Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract of hire, express or implied,oral or written." An employer is defined as"an individual,partnership,association,corporation or other legal entity,or any two or more of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the receiver or trustee of an individual,partnership,association or other legal entity,employing employees. DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two- family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required'shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons.'I i this case;our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. See the notes that have been added to the engineered plan for same. The scope of the work is as you requested when we met in April. Repair only to the existing walls and roof. Sistering walls with PT studs and PT plywood and covering existing floor with PT. As you said,PT to the top plate. This structure is on the original footprint and has used the original footings. This portion of the house will be for storage only. No electric or plumbing of any kind. 2 feet of the existing deck on the water side and the entire small deck to the right must be removed to meet the Notice of Conditions from Conservation. There will still be 4 foot deck on the water side still using only the existing footprint. I have attached photos also for clarification of project on site. The proposed project seeks approval for 1 cottage rehabilitation(initiated without permits and stopped in progress by Conservation Commission enforcement action) and 2) a redesigned pile supported pier to replace the existing floating pier. The pier was never permitted, and is hence illegal. It was the subject of a 1997 enforcement order,requiring the pier to be removed. That Order was not complied with, as photo evidence in the record indicates. 2. All existing piers in the Town were required to come through the Commission's amnesty permitting program(late 1980's into the early 1990's). Hundreds of the existing piers were applied for and received Orders of Conditions in this program, which ran parallel to the.MA DEP's Chapter 91 Waterways amnesty licensing program. A permit for the subject pier was never applied for, at the local level anyway. 3. The summated plan doesn't provide bathymetric survey information based upon a Mean Low Water datum, which is the only acceptable"language"for local and state pier permitting. Instead the consultants for the project provides (and the Commission asked to accept)a factor for converting the NGVD based soundings to mean low water. The Commission finds this approach both unusual and unacceptable. The task of producing MLW-based plan is one that rightfully belongs to the project surveyor. As the plan currently exists the Commission can only speculate as to whether the proposed pier conforms with Commission regulation governing pier length and depth. Decision for pier: The proposed pier is denied without prejudice under MGL Ch 131 Sec 40 and Article 27 of the Town of Barnstable General By-laws due to insufficient information. Herbicide,pesticide and fertilizer use is discouraged on lawns within Conservation Commission jurisdiction. I p.4.2 a �J PROJECT DESCRIPTION MYCOCK COTTAGE "1 The Mycock site is a lot of t0.17 acres lying northerly of Santuit Road and abutting the waters of Shoestring Bay in the village of Cotuit. It is bounded to the east by a town landing with its dirt surfaced, informal parking area, and to the southwest by Town Conservation Land deed restricted to open space but also utilized as a boat launching ramp and with a small boat pier. The site is developed with a modest, one-story single family dwelling, driveway, cesspool and floating pier system. According to local historian Jim Gould, the original structure, a fish shanty, " was relocated to the site between 1920 and 1930. In 1946,Ned Crosby bought the land and shack from Edgar Lovell. He added a small garage or a carriage house brought from a site in Newton and connected it with an addition to the fish shanty. Sometime in the 1960s,the south bedroom was added, resulting in the footprint now at the site. Frederick Mycock, the current owner, acquired the site in 1975. The site includes: Land Under Water, which may also contain shellfish; Salt Marsh; and a small unvegetated Beach. The entire site is below the FEMA established 100 yr. flood elevation of I F NGVD. It is too flat and low to include any Coastal Bank. It is not mapped by MNHP as harboring rare plants or animals and none have been observed at the site during field activities _.J attendant to permitting. The salt marsh is restricted by MDEM under MGL 130 s 105. Based on 1 SCS and USGS soils mapping,the site has not been filled. The Protect includes work necessary for rehabilitation of the cottage. As noted earlier, the residence is currently serviced by a cesspool. It appears to be functioning with no reported backup into the house and no apparent overflow in the yard. Considering the surface grade at the cover—t4.5'—and the fact that it is±34' from the adjacent wetland, it is likely that, were a code related inspection to be performed, it would fail due to lack of groundwater separation and landscape position. Such an inspection is not currently mandated by Code. However,the applicant is mindful of the environmental sensitivity of the area and proposes to replace the cesspool with a tight tank. This facility would be located in the southerly corner of the site in an area currently maintained as lawn. Variances will be sought for its use. The reside itselffr significant maintenance. The "garage" section in the southeast wing a ways had a plank floo he applicant would like to replace this arrangement with a poured concrete e northeast wing,which is generally described as the "boathouse" but has housed living space since prior to the Mycock ownership. i y� 1 