Dear Mr. DaLuz:
With respect to the above captioned lot, Mr. Eliadi has asked me to write to you
relative to the buildability of the lot in question.
The title to the lot was obtained by Mrs. Carol A.~ Eliadi by deed from the Atlantic
Savings Bank dated December 6, 1979. Atlantic Savings Bank had taken title to this
lot, Lot 13 as shown on Land Court Plan 36319-C, among others, by virtue of a
foreclosure on a mortgage given by Atlantic Savings Bank to William E. Dacy, Jr.
On December 6, 1979, the Eliadis bought two lots, Lots 11 and 13. Title to Lot 11
was taken in the name of Konstantin Eliadi and title ,to Lot 13 was taken in the name
of Carol Ann Eliadi .
It is my opinion, based on my review of the title and with the recent release of the
covenant by the Planning Board of the Town of Barnstable, that Lot 13 is a buildable
lot and since December 6, 1979, when the property was purchased from Atlantic Savings
Bank, Lot 13 has not been held in contiguous ownership with any other lot.
I trust that this letter will be sufficient for your purposes, and that a building
permit will therefore issue.
