Dear Mr. Crossen:
Cheryl V. Williams is the owner of the parcel of land cited
above. This parcel is shown as LOT 29 on a plan dated November
14, 1968, and recorded at Barnstable Registry of Deeds Plan Book
229, Page 51. A copy of this plan is enclosed.
The purpose of this letter is to obtain your determination
that Ms. Williams' parcel is buildable as a "grandfathered lot"
and that there is no Town limitation restricting access to the
lot from Old King's Road.
In order to assist you with determining that Ms. Williams'
lot is buildable, I will trace the ownership of her lot and all
abutting land to show that her lot has not been in common owner-
ship with any abutting parcels since March 29, 1973 (the date
that one-acre zoning was adopted) .
First, let us review ownership of the subject parcel: On
August 12, 1969, Raymond D. Crawford and Gwendolyn W. Crawford
deeded LOT 29 to William J. Wetmore and Marjorie E. Wetmore.
This deed is at Barnstable Registry Book 1445, Page 880. Then,
on December 21, 1984, the Wetmores deeded LOT 29 to Allen B.
Williams and Cheryl L. Williams (see this deed at Barnstable
Registry Book 4373, Page 40) . Allen B. Williams has since died
and Cheryl L. Williams is now the owner of LOT 29.
Next, we will review ownership of LOT 28 on the plan dated
November 14, 1968, and recorded at Barnstable Registry Plan Book
229 Page 51. On May 17, 1971, Raymond D. Crawford deeded LOT 28

to Lawrence MacGilpin and Dorothy M. MacGilpin. This deed is at
Barnstable Registry Book 1511, Page 842. Then, on August 23 ,
1973 , the MacGilpins deeded LOT 28 to David A. Chute and Ruth F.

Chute by a deed at Barnstable Book 1922, Page 326. The Chutes
deeded LOT 28 to Ruth F. Chute on August 31, 1979 (Barnstable
Book 2977, Page 255) , and on June 23, 1994, Ruth F. Chute deeded
LOT 28 to John J. McGreenery and Ruth C. McGeenery, Trustees of
the McGreenery Nominee Trust. The "McGreenery deed" is at Barn-
stable Book 9251, Page 85.
Third, we find ownership of LOT 30 on the same plan as LOTS
28 and 29 as follows: On February 23, 1976, Raymond D. Crawford
deeded LOT 30 to Philip M. Byrne and Matthew P. Byrne by a deed
at Barnstable Registry Book 2302, Page 322. On March 30, 1976,
the Byrnes deeded LOT 30 to Philip M. Byrne, Matthew P. Byrne and
Bertram Zarins. This deed is at Barnstable Book 2490, Page 297.
Next, on September 26, 1977, these three owners deeded LOT 30 to
Bertram Zarins. See Barnstable Book 2588, Page 160, for this
deed. On November 5, 1980, Bertram Zarins conveyed LOT 30 to
Christopher J. Byrne b a deed at Barnstable Book 3193 Page 156.

Then Christopher J. Byrne deeded LOT 30 to the Roberts Realty
' Trust on January 30, 1984. This deed is at Barnstable Book 4036,
Page 169. (A confirmatory deed for this conveyance was executed
by Christopher J. Byrne on February 7, 1985, and is recorded at
Barnstable Book 4420, Page 42, because the original deed failed
to recite the name of the trustees of the Roberts Realty Trust. )
Finally, on February 15, 1985, the Roberts Realty Trust deeded
LOT 30 to Sidney R. McPherson and Estelle H. McPherson. The
McPherson's deed is at Barnstable Book 4420, Page 43 .
Finally, we trace the ownership of the land abutting the
subject parcel (LOT 29) on the west. This land is shown as "Ray-
mond D. & Gwendolyn W. Crawford, Old King's Road, Cotuit, Mass. "
on the Plan. On December 16, 1968, Raymond D. Crawford and Gwen-
dolyn W. Crawford conveyed this land to J. Bradford Sargent, Jr. ,
and Edith H. Sargent by a deed at Barnstable Book 1428, Page 180.
Then on January 2, 1992, the Estate of Edith H. Sargent deeded
this property to John F. Ponte, Jr. , and Catherine Hurley. This
deed is at Barnstable Book 7820, Page 84. (There is a deed con-
veying this land from the King's Grant Trust to J. Bradford Sar-
gent, Jr. , and Edith H. Sargent dated September 18, 1974, and
found at Barnstable Book 2098, Page 260. This provides an alter-
nate theory as to how the Sargents came to own this property, but
I cannot find any real support for this deed. The deed claims
that the King's Grant Trust conveyed the property from Raymond
Crawford in 1965 by a deed at Barnstable Book 1313, Page 301.
When I checked this document, I found it was not a deed as
claimed but an easement given by the Crawfords to Cape and Vine-
yard -Electric Company. )
A review of these titles shows that at no time since March
.29, 1973, was Ms. Williams' LOT 29 in common ownership with any
abutting parcels. For your convenience, enclosed are copies of
. the plan and deeds I have referred to in this letter.