This is confirmed by the 1973 Assessor's Card (Exhibit H)which shows the limits of the garage. This space was in the process of being reconstructed when an Enforcement Order, resulting in this filing, was issued. The north wall has yet to be replaced. The original foundation is visible beneath the deck which it now supports. The westerly portion of the deck was widened by 4'to a total of 8' as part of the recent work. We are proposing to return it to its original 4'width. We are also requesting permission to replace siding and roofing,paint and maintain other portions of the structure in-place and in-kind as necessary from time to time. Negotiations with the Building Department will determine whether/how the foundation or other internal repairs will be required to meet Code. Lastly,the applicant intends to replace the assemblage of floats currently P p g serving as his dinghy , dock with a 3x44'post supported walkway and two floats (7%x 16 and 8%2x 12)with a short ramp. The floats and ramp,will be secured by 4-12" diameter piles. The new elevated walkway will extend from the beach area to the marsh and over the marsh to the water. Approximately 30'of the walkway is seaward of MHW,thereby constituting a pier for purposes of Chapter 91. The structure extends f42'beyond MLW. The property appears to be f74%2' wide at MHW. This makes the system f4'/z' longer than the Commission's current regulations. However, the system is no longer than the system it replaces which has been at the site±30 years and has a somewhat smaller footprint(26 s.f. smaller from MLW out). Other benefits of the replacement structure are reduced impacts to the salt marsh and to land under water, since the structure will no longer ground out in those resource areas. Impacts The elimination of the non-compliant cesspool will provide benefits for water quality, fisheries l and shellfish issues. The existing structure has.apparently withstood all record storms since its initial location at the site including the 1938, 1944, 1954 hurricanes and Hurricane Bob of 1991. Flood waters do, however, wash through the structure. Currently,proposed improvements will add to its structural integrity. Work will conform to requirements of the Building Commissioner. It is possible that an exemption from Section 3-5.1 of the Zoning Ordinance may be sought but it is currently believed not to be required. The pier modifications will_as noted above, P o e, have beneficial impacts of salt marsh integrity. New . sections of the structure will be non-CCA treated; a benefit for fisheries and shellfisheries. Local Ordinance interests not covered by 131/40 include erosion control. Siltation controls will be established as shown on the plan prior to work on the septic system. These controls will be kept in place until revegetation is complete. The Ordinance also considers historic and aesthetic interests. The building at the site has a place in the mosaic of Cotuit Village, having existed since early in the last century. It's maintenance helps to illustrate the nature of development through some of the more economically difficult portions of our history. Clearly, fewer and fewer such structures will continue to exist as property value increases make the maximization of investment an inevitable part of our culture. It would be unfortunate to either require it to be upgraded in a way which masks its historic flavor or, alternatively, to prohibit its maintenance thereby ensuring its loss, such as was the case with the Cobb Boathouse. Lastly, we would point out that 310 CMR 10.24(7)(C)(2) suggests that the "maintenance, repair and improvement(but not substantial enlargement) of structures, including buildings, piers, ...which existed on November 1, 1987..." may be treated as limited projects provided the work has no adverse impact on rare species habitat. I1. Prior to the start of work,the following conditions shall be satisfied: 1. Within one month of receipt of this Order of Conditions and prior to the commencement of any work approved herein, General Condition number 8 (recording requirement)on page 3 shall be complied with. 2. It is the responsibility of the applicant,the owner and/or successor(s)and the project contractors to ensure that all conditions of this Order are complied with. The applicant shall provide copies of the Order of Conditions and approved plans(and any approved revisions thereof)to project contractors prior to the start of work. Barnstable Conservation Commission Forms A and B shall be completed and returned to the Commission prior to the start of work 3. General Condition 9 on page 3(sign requirement)shall be complied with. 4. The Conservation Commission shall receive written notice 1 week in advance of the start of work. 5. The work limit line shown on the approved plan shall be staked in the field by the project surveyor/engineer. 6. Staked strawbales backed by trenched-in siltation fencing shall be set along the approved work limit line. Effective sediment controls shall remain until the site is stabilized with vegetation. 7. A sequence of color photographs showing the undisturbed buffer zone shall be submitted to the Conservation Commission. Note:the strawbales and siltation fence must show in the foreground(or bottom of) the photographs. 8. The Natural Resources Dept.shall be notified at least 21 working days prior to the start of work at the site,to inspect the areas for shellfish. If deemed necessary by the Shellfish Constable,shellfish shall be removed from the work area to a suitable site and/or,replanted at the locus following construction. The foregoing measures for shellfish protection shall ensue at the expense of the applicant p.4.1 III. The following additional conditions shall govern the project once work,begins. 