I represent Paul Morris who is purchasing this property known as 48 Rushy Marsh Road. It is my understanding that a building permit was taken out by a Norman L. and Judith Bland sometime in the early 1990's,butt was never acted upon. I examined the title for Lots 159A and 159B and find that they have been in separate ownership from 1953 to date. I did, however, find in the chain of title an Order of Conditions issued to Norman and Judith Bland by the Barnstable Conservation Commission SE-3283 in May of 1995(copy enclosed)and was duly recorded in Book 10025 Page 129. According to my client and conversations with, I believe, Rob Gatewood this Order of Conditions is for the construction of the house,because of the elevation and the area being possibly within the flood zone, which I believe the Conservation Commission now does by Notice of Application for Determination of Applicability. The roads are paved and have all of the utilities at the lot line. Would you kindly review the matter and notify me whether or not there is any reason why a building permit would not be issued, provided my clients provide you with the necessary building permit application, Conservation approval, if necessary, and the Board of Health permits.