Next, there is the issue of access to LOT 29 from Old King's
Road. The subdivision plan shows a "non-access buffer zone"
along LOT 29's boundary with Old King's Road. I find no indica-
tion that this buffer zone was imposed by the Planning _Board.
The Planning Board Covenant for this subdivision (recorded in
Barnstable Book 1443, Page 712) is simply the standard form of
Planning Board Covenant and makes no reference to this buffer
zone. In addition, a release of the Planning Board Covenant can
be found at Barnstable Book 1537, Page 144.
Finally, Old King's Road is a County way, and I see no logi-
cal reason to restrict driveway access to LOT 29 from it. Neigh-
boring houses front on Old King's Road and have driveway access
from said Road.
If you agree with my conclusion that LOT 29 is a grand-
fathered lot and buildable and that there is no Town limitation
restricting access to said lot from Old King's Road, would you
please so indicate by signing and returning a copy of this let-
ter.

The granted premises are conveyed subject to the following restrictions, f
imposed for the benefit of Purchasera, their heirs, executors, administrators
and assigns, and for the benefit of abutting land now owned by the Grantors.
1. No building; or structures of any kind shall be erected, sited, rain-
tained, altered or used on the granted promises unless plans, specifications,
and location of the proposed structure have boon approved in writing by the
F` Grantors, or their ropresentative, agent, or other person delegated by them for
that purpose.
To secure said approval, Purchasers agree to submit to the Grantors or
their successors in title, a complete set of exterior plans and specifications
showing the exterior dosign, height, and building material of the proposed
structuro, said plans and specifications to become the property of the Grantors
1 or their successors in title. It is the intent of this restriction that any
structure ernetod on the promises shall contain at least one thousand (1,000)
square feet of living area on the first floor, exclusive of garage or porches;
and in addition shall have an attached garage with a minimum storage for one car,_

2. No fence shall be erected on said premises except of a split-rail

RESERVATIONS AND EASDWTS
1. The reserved areas, as shown on the heroinbefore-mentioned plan, as
well as the Drainage Eacomont and Golf Course Easement areas shown on said plan,
shall not be built upon, and shall be maintained for pedestrian use by the sub-
division owners for the benefit of all home owners within Cotuit Country Estates.
2. The buffer-zone areas, fronting on Old Oyster Road, as shown on said
plan, shall not be built upon, and shall be allowed to remain in their natural
state, unless they be landscaped, in trees, or shrubbery, by their respective
owners. No direct access to Old Oyster Road may be had from any lot bordering
thereon.
3. Use of "No Bottom Pond", .as shown on said plan, for bathing, swimming,
boating, or other purposes, shall be by written permission of the Grantors, or
their heirs or assigns, only.
4. The purchaser of the above-described lot shall be entitled to the
services of the subdivision landscape architect, at the expense of the owner,
to prepare a site and landscape sketch plan of the proposed house site, general
grading, cesspool or septio-tank location, location of trees worth saving, and'
recommended planting areas. t

