town's zoning by-law required a minimum area of 40, 000 square feet and a minimum street frontage .of 180 feet in the district in which the three lots were situated. While the manner in which parcels are assessed is not controlling in determining what constitutes a lot, • assessment practices may serve as "some indication of the status of the property" . Lindsay v. Board of Appeals of Milton, 362 Mass. 126, 131 n. 6, 284 N. E. 2d 595, 598 n. 6 (1972) . In that case the Court cited the fact that the property had been assessed as one lot, not two, which probably bolstered plaintiffs' interpretation of the zoning by-law. The following analysis applies the principles set forth in the aforementioned cases to lots 41 and 42 . The "Dyer lots" , i.e. Lots 41 and 42, can be assembled as one (1) lot which predates zoning and meets the minimum lot size requirements of General Laws Chapter 40A, Section 6. Barnstable Assessors Map 37, Parcel 14 shows lots 41 and 42 merged as one lot. Ida Dyer did not own of record any lots abutting lots 41 and 42 since the deed to her in 1913 and you and your wife have not owned .any lots abutting lots 41 and 42 since you acquired title in 1982 ._ I_� Christopher McGavin October 4, 1995 Page 4 " It is my-opinion based on the foregoing research and analysis that lots 41 and 42 are properly "grandfathered" because assembled together the lots contain at least 5, 000 square feet of area and at least 50 feet of frontage and therefore constitute one building lot. "Title V Septic System" as that is an engineering and Board of Health concern. The Town of Barnstable Building Commissioner, Ralph Crossen, is that official who is invested with the power and authority to issue a Building Permit and he is the chief zoning enforcement officer in the Town of Barnstable. The Appeals Court in that case summarized the case law on "assembly of parcels" as follows: e Christopher McGavin October 4, 1995 Page 3 "In the absence of specific zoning code provisions defining a 'lot' in terms of sources of title or assessor's plans, the Supreme Judicial Court has consistently held that adjoining parcels may, and indeed, in certain instances, must be considered one lot for zoning purposes. . . Changing patterns of land use frequently require land assembly and realignment of historic lot lines. . . It would be a peculiarly restrictive zoning code which tied owners to descriptions of record. " Id. 289-90, 387 NE 2d at 173 . Another case which confirms the principle that parcels may be assembled to meet zoning requirements is Vassalotti v. Board of Appeals of Sudbury, 348 Mass. 658, 204 N.E. 2d 924 (1965) . In that case it appeared that prior to the adoption of a zoning by-law a subdivision plan showing many lots was recorded at the registry of deeds and three of the lots, contiguous and each having an area about 2, 500 square feet and a street frontage of about 25 feet, were conveyed by a single deed, the subsequent grantee of the three lots was entitled as a right to erect one dwelling on the three lots treated as a single lot, under the exemption in the zoning by- law and under the old G.L.C. 40A, Section 5A, even though the town's zoning by-law required a minimum area of 40, 000 square feet and a minimum street frontage of 180 feet in the district in which the three lots were situated. While the manner in which. parcels are assessed is not controlling in determining what constitutes a lot, assessment practices may serve as "some indication of the status of the property" . Lindsay v. Board of Appeals of Milton, 362 Mass. 126, 131 n. 6, 284 N.E. 2d 595, 598 n. 6 (1972) . In that case the Court cited the fact that the property had been assessed as one lot, not two, which probably bolstered plaintiffs' interpretation of the zoning by-law. The following analysis applies the principles set forth in the aforementioned cases to lots 41 and 42 . The "Dyer lots" ,. i.e. Lots 41 and 42 , can be assembled as one (1) lot which predates zoning and meets the minimum lot size requirements of General Laws Chapter 40A, Section 6. Barnstable Assessors Map 37 , Parcel 14 shows lots 41 and 42 merged as one lot. Ida Dyer - did not own of record any lots abutting lots 41 and 42 since the deed to her in 1913 and you and your wife have not owned any lots abutting lots 41 and 42 since you acquired title in 1982 . i Christopher McGavin October 4, 1995 Page 4 It is my opinion based on the foregoing research and analysis that lots 41 and 42 are properly "grandfathered" because assembled together the lots g contain at least 5, 000• square feet of area and at least 50 feet of frontage and therefore constitute one building lot.
