Zoning Bodd of Appeals Decision and Notice Appeal 2003-153-Fairy Special Permit Findings-MGL Chapter 40A,Section 6 Demolition and Reconstruction on an Undersized Non-conforming Lot gummary: Granted with Conditions Petitioner: Paul C.Farry Property Address: 514 Santuit Road,Cotuit,MA Mapfareel: Map 010,Parcel 010 Ong: Residence F Zoning District Relief Requested&Background: The subject property is located in Cotuit on Santuit Road. The lot is 0.46 of an acre and developed with a one-story,two-bedroom single-£amily dwelling of 624 sq.& The dwelling also has an enclosed porch of 100 sq.ft.and an outdoor patio of 220 sq.ft. According to the Assessor's record the lot was developed in 1950. The applicant proposes to completely demolish and remove the existing house and reconstruct a new single-family dwelling. The proposed new single-family dwelling is a two-story,three-bedroom colonial with an attached two-car garage and a small front porch. The dwelling is to have 1,660 sq.&,the garage 576 sq.ft.and the porch 72 sq.ft. The location of the dwelling conforms to the required 30-foot front and 15-foot side and rear setbacks for the RF District The property is within the AP—Aquifer Protection Overlay District and is not subject to the 330 Rule or Title 5 nitrogen loading regulations. It is not subject to Conservation Commission jurisdiction and the existing structure is not subject to the demolition delay ordinance. Procedural&Hearing Summary: This appeal was filed at the Town.Clerk's Office and at the Office of the Zoning Board of Appeals on October 01,2003. A public hearing before the Zoning Board of Appeals was duly advertised and i notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened December 03,2003,at which time the Board found to grant the appeal. Board Members deciding this appeal were Ralph Copeland,Sheila Geller,Ron S.Janson,Gail Nightingale and Chai=an,Daniel M.Creedon III. Mr.Brian R.Grady of GAF Engineering represented the applicant. Mr.&Mrs.Paul C.Farry were also present. Mr. Grady gave an overview of the lot and ownership history. He stated the proposal is to raze the existing dwelling and reconstruct a new 1,600 sq.&dwelling with an attached 576-sq.ft garage and a 72 sq.ft porch. The existing cesspools would be replaced with a new on-site Title 5 septic system. He noted that the new dwelling would be setback some 65 feet from the street,23 and 48 feet from the side property lines and 80 feet from the teat property line. Mt.Farry stated he contacted his immediate neighbors and they are not in opposition. The Board reviewed the plans and area calculation,noting the dwelling has a footprint of 1,600 sq.ft and that it is to be two levels with a total area for the dwelling to be 3,200 sq.& It was also noted that the existing shed was to remain. j �' 6 ` Bk 18104 Pg 127 #1353 Mr.Farry stated that they have no objections to conditions suggested in the staff report Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of December 03,2003,the Board unanimously made the following findings of fact: 1. Paul C.Farry has applied for Special Permit findings under MGL Chapter 40A,Section 6 to permit the demolition of an existing single-family dwelling and to reconstruct a new single-family dwelling. The property is addressed as 514 Santuit Road,Cotuit,MA in a Residence F Zoning District It is shown on Assessor's Map 019 as Parcel 010. 2. The subject lot is 0.46-antes and developed with a one-story,two-bedroom single-family dwelling of 624 sq.ft The dwelling also has an enclosed porch of 100-sq.ft.and an outdoor patio of 220 sq.ft with no basement The lot was developed in 1950. 3. The applicant proposes to completely demolish and remove the existing house and reconstruct a new single-family dwelling. The proposed new single-family dwelling is a two-story,three-bedrroom colonial with an attached two-car garage and a small front porch. .The dwelling is to have 1660 sq. ft.,the garage 576 sq.ft.,an 830 sq.ft.basement,a 10'x20'deck, and a porch of 72 sq.ft 4. The location of the dwelling conforms to the required 30-foot front and 15-foot side and rear setbacks for the RF District. 5. The new dwelling is a"reconstruction"as that term is used in the"second except"clause of the first sentence of MGL Ch.40A,Section 6. 6. The proposed dwelling does intensify the nonconformity in that it is a larger structure on the non- conforming lot However the proposed new dwelling would not be substantially more detrimental to the neighborhood than the former dwelling because of its modest size. Decision: Based on the findings of fact,a motion was duly made and seconded to grant the appeal for the demolition and reconstruction with expansion of a single-family dwelling on an undersized non- conforming lot The reconstruction shall comply with all setback requirements and is subject to the following conditions: 1. Location of the dwelling shall be as shown on.a plan entitled"Sewage Disposal System Design prepared for Paul Farry located at 514 Santuit Road Barnstable,Mass."Drawn by G.A.F. Engineering,Inc.dated September 21,2003 and revised dated November 21,2003. 