Dear Mr. Crossen:
My office was requested to review the zoning and ownership history
of the above captioned site, owned by John C. and Nancy T.
McGilvary under deed recorded at Barnstable Registry Book 4489
Page 142 dated 12/05/80 in order to assist in determining whether
the lot is buildable without ZBA relief. The relevant facts are
as set forth below.
The parcel contains +1. 36 AC with +253 ' of frontage on Pine Ridge.
Road, a 40 ' wide way with a maintained gravel surface, and +225.51
of frontage on Rushy Marsh Road, a 40' wide way with a maintained
gravel surface. The lot has +35, 570 s.f. of contiguous upland and
+23,440 s.f. of wetland and discontiguous upland fringe adjacent
to Rushy Marsh Road. Current zoning is RF; a residential district
requiring 150' of frontage and one acre of upland.
The subdivision from which the lot derives was prepared for Howard
F. Connors, et ux and signed as an ANR on 10/13/76, all abutting
roads being then in existence. At that time the site was in an RF
zoning district which required 1 acre of land with 150 ' of road
frontage. At the time of subdivision, only 70% of the minimum lot
area was required to be upland; in this case 30,492 s. f. As the
lot has 35, 570 s.f. of contiguous upland now, and since the zoning
definition of "upland" and "wetland" have not changed, and the lot
perimeter has not changed, the lot appears to have met the zoning
requirement initially.
The requirements for lot area and frontage have. not changed in
this district since the time of original subdivision. What has

changed is the upland requirement. The fall 1983 annual meeting
voted to change the requirement from 70% to 100% contiguous upland
(Art. III Ch. III, sec. J(c) ) . The vote was not approved by the
AG's office until 2/4/84, however.
The Connors sold the lot in question to the McGilvarys by deed
dated 12/05/80. On 1/5/81 the Connors sold the abutting lot (lot
5 of the subdivision) to the McGilvarys. That lot also met zoning
at the time of subdivision and at the time of the 1981 sale. No
changes had occurred in relevant zoning between the 1976
subdivision and this date. The McGilvarys held the two lots in
common until 4/22/85 when the northerly lot, which conformed to
zoning at the time of subdivision and at the time of acquisition
by McGilvary, was sold. This lot had ±100 s:f. of isolated
wetland. The sale was within 15 1/2 months of the zoning change
relative to upland requirements.
It appears that the subject lot is currently non-conforming as to
amount of upland and therefore subject to Section 4-4 .2 of the
Zoning Ordinance. Under subsection (1) , it meets all but
condition D, in that the site was not held separately at the time
of the 1984 zoning change for upland but was then held in common
with one other lot. However, it appears that protection may have
been granted to the locus under 4-4.2 (2) , as the lot met all
conditions (A through D) of that- section at the time of its
transfer to the McGilvarys. If this is true, then the lot could
never have been merged with abutting lands and is a valid building
lot.
We would appreciate your comments on this matter and the issuance
of a permit for construction in accordance with the attached
application and plans.

The current exemption for "homeowners" was extended to include owner-occupied
dwellings of six units or less and to allow such homeowners to engage an in-
dividual for hire who does not possess a license, provided that the owner
acts as supervisor-.
DEFINITION OF HOMEOWNER:
Persons) who owns a parcel of land on which he/she resides or intends to re-
side, on which there is, or is intended to be, a one or two family dwelling,
attached or detached structures accessory to such use and/or farm structures.
A person who constructs more than one home in a two-year period shall not be
considered a homeowner. Such "homeowner" shall submit to the Building Official
on a form acceptable to the Building Official, that he/she shall be responsible
for all such work performed under the building ermit. (Section 109. 1. 1)
The undersigned "homeowner" assumes responsibility for compliance with the Stat
Building Code and other applicable codes, by-laws, rules and regulations.

HOME OWNER'S EXEMPTION YM.
The code state that: "Any Home Owner performing work for which a building
permit is required shall be exempt from the provisions of this section
(Section 109. 1. 1 - Licensing of Construction Supervisors) ; provided that if
Home Owner engages a person(s) for hire to do such work, that such Home Owner
shall act as supervisor. "

Many Home Owners who use this exemption are unaware that they are assuming
the responsibilities of a supervisor (see Appendix,Q, Rules and Regulations
for licensing Construction Supervisors, Section 2. 15) . This lack of awarenes
often results in serious problems, particularly+ when the Home Owner hires
unlicensed persons. In this case our Board cannot proceed against the
inlicensed person as it would with licensed Supervisor. The Home " caner actin
as supervisor is ultimately responsible.
To ensure that the Home Owner is fully aware of his/her responsibilities, man
communities require, as part of the permit application, that the Home Owner
certify that he/she understands the responsibilities of a supervisor. On the
last page of this issue is a form currently used by several towns. You may
care to amend and adopt such a form/certification for use in your community.

Dear Mr. Crossen:
My office was requested to review the zoning and ownership history
of the above captioned site, owned by John C. and Nancy T.
McGilvary under deed recorded at Barnstable Registry Book 4489
Page 142 dated 12/05/80 in order to assist in determining whether
the lot is buildable without ZBA relief. The relevant facts are
asset forth below.
The parcel contains +.1.36 AC with +253 , of frontage on Pine Ridge
Road, a 401 wide way with a maintained gravel surface, and +225.51
of frontage on Rushy Marsh Road, a .40" wide way wi" a maintained
gravel surface. The lot has ±35,570 s.f. of contiguous upland and
±23,440 s.f. of wetland and discontiguous upland fringe adjacent
to Rushy Marsh Road. Current zoning is RF; a residential district
requiring 150' of frontage and one acre of upland.
The subdivision from which the lot derives was prepared for Howard
F. Connors, et ux and signed as an ANR. on 10/13/76, all abutting
roads being then in existence. At that time the site was in an RF
zoning district which required 1 acre of land with 150' of road
frontage. At the time of subdivision, only 7o% of the minimum lot
area was required to be upland; in this case 30,492 s. f. As the
lot has 35,570 s.f. of contiguous upland now, and since the zoning
definition of "upland" and "wetland" have not changed, and the lot
perimeter has not changed, the lot appears to have met the zoning.

changed is the upland requirement. The fall 19s3 annual meeting
voted to change the requirement from 70 to 100% contiguous upland
(Art. III Ch. 111, sec. 3(c) ) . The vote was not approved 'by the
AG's office until 2/4/84, however.
The Connors sold the lot in question to the McGilvarys by deed
dated 12/05/80. on 1/5/81 the Connors sold the abutting lot- (lot
5 of the subdivision) to the McGilvarys. That lot also met zoning
at the time of subdivision and at the time of the 1981 sale. No
changes had occurred in relevant zoning between the 1976
subdivision and this date. The McGilvarys held the two lots in
common until 4/22/85 when the northerly lot, which conformed to
zoning at the time of subdivision and at .the time of acquisition
by McGilvary, was sold. This lot had ±100 s.f. of isolated
wetland. The sale was within 15 1/2 months of the zoning change
relative to upland requirements.
It appears that the subject lot is currently non-conforming as to
amount of upland and therefore subject to Section 4-4.2 of the
Zoning ordinance. Under subsection (1) , it. meets all but
condition D, in that the site was not held separately at the time
of the 1984 zoning change for upland but was then held in common
with one other lot. However, it appears that protection may have
been granted to the locus under 4-4.2(2) , as the lot met all
conditions (A through D) of that section at the time of its
transfer to the McGilvarys. If this is true, then the lot could
never have been merged with abutting lands and is a valid building
lot.
We would appreciate your comments on this matter and the issuance
of a permit for construction in accordance with the attached
application and plans.
