DeMattos At a regularly scheduled hearing, held on March 10, 1988 notice of which was duly published in the Barnstable Patriot, and notice of which was forwarded to all interested parties pursuant to Chapter 40A of the General Laws of Massachusetts, the Petitioner by himself requested a variance of section 3- 1 .445� to waive the required 150 feet of frontage on a road, of the Town of Barnstable's Zoning Bylaws for the property located at Pine Road in Cotuit, Map • 18, parcel 125. In support of this petition, the Petitioner presented evidence that the following conditions applied which would warrant relief: The Petitioner owns and has lived on a 2.87 acre parcel of land for over 25 years which has only 150 feet of frontage on Pine Street. A one foot strip of land belonging to an adjoining lot separates the access and frontage a substantial of part of the lot from Pine Street. The applicant has been unable to purchase this strip from the adjoining property owner. The Petitioner wishes to divide the parcel into two lots,as a result of a divorce order. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor.