2. The dwelling shall be built in conformance to plans and elevations presented to the Board entitled "Choate Colonial"drawn by A J.Feith dated 07/18/03 and consisting of four sheets showing the elevations and first and second floor layout The Chairman will initial and date the plans. 3. The total gross area of the dwelling shall not exceed 3,350 gross sq.ft.,including the deck on the rest,which does not show on the plans,the garage and basement The dwelling is limited to no more than three-bedrooms. 4. The on-site septic system shall be required to meet Title 5 requirements without variance. 5. During all stages in the demolition and reconstruction of the new,dwelling,all vehicles,equipment and materials associated with the demolition/reconstruction shall be required to be located on-site and not within the required setbacks. At no time will any parking,storage or construction materials or items be permitted in the right-of-way of Santuit Road or within 10 feet of the neighboring property except as-may be needed for landscaping purposes or for utilities and then only on a temporary basis. No parking of vehicles on Santuit Road shall be permitted during construction. 7. All mechanical equipment associated with the dwelling(air conditioners;electric generators,etc) shall be located so as to conform to the required setbacks for the district and screened from neighboring homes and the public right-of-way. 8. The dwelling,attached garage,covered porches,and deck shall be considered full build-out for the lot and it shall not be expanded in area or in footprint nor shall any other accessory structure other than the existing shed be permitted without further permission from the Zoning Board of Appeals. 9. This decision,once issued and after the appeal period has expired,must be recorded at the registry of deeds and a copy of that recorded document must be submitted to the Zoning Board of Appeals Office and to the Building Division before any demolition or building permit shall be issued. The relief authorized must be executed within one year of the granting of this permit. The applicant proposes to completely demolish and remove the existing house and reconstruct a new single-family dwelling. The proposed new single-family dwelling is a two-story,three-bedroom colonial with an attached two-car garage and a small front porch. The dwelling is to have 1660 sq. ft., the garage 576 sq. ft., an 830 sq. ft.basement, a 10'x20' deck, and a porch of 72 sq. ft. 4. The location of the dwelling conforms to the required 30-foot front and 15-foot side and rear setbacks for the RF District. 5. The.new-dwelling is a"reconstruction" as that term is used in the"second except" clause of the first sentence of MGL Ch..40A, Section 6. 6. The proposed dwelling does intensify the nonconformity in that it is a larger structure on the non- conforming lot. However the proposed new dwelling would not be substantially more detrimental to the neighborhood than the former dwelling because of its modest size. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the appeal for the demolition and reconstruction with expansion of a single-family dwelling on an undersized non- conforming lot. The reconstruction shall comply with all setback requirements and is subject to the following conditions: 1. Location of the dwelling shall be as shown on a plan entitled"Sewage Disposal System Design prepared for Paul Farry located at 514 Santuit Road Barnstable,Mass." Drawn by G.A.F. Engineering, Inc. dated September 21,2003 and revised dated November 21,2003. 2. The dwelling shall be built in conformance to plans and elevations presented to the Board entitled "Choate Colonial' drawn by A J. Feith dated 07/18/03 and consisting of four sheets showing the elevations and first and second floor layout. The Chairman will initial and date the plans. 3. The total gross area of the dwelling shall not exceed 3,350 gross sq. ft.,including the deck on the rear,which does not show on the plans, the garage and basement. The dwelling is limited to no more than three-bedrooms. 4. The on-site septic system shall be required to meet Title 5 requirements without variance. 5. At no time will any parking, storage or construction materials or items be permitted in the right-of-way of Santuit Road or within 10 feet of the neighboring property except as may be needed for landscaping purposes or for utilities and then only on a temporary basis. No parking of vehicles on Santuit Road shall be permitted during construction. 