9. General conditions No. 12 and No. 13(changes in plan)on page 3 shall be complied with. 10. General condition No. 17(maintaining sediment controls)on page 4 shall be complied with. 11. The work limit shown on the approved plan shall be strictly observed. 12. There shall be no disturbance of the site,including cutting of vegetation,beyond the work limit. This restriction shall continue over time. 13. The Conservation Commission,its employees,and its agents shall have a right of entry to inspect for compliance with the provisions of this Order of Conditions. 14. This permit is valid for 3 years from the date of issuance, unless exterided by the Commission at the request of the applicant.Caution: a future Amended Order does not change the expiration date. 15. This approval is contingent upon the approval by the Board of Health of the subsurface sewage disposal system. 16. Any fill used for this project shall be clean fill. Any fill shall contain no trash,refuse,rubbish;or debris. 17. Construction shall conform to the requirements of the State Building Code and the Town of Barnstable Zoning By-law Flood Area Provisions for construction within the coastal floodplain. Work shall ensue only after consulting with the Building Commissioner. 18. Drywells or graveled trenches along the drip lines shall be installed to accommodate roof runoff. 19. The restoration of the`dirt area' consistent with the protocols given in the plan notes. 20. The unauthorized stone groin shall be removed as shown on the approved plan. 21. Herbicide,pesticide and fertilizer use is discouraged on lawns within Conservation Commission jurisdiction. If fertilizer is used,only slow-release low-nitrogen fertilizer shall be applied. Over-fertilizing shall be avoided. 22. Work limit markers(wood stakes)shall remain until a Certificate of Compliance is issued for this project. 23. A knee-high rail fence(or approved alternative)shall be constructed and maintained along the"limit of wetland vegetation"line shown on the plan on the seaward side of the property. For the pier... 24. No CCA-treated or creosote-treated materials shall be used. 25. Deck plan spacing shall be at least one half inch. 26. Work shall occur during the off-season only: October 15 through May 1. 27. No dredging(including.but not limited to effects of propeller wash)is permitted herein. Deepening the berth by propeller scouring is strictly prohibited under this Order. 28. The seasonal storage of floats shall be at a suitable upland site. This license will expire thirty (30) years from the date of license issuance. By written request of the licensee for an amendment, the Department may grant a renewal for the term of years not to exceed that authorized in the original license. The existing stone groin shown on License Plan No. 11888 shall be removed in its entirety within three(3)years of the issuance date of this license Special Waterways Conditions r In accordance with any license condition,easement,or other public right of lateral passage that exists in the area of the subject property lying between the high and low water marks, the Licensee shall allow the public in the exercise of such rights to pass freely over all structures within such intertidal area. Accordingly, the Licensee shall place and maintain, in good repair, a public access sign on both the easterly and westerly sides of the pier authorized herein, adjacent to the mean high water shoreline. Said signs,provided by the Department,shall be posted immediately upon receipt. Nothing in this condition shall be construed as preventing the Licensee from excluding the public from portions of said structure(s)or property not intended for lateral passage. In partial compensation for private use of structures on tidelands of the Commonwealth,which interferes with the rights of the public to use such lands,the Licensee shall allow the public to pass on foot,for any purpose and from dawn to dusk, within the area of the subject property lying seaward of the high watermark. This condition shall not be construed to prevent the Licensee from taking reasonable measures to discourage unlawful activities by users of the area(s)intended for public passage, including but not limited to trespassing on the adjacent private areas and deposit of refuse of any kind or nature in the water or on the shore. Further, the exercise by the public of free on-foot passage in accordance with this condition shall be considered a permitted use to which the limited liability provisions of M.G.L.c.21,s.17c apply. No dredging(including,but not Iimited to the effects of prop wash)is permitted herein. No motorized vessels shall be use or berthed at the pier,ramp or float When removed,all seasonal structures shall be stored landward of the mean high water shoreline and outside of wetland resource areas. Said storage shall be in conformance with any applicable local,state or federal requirements. All work authorized herein shall be completed within five (5) years of the date of Iicense issuance. Said construction period may be extended by the Department for one or more one year periods without public notice, provided that the Applicant submits to the Department,thirty(30)days prior to the expiration of said construction period,a written request to extend the period and provides an adequate justification for said extension. Within sixty(60) days of completion of the licensed project,the Licensee shall request, in writing, that the Department issue a Certificate of Compliance in accordance with 310 CMR 9.19. That request shall be accompanied by a certification by registered professional engineer licensed in the Commonwealth that the project was completed in accordance with the License. Acceptance of this Waterways License shall constitute an agreement by the Licensee to conform with all terms and conditions stated herein. 2. This License is granted upon the express condition that any and all other applicable authorizations necessitated due to the provisions hereof shall be secured by the Licensee prior to the commencement of any activity or use authorized pursuant to this License. 