An employer is defined as"an individual,partnership,association, corporation or other legal entity,or any two or more of the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer,or the receiver or trustee of an individual,partnership,association or other legal entity,employing employees. Additionally,MGL chapter 152, §25C(7)states"Neither the commonwealth nor any of its political subdivisions shall enter into any contract for.the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority." A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 15, 1999, and continued to November 17, 1999 and January 5, 2000.at which time the Board granted a Variance with conditions. Hearing Summary: Board Members hearing this appeal were Gene Burman, Ron Jansson, Gail Nightingale, Richard Boy, and Chairman Emmett Glynn., Alternate Board Member Tom DeRiemer will hear the testimony tonight and can replace any Board Member if necessary. Attorney John Alger represented the applicant, Donald F. Law, Jr. Present was Arlene Wilson, PWS, of A.M.Wilson Associates, Inc. Attorney Alger described the site. There is presently a small cottage. The one-car garage has been removed. The owner went to the Town of Barnstable Conservation Commission in April'(1999) seeking Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-108-Law Variance to Section 3-1.4(5)Bulk Regulations-Front Yard Setback permission to demolish the cottage on site and build a new dwelling that would have been partially inside the 50 foot buffer zone. The Conservation Commission would not approve any structure that encroached within 50 feet of the top of the bank_even though the top of the bank is a considerable distance from Poponessett Bay. In order to comply with conservation, the applicant is proposing to move the house out of the 50 foot buffer zone and closer to the front property line. But, they need a variance from the Zoning Board of Appeals because the dwelling will encroach into the required 30 foot front yard setback. The house will encroach by 5 feet on one end and 10 feet on the other end. If the applicant were to build a smaller house, they would not encroach on any setbacks. However, Attorney Alger stated that to build a smaller house was not feasible. When you take into account the 50 foot buffer in the rear and the 30 foot setback in the front, a satisfactory house can not be built that justifies the price paid for the lot. The topography of the lot is unique in that much of the lot is unbuildable when you put in all the buffer zone requirements. The shape of the lot is unique due to the Conservation Commission and zoning restrictions placed on the lot. On the site are some beautiful trees that will act as a buffer. There are houses already built on either side of the subject lot and this proposed dwelling will be in keeping with those houses. As such, the proposed relief may be granted without substantial detriment to the public good and without derogating from the intent or purpose of the.Zoning Ordinance. Attorney Alger reported that all of the lot is considered upland, but it is not buildable due to the 50 foot conservation regulation. There is only a small strip of land (less than 10%)that can be used for any structure. The proposed house will be approximately 112 feet long including the breezeway and garage. The Board felt this might be a self-imposed hardship because the proposed house is so large. There was a house on the lot and a new house can be built on the lot-just not as big as the applicant wants. Attorney Alger disagreed stating that the applicants were upset with the Conservation Commission's ruling and they have appealed to the DEP and to Superior Court. The DEP told the applicant they could build in the 50 foot buffer but the applicant is still in Superior Court. The applicants have two proposals. On one plan, the house is within the 50 foot conservation buffer zone but meets the zoning setbacks. On the other plan, the house is outside the conservation buffer zone but encroaches on the zoning setback. The applicant would like the first plan [within the conservation buffer zone and meeting the zoning setbacks). The Board requested elevation plans as the new house will be twice as long and three times as big as the old house. Attorney Alger stated he will provide elevation plans and floor plans so the Board can understand the scale of the project and requested a continuance. If the applicant were to build a second story, no zoning relief would be needed, but they do not want a two story home. Public Comment: Arlene Wilson addressed the Board. She stressed this was not a self-imposed hardship. She indicated that the Conservation Commission is not uniform in its rulings and no one knows what will happen when they go before the Commission. They are not consistent in their rulings and one r can not tell from project to project how they will rule. No one else spoke in favor or in opposition to this appeal. The Board voted to continue Appeal Number 1999-108 to November 17, 1999 @ 7:30 PM. Board Members hearing this appeal on November 17th were Gene Burman, Ron Jansson, Gail Nightingale, Richard Boy, and Chairman Emmett Glynn, Alternate Board Member Tom DeRiemer heard the testimony and can replace any Board Member if necessary. As to Variance conditions, Attorney Alger stated there is a long sloping bank down to the bay and because of the Conservation Commission Regulation that requires a 50 foot buffer from the top of the coastal bank -which is beyond Chapter 131 rules but within the town bylaw -there is a restriction as to the available buildable area. The entire site is 20,234 square feet of which only 3,402 square feet is buildable and that is in a small triangular shape. Added to that, this is a corner lot intersected by two 45 foot ways making it a unique parcel for the neighborhood. The relief may be granted without substantial detriment to the neighborhood as it would help to start the rebuilding of this area. Attorney Alger reviewed the elevation plan. Law, Jr. Attorney Alger submitted a new plan to the file and all Board Members received it. Attorney Alger reviewed the new plan and indicated it is not as nice looking as the other plan. In his opinion, the original plan was better looking aesthetically. He reminded the Board that the last time he asked the architect if the plans could be changed slightly so relief would not be needed, the architect told him this type of home is"proper for this