7. All mechanical equipment associated with the dwelling (air conditioners, electric generators, etc.) shall be located so as to conform to the required setbacks for the district and screened from neighboring homes and the public right-of-way. 8. The dwelling,attached garage, covered porches, and deck shall be considered full build-out for the lot and it shall not be expanded in area or in footprint nor shall any other accessory structure other than the existing shed be permitted without further permission from the Zoning Board of Appeals. 9. This decision,once issued and after the appeal period has expired,must be recorded at the registry of deeds and a copy of that recorded document must be submitted to the Zoning Board of Appeals Office and to the Building Division before any demolition or building permit shall be issued. The proposed home is a modular frame structure manufactured by Westchester Modular Homes, Inc. It has the appearance of a three quarter Colonial-style structure with an attached two-car garage, You have provided me with plans for the project dated July 13, 2003, with a revision date of August 6, 2003, 1 understand that the garage foundation and the main house foundation were placed at different times, and that they do not meet in full width joint. Although it is permissible to have a cold joint between adjacent elements of a structure, l recommend strongly that you provide a positive attachment between them to ensure there is no differential deflection of settlement across the joint. Y recommend that you install a series of steel angle clips on both the inside and outsie of the joint, 'rhese clips should be fastened to the concrete of both the garage and the main house with 5/8" threaded rod set in an epoxy grout, 1 recommend that you install these clips at 24" on center, and staged them in elevation from inside to outside of the joint. The lot is 0.46 of an acre and developed with a one-story, two-bedroom single-family dwelling of 624 sq.ft. The dwelling also has an enclosed porch of 100 sq.ft:and an outdoor patio of 220 sq.ft. According to the Assessor's record the lot was developed in 1950. The applicant proposes to completely demolish and remove the existing house and reconstruct a new single-family dwelling. The proposed new single-family dwelling is a two-story, three-bedroom colonial with an attached two-car garage and a small front porch. The dwelling is to have 1,660 sq.ft., the garage 576 sq.ft. and the porch 72 sq.ft. The location of the dwelling conforms to the required 30-foot front and 15-foot side and rear setbacks for the RF District. The property is within the AP—Aquifer Protection Overlay District and is not subject to the 330 Rule or Title 5 nitrogen loading regulations. Procedural& Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 01, 2003. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened December 03, 2003, at which time the Board found to grant the appeal. Board Members deciding this appeal were Ralph Copeland, Sheila Geiler, Ron S.Jansson, Gail Nightingale and Chairman, Daniel M. Creedon III. Mr. Brian R. Grady of GAF Engineering represented the applicant. Mr. &Mrs. Paul C. Farry were also present. Mr. Grady gave an overview of the lot and ownership history. He stated the proposal is to raze the existing dwelling and reconstruct a new 1,600 sq.ft. dwelling with an attached 576-sq. ft. garage and a 72 sq.ft. porch. The existing cesspools would be replaced with a new on-site Title 5 septic system. He noted that the new dwelling would be setback some 65 feet from the street, 23 and 48 feet from the side property lines and 80 feet from the rear property line. Mr. Farry stated he contacted his immediate neighbors and they are not in opposition. The Board reviewed the plans and area calculation, noting the dwelling has a footprint of 1,600 sq.ft. and that it is to be two levels with a total;area for the dwelling to be 3,200 sq.ft. It was also noted that the existing shed was to remain. Mr. Farry stated that they have no objections to conditions suggested in the staff report. Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of December 03, 2003, the Board unanimously made the following findings of-fact: 1. Paul C. Farry has applied for Special Permit findings under MGL Chapter 40A, Section 6 to permit the demolition of an existing single-family dwelling and to reconstruct a new single-family dwelling. The property is addressed as 514 Santuit Road, Cotuit, MA in a Residence F Zoning District. It is shown on Assessor's Map 019 as Parcel 010. 