According to the Assessor's record,the lot is a 0.62-acre lot developed with a one and one-half- rb story,single family dwelling of 1,847 sq.ft.,of living area. It is a two-bedroom dwelling that dates to 1955 0 and also has an attached garage of 320 sq.ft. The property is served by public water and an on-site septic o system It is located in a Residence F Zoning District and the Resource Protection Overlay District. w co The applicant is proposing to demolish the existing dwelling on the lot and reconstruct a new single-family dwelling. The proposed new single-family dwelling is to have a total of 4,067 sq.ft., of living area,a garage of 473 sq.ft.,a screened porch of 242 sq.ft., and covered porches totaling 340 sq.ft. Plans show the dwelling E to be a three-bedroom, 1.5-story home. a� b Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 12,2004. An extension of time for holding the public hearing and for filing of the decision was executed o between the applicant and the Board.'A public hearing before the Zoning Board of Appeals was duly w advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on August 04,2004,at which time the Board found to grant the appeal. Board Members deciding this appeal were;Richard L.Boy,Ralph Copeland, Gail Nightingale,Randolph Chiles and Chairman Daniel M. Creedon III. Attorney John R.Alger represented the applicant before the Board. He submitted a revised site plan dated June 23, 2004 and noted that the building area calculation had been revised slightly to adjust to that new plan. Mr.Alger noted that this proposal is a lager home,but one that would be in keeping with the neighborhood .and an improvement to it over that which now exists. He presented the plan noting that it has been before conservation and an order of conditions has been issued. The on-site septic will conform to the requirements of title 5 without variance. Public comment was requested and no one spoke in favor or in opposition to the request. Chairman Creedon noted that a letter of support from Demos R.Houle of 679 Popponessett Road, Cotuit,an abutter, was submitted to the file. r r T . Findings of Fact: At the hearing of August 04,2004, the Board unanimously made the-following findings of fact: I E 1. Appeal 2004-107 is that of John A. and Christine E.Williams seeking a Special Permit in accordance with Section 4-4.3 Nonconforming'Buildings or Structures Used as Single and Two-Family. Residences, j and findings under MGL Chapter 40A, Section 6 for the demolition and reconstruction of a single-family dwelling on a nonconforming lot. The property is shown on Assessor's Map 006,Parcel 015 addressed i as 682 Popponessett Road, Cotuit,MA in a Residence F and the Resource Protection Overlay Districts. 2. The property is located on Shoestring Bay at the intersection of Popponessett Road and Santuit Road in f Cotuit. The lot is a 0.62-acre lot developed with a one and one-half-story, single family dwelling of 1,847 sq.ft.,of living area. It is a two-bedroom dwelling that dates to 1955 and also has an attached garage of 320 sq.ft. The property is served by public water and an on-site septic system. It is not located in a groundwater protection area and is not subject to the Town's 330 rule or 440 nitrogen loading limitations of Title 5. 3. The applicant is proposing to demolish the existing dwelling on the lot and reconstruct a new single- family dwelling having a total of 4,067 sq.ft.,of living area,a garage of 473 sq.ft.,a screened porch of 242 sq.ft.,and covered porches totaling 340 sq.ft. Plans show the dwelling to be a three-bedroom, 1.5- story home. The footprint of the structure is to be 3,800 sq.ft.,for a lot coverage of approximately 13.5%. 4. The property is located on Shoestring Bay and is subject to the jurisdiction of the Conservation Commission. An Order of Conditions was issued for the reconstruction as'it is located within 100 feet of wetlands and 100 feet of the top of the coastal bank. 5. The proposed dwelling is long and narrow,measuring some 107 feet long facing on Popponessett Road and 40 feet long facing on Santuit Road. For the most part it is 25 feet wide. The shape and configuration are dictated by the required 50-foot conservation setbacks from wetlands/resource areas and the required 30-foot zoning front yard setback. 6. The lot was created by a plan entitled, "Plan of land belonging to Robert T.Fowler, showing Cotuit Highground"dated July 1, 1926 recorded in Plan Book 19 as page 143. The lot becoming a legal pre- existing non-conforming lot due to the 1973 rezoning of the area to Residence F. j 7. With respect to MGL Ch. 40A, Section 6,the proposed new dwelling is an intensification over that which now exists on the lot and it does intensify the use of the nonconforming lot,however the proposed new dwelling would not be substantially more detrimental to the neighborhood than the former dwelling. ! Decision: Based on the findings of fact,a motion was duly made and seconded to grant the permit for the demolition and reconstruction with expansion of a single-family dwelling on an undersized non-conforming lot. The reconstruction shall comply with all setback requirements and is subject to the following conditions: i 1.
