The property at issue is a vacant 0.45 acre lot. According to the application submitted, the undersized lot was rendered un-buildable due to the merger of two undersized lots. The subject lot before the Board is Parcel No. 152 (Developer's Lot 50). The other undersized lot that was involved with this issue is Parcel No. 137 (Developer's Lot 35). That second lot was not brought forth in this appeal. According to the Assessor's Record that lot is developed, owned by Carol W. Sandler, and is addressed 75 Roosevelt Road, Cotuit. � The applicant is seeking relief to permit the development of a 1 & 3/4 story, 3 bedroom single-family dwelling. The foundation measures 40 feet by 28 feet and the estimated gross floor area is 1,960 sq.ft.. The proposed dwelling has been situated on the lot in conformance to required setbacks for the district. A Title 5 on-site septic system has been designed. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on December 20, 2000. An extension of time for holding the hearing and for filing of the decision was executed between the applicants and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened February 21, 2001 and continued to March 21, 2001, at which time the Board granted the special permit requested with conditions. Board Members hearing this appeal were; Dan Creedon, Gail Nightingale, Richard Boy, Jeremy Gilmore and Ron Jansson, Chairman. Ms Kuzyk represented herself at the hearing. She described the incidences that let to the merger of the lot. she noted that they were merged only for 1 month and that the merger was due to family circumstances. The public was invited to speak and no one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of March 21, 2001, the Board unanimously found the following findings of fact as related to • Appeal2001-20: � 1. In Appeal 2001-20 The applicant is Elaine Kuzyk, seeking a Special Permit in accordance with Section 4-4.2(5) -Merged Lots . The property is address 429 Sampson's Mill Rd., Cotuit, MA, as • shown on Assessors Map 039, Parcel 152. It is zoned Residential F and is in the Resource Protection Overlay District. 2. The property at issue is a vacant lot of approximately 0.45 acres. The undersized lot was rendered un-buildable due to the merger of two undersized lots. 3. The subject lot before the Board is Parcel No. 152 (Developer's Lot 50). The other undersized lot that was involved with this issue is Parcel No. 137 (Developer's Lot 35). A Title 5 on-site septic system has been designed for the dwelling. 5. The lot was created by a February 1, 1973 subdivision -Subdivision No. 267. It is identified on that plan as Developer's Lot No. 50. At that time, the area was zoned Residence D-2 requiring 20,000 sq.ft. minimum lot area. The locus was rezoned to Residence F in March of 1973 by Town Meeting Article 159 requiring a minimum lot area of 1 acre. Recent adoption of the Resource Protection Overlay District(RPOD) has now requires a minimum 2 acre lot area for all future new lots. 6. The application falls within a category specifically excepted in the ordinance for a grant of a Special Permit pursuit to Section 4-4.2, Non-conforming Lots. 7. After evaluation of the evidence presented, the proposal fulfills the spirit and intent of the Zoning • Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the applicants' request for a special permit, subject to the following condition: Development of the site shall be in substantial conformance to plans presented to the Board entitled"Title 5 Site Plan of 429 Samson's Mill Road Cotuit Barnstable" prepared for Elaine Kuzyk, dated August 22, 2000 and drawn by Down Cape Engineer, Inc. as well as architectural plans submitted drawn by Devin Custom Designs and dated 4/24/00. A Title 5 on-site septic system has been designed for the dwelling. 5. The lot.was created by a February 1, 1973 subdivision-Subdivision No. 267. It is identified on that plan as Developer's Lot No. 50. At that time, the area was zoned Residence D-2 requiring 20,000 sq.ft. minimum lot area. The locus was rezoned to Residence F in March of 1973 by Town Meeting Article 159 requiring a minimum lot area of 1 acre. Recent adoption of the Resource Protection Overlay District(RPOD) has now requires a minimum 2 acre lot area for all future new lots. 6. The application falls within a category specifically excepted in the ordinance for a grant of a Special Permit pursuit to Section 4-4.2, Non-conforming Lots. 7. After evaluation of the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. She described the incidences that let to the merger of the lot. she noted that they were merged only for 1 month and that the merger was due to family circumstances. The public was invited to speak and no one spoke in favor or in opposition to this appeal. Findings of Fact: F At the hearing of March 21, 2001, the Board unanimously found the following findings of fact as related to Appeal 2001-20: fC 1. In Appeal 2001-20 The applicant is Elaine Kuzyk, seeking a Special Permit in accordance with Section 4-4.2(5)-Merged Lots . The property is address 429 Sampson's Mill Rd.,Cotuit, MA, as shown on Assessor's Map 039, Parcel 152. It is zoned Residential F and is in the Resource Protection Overlay District. 2. The property at issue is a vacant lot of approximately 0.45 acres. The undersized lot was rendered un-buildable due to the merger of two undersized lots. 3. The subject lot before the Board is Parcel No. 152 (Developer's Lot 50). The other undersized lot that was involved with this issue is Parcel No. 137(Developer's Lot 35). That second lot was not brought forth in this appeal. According to the Assessor's Record that lot is developed, owned by Carol W. Sandler, and is addressed 75 Roosevelt Road, Cotuit. 4. The applicant seeks a special permit to allow the development of a 1 &3/4 story, 3 bedroom single- family dwelling. The foundation measures 40 feet by 28 feet and the estimated gross floor area is 1,960 sq.ft. The proposed dwelling has been situated on the lot in conformance to required setbacks for the district. A Title 5 on-site septic system has been designed for the dwelling. 5. The lot was created by a February 1, 1973 subdivision -Subdivision No. 267. It is identified on that plan as Developer's Lot No. 50. At that time, the area was zoned Residence D-2 requiring 20,000 sq.ft. minimum lot area. The locus was rezoned to Residence F in March of 1973 by Town Meeting Article 159 requiring a minimum lot area of 1 acre. Recent adoption of the Resource Protection Overlay District(RPOD)has now requires a minimum 2 acre lot area for all future new lots. 6. The application falls within a category specifically excepted in the ordinance for a grant of a Special Permit pursuit to Section 4-4.2, Non-conforming Lots. 7. After evaluation of the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. - Decision: Based on the findings of fact, a motion was duly made and seconded to grant the applicants' request for a special permit, subject to the following condition: Development of the site shall be in substantial conformance to plans presented to the Board entitled"Title 5 Site Plan of 429 Samson's Mill Road Cotuit Barnstable" prepared for Elaine Kuzyk, dated August 22,2000 and drawn by Down Cape Engineer, Inc. as well as architectural plans submitted drawn by Devin Custom Designs and dated 4/24/00.