2. The subject lot is 0.46-acres and developed with a one-story, two-bedroom single-family dwelling of 624 sq. ft. The dwelling also has an enclosed porch of 100-sq. ft. and an outdoor patio of 220 sq. ft with no basement. The lot was developed in 1950. 3. The applicant proposes to completely demolish and remove the existing house and reconstruct a new single-family dwelling. The proposed new single-family dwelling is a two-story, three-bedroom colonial with an attached two-car garage and a small front porch. The dwelling is to have 1660 sq. ft., the garage 576 sq. ft., an 830 sq. ft. basement, a 10'x20' deck, and a porch of 72 sq. ft. 4. The location of the dwelling conforms to the required 30-foot front and 15-foot side_ and rear _ setbacks for the RF District. 5. The new dwelling is a"reconstruction" as that term is used in the "second except" clause of the first sentence of MGL Ch. 40A, Section 6. 6. The proposed dwelling does intensify the nonconformity in that it is a larger structure on the non- conforming lot. However the proposed new dwelling would not be substantially more detrimental to the neighborhood than the former dwelling because of its modest size. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the appeal for the demolition and reconstruction with expansion of a single-family dwelling on an undersized non- conforming lot. The reconstruction shall comply with all setback requirements and is subject to the following conditions: 1. Location of the dwelling shall be as shown on a plan entitled "Sewage Disposal System Design prepared for Paul Farry located at 514 Santuit Road Barnstable, Mass." Drawn by G.A.F. Engineering, Inc. dated September 21, 2003 and revised dated November 21, 2003. 2. The dwelling shall be built in conformance to plans and elevations presented to the Board entitled "Choate Colonial" drawn by A J. Feith dated 07/18/03 and consisting of four sheets showing the elevations and first and second floor layout. The Chairman will initial and date the plans. 3. The total gross area of the dwelling shall not exceed 3,350 gross sq. ft.,including the deck on the rear; which does not show on the plans, the garage and basement. The dwelling is limited to no more than three-bedrooms. , 3 4. The on-site septic system shall be required to meet Title 5 requirements without variance. 5. Construction shall comply with all applicable Building Division requirements. 2 i 6. During all stages in the demolition and reconstruction of the new dwelling, all vehicles, equipment and materials associated with the demolition/reconstruction shall be required to be located on-site and not within the required setbacks. At no time will any parking, storage or construction materials or items be permitted in the right-of-way of Santuit Road or within 10 feet of the neighboring property except as may be needed for landscaping purposes or for utilities and then only on a temporary basis. No parking of vehicles on Santuit Road shall be permitted during construction. 7. All mechanical equipment associated with the dwelling (air conditioners, electric generators, etc.) shall be located so as to conform to the required setbacks for the district and screened from neighboring homes and the public right-of-way. 8. The dwelling, attached garage, covered porches, and deck shall be considered full build-out for the lot and it shall not be expanded in area or in footprint nor shall any other accessory structure other than the existing shed be permitted without further permission from the Zoning Board of Appeals. 9. This decision, once issued and after the appeal period has expired, must be recorded at the registry of deeds and a copy of that recorded document must be submitted to the Zoning Board of Appeals Office and to the Building Division before any demolition or building permit shall be issued. Advance planning for the arrival and locating of crane and module transporter units will allow for minimal installation time requirements . Individual builders , site conditions, weather and availability of utilities for heat and Power tools will vary the exact sequence in which the finishing work is to be completed, First efforts should be directed toward weather- Proofing the units as soon as possible , Afterwards , make all electrical connections at the two ) unction boxes and turn on the electrical power , Heat can be turned on as soon as structural and plumbing connections have been completed, Basement and garage floors should be poured rior to delivery of the units to allow early completion of basement stairways and easier unit and garage erection , Unpoured floors J Increase reaching distances and make setting operations more dangerous and difficult . Unpoured garage floors make the setting of two-car garage headers most difficult for builders because of beam height.
