As quoted from the"law", an employee is defined as every person in the service of another under any contract of hire, express or implied, oral or written. An employer is defined as an individual, partnership, association,corporation or other legal entity, or any two or more of the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receiver or trustee of an individual, partnership, association or other legal entity, employing employees. However the owner of a dwelling house having not more than three apartments and who resides therein, or the occupant of the dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer. MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required. She received her title by a deed from Bass River Savings Bank dated ay 5, 1977 d recorded with Certificate of .Title 70422. , Under our Zoning Ordinance Section 4-4-2 (1), any increase in the size requirement of the Zoning Ordinance shall not apply to a lot for a single family residential use which at the time of recording or endorsement: A)was not held in common ownership with any adjoining land and B)had a minimum of 5,000 sq. ft. or area and 50 feet of frontage or the minimum frontage requirement for the zoning district in which it is located; and C) conformed to the existing zoning if any when legally created, and D)was separately owned at the time of every zoning change which made it nonconforming. At the time of the zoning change from RD-2 , 20, 0000 sq. ft. to 43,560 sq. ft. minimum . e. size RF zoning district, the lots were held in separate ownership and not under common control: Prior to losing the lots involuntarily to Bass River Savings Bank in 1977 and prior to the change in zoning in March, 1973,the lots were in separate ownership and not in common control. The subdivision-plan protection article in 4-4.2 (3) of our Zoning Ordinance provides protection to a subdivision plan for up to eight years from the date of endorsement and recorded release from the Planning Board. Though the release was not recorded until 1979, the records of the Board show the subdivision was completed and all securities released by 1973. There have been over 40 lots of similar size in this subdivision that have been built upon both during the eight year freeze and afterwards.
