Massachusetts, the Petitioner by himself requested a
variance of section 3- 1 .445� to waive the required 150 feet
of frontage on a road, of the Town of Barnstable's Zoning
Bylaws for the property located at Pine Road in Cotuit, Map
• 18, parcel 125.
In support of this petition, the Petitioner presented
evidence that the following conditions applied which would
warrant relief:
The Petitioner owns and has lived on a 2.87 acre parcel of
land for over 25 years which has only 150 feet of frontage
on Pine Street. A one foot strip of land belonging to an
adjoining lot separates the access and frontage a
substantial of part of the lot from Pine Street. The
applicant has been unable to purchase this strip from the
adjoining property owner. The Petitioner wishes to divide
the parcel into two lots,as a result of a divorce order.
One would have 60 feet of frontage and the other would have
90 feet of frontage. 150 feet is required in the zoning
district.

The Petitioner wishes to remain living on locus , and will
not be able to do so as a result of the court order unless
he is able to create two (2) lots.
FINDINGS OF FACT
Based on the 'evidence submitted, the Zoning Board of Appeals
made the following findings of fact:
Desirable relief may be granted without substantial
detriment to the public good because:
1 ) Both lots exceed the minimum one acre requirement
of the Zoning Bylaw
2) Both lots will have adequate access on Pine Street
Desirable relief may be granted without nullifying or
substantially derogating from the intent or purpose of such by-IQw :
Both lots meet all the acre requirements of the Zoning
Bylaw and would have had sufficient frontage except for the
existence of a one foot strip of land separating the parcel
.from part of Pine Street.
There are circumstances relating to soil conditions, shape,
or topography of such land or structures especially
effecting such land in that; ( 1 ) the parcel is unique in
that it is a large parcel of land without adequate frontage
on a road caused by the existence of a one foot strip of
land in different ownership.
A literal enforcement of the applicable Bylaw would involve
substantial hardship, financial or otherwise to the
Petitioner because: ( 1 ) The applicant would be unable
to subdivide a large 2.87 acre parcel of land which meets
all of the other zoning acre requirements, and because of

the court order, would be deprived of its use totally.

At a public hearing held on March 10, 1988, the Zoning

Board of Appeals voted by a 4 - 1 vote to grant relief

Barnstable Superior court or Land Court of the Commonwealth of
Massachusetts, as prescribed in Section 17 of Chapter 40A of the
General Laws of Massachusetts by filing a Complaint in said
Court(s). as well as a notice of action with the Barnstable Town
Clerk, within twenty (20) days of the. filing of this decision with
the Barnstable Town Clerk's Office.

Information and Instructions
Massachusetts General Laws chapter 152 section 25 requires all employers to provide workers' compensation for their
employees. As quoted from the'law",an employee is defined as every person in the service of another under any contract
of hire,express or implied,oral or written.
An employer is defined as an individual,partnership,association, corporation or other legal entity, or any two or more of
the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer, or the receiver or
trustee of an individual,partnership,association or other legal entity,employing employees. However the owner of a - _
dwelling house having not more than three apartments and who resides therein,or the occupant of the dwelling house of
another who employs persons to do maintenance,construction or repair work on such dwelling house or on the grounds or
building appurtenant thereto shall not because of such employment be deemed to be an employer.
MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal
of a license or permit,to operate a business or to construct buildings in the commonwealth for any applicant who has
not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neither the
commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until
acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting
authority.

DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to
be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be
responsible for all such work performed under the building permit. (Section 109.1.1)

applicable codes,bylaws,rules and regulations.

Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the
State Building Code Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the
provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for
hire to do such work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,
Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,
particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would
with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,
that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used
by several towns. You may care to amend and adopt such a form/certification for use in your community.