The above parcel of .land is shown as Developers Lot
29 on plan dated November 14, 1968 and recorded' at Barn-
stable Registry of Deeds in Plan Book 229 , Page 51, a copy
of which is enclosed.
This lot was conveyed by the original developer, Ray-
mond D. Crawford and Gwendolyn W. Crawford, to William J.
Wetmore and Marjorie E. Wetmore by deed dated August 12 ,
1969, and recorded ,in Barnstable Re,gistry' of Deeds in Book
1445 , Page 880, a copy of which is enclosed.
The lot has been in separate ownership from the abut-
ting lots since August 12, 1969. and, therefore, in my
opinion, is a grandfathered lot insofar as Barnstable zon-
ing issues are concerned.
You will note on the subdivision .plan the indication
of a non-access buffer zone along Old King's Road. I can
find no indication that this buffer zone was imposed by the
Planning Board since the Planning Board Covenant recorded
in Book 1443, Page 712 , is simply the standard form of
Planning Board covenant, and the 'Planning Board Covenant
was released and recorded in Book 1537, Page 144 .
The deed recorded in Book 1445, Page 880, purports to
impose a no-access; buffer zone on Old Oyster Road but
doesn'-t mention Old King ' s Road. In any event, Old King' s
Road is shown. as a County,.Way and the. Town would logically
have no reason to restrict driveway access from ,Old King' s
Road. ' Neighboring houses fronton Old. King' s Road and have
driveway access from said Road. Y

The granted premises are conveyed subject to the following restrictions,
imposed for the benefit of Purchasers, their heirs, executors, administrators j
and assigns, and for the benefit of abutting land now owned by the Grantors.
1. No building or structures of any kind shall be erected, sited, main-
tained, altered or used on the granted promises unless plans, specifications,
and location of the proposed structuro have boon approved in writing by the 4
Grantors, or their represontative, agent, or other person delegated by them for
that purpose.
To secure said approval, Purchasers agree to submit to the Grantors or
their successors in title, a complote set of exterior plans and specifications
showing the exterior dosign, height, and building material of the proposed
structure, said plans and specifications to become the property of the Grantors
or their successors in title. It is the intent of this restriction that any
structure erected on the promises shall contain at least one thousand (1,000)
square feat of living area on the first floor, exclusive of garage or porches;
and in addition shall have an attached garage with a minimum atorage for one car,.
and a maximum storage for three cars. Purchasers agree that driveways shall be
paved.
2. No fence shall be erected on said premises except of a split-rail
or round-rail type, nor over 3J feet in height. No shrubbery shall be raised or
maintained which may interfere with vision at or near any intersection of ways.
3. No mechanical, manufacturing, or mercantile trade, business .or
profession shall be conducted for profit or otherwise on the granted premises.
No cormercial vehicle of any description shall be parked overnight on any of the
r ways_shovn on the aforesaid plan of land, or on Purchasers' premises, except in-
side a garage.

RESERVATIONS AND EASEMENTS

1. The reserved areas, as shown on the hereinbefore-mentioned plan, as
_ well as the Drainage Enooment and Golf Course Easement areas shown on said plan,
shall not be built upon, and shall be maintained for pedestrian use by the sub-
division owners for the benefit of all home owners within Cotuit Country Estates.
2. The buffer-zone areas, fronting on Old Oyster Road, as shown on said
3 plan, shall not be built upon, and shall be allowed to remain in their natural
t state, unless they be landscaped, in trees, or shrubbery, by their respective
owners. No direct access to Old Oyster Road may be had from any lot bordering

:t 3. Use of "No Bottom Pond", as shown on said plan, for bathing, swimming, 1
boating, or other purposes, shall be by written permission of the Grantors, or
Choir heirs or assigns, only.
4. The purchaser of the above-described lot shall be entitled to the ,
services of the subdivision landscape architect, at the expense of the owner,
to prepare a. site and landscape sketch plan of the proposed house site, general
grading, cesspool or septic-tank location, location of trees worth saving, and'
recommended planting areas.

S. All Purcasers covenant for themselves, their heirs and assigns that
. no agreement for sale of a lot shall be made without making such agreewent sub-
ject to the first re:usal, on the same tor:.:s, by the owners of the subdivision,

written notice to the Grantors of the proposed sale. Me structures and grounds

If a broach or default continues thereaftor, and such proceedings are commenced

fees incurred in such proceedings.

The lion provided for herein shall be subordinate to the lien of any
mortgage given by Purchasers to any bank or other lender;. provided, however,
that any such mortgagee then in possession, and Purchasers at any foreclosure
sale, and all persons claiming under them, shall hold such premises subject to
said lien.
6. Reserving also to the Grantors the right to grant easements to
public utilities, to install and maintain apparatus in, over, under and upon any
