As I told you during our telephone conversation last week, she has students on Tuesday and Thursday afternoon. Her schedule on Tuesdays is as follows: 2:30-3:00 p.m., 3:30-4:30 p.m., 4:30-5:00 p.m., and, 5:30-6:00 p.m. Of her students on Tuesdays three are transported to Queen Anne Lane'by parents, two of whom park their respective automobiles in Ms. LeClair's driveway, and one of whom drops the students off, drives off and picks them up after their lessons. On Thursdays the schedule is as follows: 2:15-2:45 p.m., 3:00-3:30 p.m., 4:00-4:30 p.m. and 4:30-5:00 p.m. Of her students on Thursdays two are transported to Queen Anne Lane by their parents, one of whom waits in the driveway at 44 Queen Anne Lane, and one of whom drops the student off, drives away and picks the child up after the piano lesson. The rest of the students either walk or ride their bicycle to Ms. LeClair's home. I have review the requirements contained within Section 240-46 ("Home Occupation") and I believe Ms. LeClair's home occupation meets all of the requirements set forth: hers is a single family dwelling, her piano teaching is not discernible from outside of the dwelling, there is no increase in odor or noise, there is no alteration to the premises at all, no increase in traffic volume above normal residential volumes and no increase in either air or groundwater pollution. Enclosed please find Ms. LeClair's Home Occupation Registration, along with her check in the amount of$25.00. Please issue a Permit for Home Occupation at your earliest convenience. It is my understanding that home occupation is permitted "as of right" subject to compliance with certain requirements, all of which, I believe, Ms. LeClair meets. When we spoke, you indicated to me that you felt that there must be substantially more automobile traffic at 44 Queen Anne Lane than that which I had reported to you. My client insists that any traffic volume, as a result of.her piano teaching, is negligible; however, she also states that, in the future, all parking necessary to drop-off and pick-up will take place in her driveway and not on Queen Anne Lane. She is having her students' end-of-year Ms. Grangregario May 30, 2006 Page 2 of 2 recital at the Baptist Church in Osterville on June 6, 2005. There will be no piano lessons given from that date until mid-September. When trying to determine why someone would have filed a complaint against her, the only instance that she recalls that might have triggered such a letter was for the three weeks following Easter (April 16, 2006) when she was in Europe and her adult son stayed at her home for a few days and may have parked his van on the street. She estimates that he was at the home for about six days during that time. Other than that instance, she does not know why a complaint would have been made. Apparently, this has been going on for a number of years. The problem is that visitor's cars are parked on both sides of the street making it difficult for others to get by. This also means that emergency apparatus would have greater difficulty. I am informed that the caller's elderly mother lives at the end of the Queen Anne cul-de-sac having relocated there about 4 months ago. First, Tom, I need to know if you consider piano lessons as an educationally exempt use. There is nothing in the street file that indicates any accessory use or approvals and nothing in the ZBA database. Of course, . pursuing piano teachers, in my humble opinion, is not going to result in good PR but it's your call, Tom. (That must be why you get the big bucks!)The caller will check back next week for your determination. Secondly, I thought perhaps both the Fire Chief and Sergeant McKenna could communicate with the owner and encourage parking in such a manner that it would not impede the public's right to travel past the subject property. I believe the caller will be satisfied with new/improved parking arrangements as the intention here is really to protect the safety and welfare of the neighbors on the other end of the street.
