In support of this petition, the Petitioner presented te w t=' evidence that the following conditions applied which would O ' warrant relief: w The Petitioner owns and has lived on a 2.87 acre parcel of b land for over 25 years which has only 150 feet of frontage I=-� ` a on Pine Street. A one foot strip of land belonging to an adjoining lot separates the access and frontage a :F substantial of part of the lot from Pine Street. The applicant has been unable to purchase this strip from the adjoining property owner. The Petitioner wishes to divide . I the parcel into two lots.as a result of a divorce order. Richard Duggan, et al Dear Mr. Martin: Several months ago I spoke with Joe about testifying in an upcoming trial on March 20 , 1989 . However, since he is' unable to do so because of his health, I would like to meet with you on Monday, March 19, 1990 with regard to your testifying. The following is a synopsis of the case. In March of 1988 my client, Paul deMattos, owner of a 2. 87 acre parcel of land in Cotuit, applied for and received a variance from the Board of Appeals to divide his land into 2 lots, one with 90 feet of frontage. Copies of the plan and variance are enclosed. As you can see, the variance "authorized" the division of my client' s land into 2 lots and further, the plan was recorded on May 26, 1988, approximately 2 months after the variance was granted. In February of 1989 my client agreed to sell LOT 2. The closing was scheduled for April 18 , 1989 . However, the buyer refused to go forward with the purchase on the, grounds that the variance "lapsed" because it was not "exercised" within one year of the grant as required under c. 40A, Section 10. I discussed the case with Joe and he executed an affidavit (copy enclosed) which stated that the variance was "exercised" by the recording of the plan. Therefore, he would issue a building permit at any time, either before or after April 18, 1989. If possible, I would like you to testify to the same matter on Tuesday morning, March 20 , 1990 . AFFIDAVIT G tow comes JOSEPH DA LUZ, on oath deposes and states the following_ 1 . I am the Building Inspector for the Town of Barnstable and have held this position since 1973. 2 . I have reviewed the variance dated March 25, 1988 and modified April 15, 1988 issued to Paul V. deMattos concerning two ( 2) parcels of land off Pine Road in Cotuit. ' 3 . I have also examined a plan of land entitled "Plan of Land in BARNSTABLE (Cotuit) MASS. for Paul V. deMattos, Scale 1" 40' , May 12, 1988, Baxter & Nye, Inc. , Registered Land Surveyors and. Civil Engineers, Osterville Mass." , recorded on May 26, 1988 in Plan Book 449, Page 43. 4. Because the variance authorized the subdivision of Mr. deMattos' land into two ( 2) lots, and the subdivision plan was recorded within one ( 1) year of the date of the variance, the variance did not lapse on April 15, 1989. 5. I stand ready to issue a foundation and building permit to Mr . deMattos or other owner of LOT 2 at any time, provided the Board of Health approves the septic system design and well placement. 6. In February, 1989, I advised Attorney Albert J. Schulz, Mr. deMattos' attorney, of my opinion that the variance . would not lapse and that I would issue a building permit for LOT 2 at any time either before or after April 18, 1989. I understand that Mr. deMattos subsequently requested and obtained an extension of the variance. I believe said extension was unnecessary because the rights under the variance had already been exercised. _ 7 . Prior to April 18, 1989, no person other than Attorney Schulz asked me whether I would issue a building permit for LOT 2 nor was a foundation permit applied for.