site"and he could not change the plans. But Attorney Alger went back and again asked him to reconfigure the house and this is the new plan he has submitted. As.to the lot itself, it is usual in that more than 1/3 of the lot is on an embankment that slopes from 0 feet to 30 feet and only 16.8% of the lot is buildable. Plus, they must satisfy the wetland buffer zone. These are unique topographical features directly affecting this lot. If the relief is allowed, the applicants would be able to move the existing septic system farther away from the water which would be ecologically better. The original plans were reviewed again. The first floor has the master suite, kitchen, dining room and living room while the second floor has three bedrooms and a study over the garage. Attorney Alger offered a"compromise" - if the Board were to grant the relief for the encroachment on the westerly side of the house, which would allow for the garage, Attorney Alger would tell the applicants to scale back the house on the easterly side so as to not violate that setback. Findings of Fact: At the hearing of January 5, 2000, the Board voted on the following findings of fact as related to Appeal No. 1999-108: 1. The Applicant, Donald F. Law, Jr., is seeking a Variance to Section 3-1.4(5) Bulk Regulations - Front Yard Setback. 2. The property address is 562 Poponessett Road, Cotuit, MA as shown on Assessor's Map 007, Parcel 004.001. The site is 0.91 acres and is located in the AP Aquifer Protection Overlay District. 3. The locus is located in an RF Residential F Zoning District which requires a minimum 30 foot front yard,15 foot side yard and 15 foot rear yard setback. This lot is a corner lot so a minimum 30 foot front yard setback is required off both Poponessett and Santuit Roads. 4. The applicant is proposing to demolish the existing dwelling and construct a new, 4 bedroom single- family residence of approximately 3,550 square feet as well as a two-car garage. 5. The applicant is seeking Variance relief for both sides of the house as the proposed new dwelling will be situated approximately 25 feet from the front property line off Poponessett Road ("the garage end") and approximately 20 feet from the front property line off Santuit Road ("the master suite end"). 6. The property itself is unique in that more than one-half of the property lies within the coastal bank and within wetlands areas as determined by the Conservation Commission. 7. The applicant has attempted to seek relief from the local Conservation Commission and was denied relief from the 50 foot wetlands buffer zone. 8. The configuration of the lot is such that there is a very small "envelope" on which to build the house that the applicant is seeking to build and to make use of the lot consistent with the value of the lot. - 9. The size of the master bedroom is such that there is no real hardship in not having the master bedroom be as large as it is proposed. The relief may be granted without substantial detriment to the public good or neighborhood affected and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Law,Jr. Present was Arlene Wilson,PWS,of A.M.Wilson Associates,Inc. Attorney Alger described the site. There is presently a small cottage. The one-car garage has been removed. The owner went to the Town of Barnstable Conservation Commission in April(1999)seeking permission to demolish the cottage on site and build a new dwelling that would have been partially inside the 50 foot buffer zone. The Conservation Commission would not approve any structure that encroached within 50 feet of the top of the bank even though the top of the bank is a considerable distance from Poponessett Bay. In order to comply with conservation,the applicant is proposing to move the house out of the 50 foot buffer zone and closer to the front property line. But,they need.a variance from the Zoning Board of Appeals because the dwelling will encroach into the required 30 foot front yard setback. The house will encroach by 5 feet on one end and 10 feet on the other end. If the applicant were to build a smaller house,they would not encroach on any setbacks. However, Attorney Alger stated that to build a smaller house was not feasible. When you take into account the 50 foot buffer in the rear and the 30 foot setback in the front;a satisfactory house can not be built that justifies the price paid for the lot. The topography of the lot is'unique in.that'much of the lot is unbuildable when. ' you put in all the buffer zone requiremenis.' The shape of the lot is unique due to.the Conservation ' g the site,*are some beautiful trees that will act as"a, Commission and zonin restrictions placed on the lot'. On: ' buffer. There is only a small strip of land(less than 10%)that can be used for any structure. The proposed house will be approximately 112 feet long including the breezeway and garage. The Board felt this might be a self-imposed hardship because the proposed house is so large. There was a house on the lot and a new house can be built on the lot-just not as big as the applicant wants. Attorney Alger disagreed stating that the applicants were upset with the Conservation Commission's ruling and they have appealed to the DEP and appealed to Superior Court. The DEP told the applicant they could build in the 50 foot buffer but the applicant is still in Superior Court. The applicants have two proposals. On one plan,the house is within the 50 foot conservation buffer zone but meets the zoning setbacks. On the other plan,the house is outside the conservation buffer zone but encroaches on the zoning setback. The applicant would like the first plan[within the conservation buffer zone and meeting the zoning setbacks]. The Board requested elevation plans as the new house will be twice as long and three times as big as the old house. Attorney Alger stated he will provide elevation plans and floor plans so the Board can understand the scale of the project and requested a continuance. If the applicant were to build a second story,no zoning relief would be needed,but they do not want a two story home. Public Comment: Arlene Wilson addressed the Board. She stressed this was not a self-imposed hardship. She indicated that the Conservation Commission is not uniform in its rulings and no one knows what will happen when they go before the Commission. The entire site is 20,234 square,feet of which only 3,402 square feet is.buildable and that is in a small triangular shape.