3. Any change in use or any substantial structural alteration of any structure or fill authorized herein shall require the issuance by the Department of a new Waterways License in accordance with the provisions and procedures established in Chapter 91 of the Massachusetts General Laws. Any unauthorized substantial change in use or unauthorized substantial structural alteration of any structure or fill authorized herein shall render this Waterways License void. 4. This Waterways License shall be revocable by the Department for noncompliance with the terms and conditions set forth herein. This license may be revoked after the Department has given written notice of the alleged noncompliance to the Licensee and those persons who have filed a written request for such notice with the Department and afforded them a reasonable opportunity to correct said noncompliance. Failure to correct said noncompliance after the issuance of a written notice by the Department shall render this Waterways License void and the Commonwealth may proceed to remove or cause removal of any structure or fill authorized herein at the expense of the Licensee, its successors and assigns as an unauthorized and unlawful structure and/or fill. 5. The structures and/or fill authorized herein shall be maintained in good repair and in accordance with the terms and conditions stated herein and the details indicated on the accompanying license plans. 6. Nothing in this Waterways License shall be construed as authorizing encroachment in,on or over property not owned or controlled by the Licensee,except with the written consent of the owner or owners thereof. 7. The proposed project seeks approval for 1,cottage rehabilitation(initiated without permits and stopped in progress by Conservation Commission enforcement action)and 2)a redesigned pile supported pier to replace the existing floating pier. The pier was never permitted, and is hence illegal. It was the subject of a 1997 enforcement order,requiring the pier to be removed. That Order was not complied.with,as photo evidence in the record indicates. 2. All existing piers in the Town were required to come through the Commission's amnesty permitting program (late 1980's into the early 1990's). Hundreds of the existing piers were applied for and received Orders of Conditions in this program, which ran parallel to the MA DEP's Chapter 91 Waterways amnesty licensing program. A permit for the subject pier was never applied for, at the local level anyway. 3. The summated plan doesn't provide.bathymetric survey information based upon a Mean Low Water datum, which is the only acceptable"language"for local and state pier permitting. Instead the consultants for the project provides (and the Commission asked to accept) a factor for converting the NGVD based soundings to mean low water. The Commission finds this approach both unusual and unacceptable. The task of producing MLW-based plan is one that rightfully belongs to the project surveyor. As the plan currently exists the Commission can only speculate as to whether the proposed pier conforms with Commission regulation governing pier length and depth. Decision for pier: _ The proposed pier is denied without prejudice under MGL Ch 131 Sec 40 and Article 27 of the Town of Barnstable General By-laws due to insufficient information. The existing stone groin shown on License Plan No. 11888 shall be removed in its entirety within three (3) years of the issuance date of this license Special Waterways Conditions In accordance with any license condition,easement, or.other public right of lateral passage that exists in the area,of the subject property lying between the high and low water marks, the Licensee shall allow the public in the exercise of such rights to pass freely over all structures within such intertidal area. Accordingly, the Licensee shall place and maintain, in good repair, a'public access sign on`both the easterly and westerly sides of the pier authorized herein,. adjacent to the mean high water shoreline. Said signs, provided by the Department, shall be posted immediately upon receipt. Nothing in this condition shall be construed as preventing the Licensee from excluding the public from portions of said structure(s)or property not intended for lateral passage. In partial compensation for private use of structures on tidelands of the Commonwealth, which interferes with the rights of the public.to use such lands, the Licensee shall allow the public to pass on foot, for any purpose and from dawn to dusk, within the area of the subject property lying seaward of'the high water mark. This condition shall not be construed to prevent the Licensee from taking reasonable measures.to discourage unlawful activities by users of the area(s)intended for public passage, including but not limited to trespassing on the adjacent private areas and deposit of refuse of any kind or nature in the water or on the shore. Further, the exercise by the public of free on-foot passage in accordance with this condition shall be considered a permitted use to which the limited liability provisions of M.G.L. c.21,s.17c apply. No dredging(including,but not limited to the effects of prop wash)is pernvtted herein. No motorized vessels shall be use or berthed at the pier,ramp or float. When removed, all seasonal structures shall be stored landward of the mean high water shoreline and outside of wetland resource areas. Said storage shall be in conformance with any applicable local,state or federal requirements. All work authorized herein shall be completed within five (5) years of the date of license issuance. Said construction period may be extended by the Department for one or more one year periods without public notice, provided that the Applicant submits to the.Department,thirty(30) days prior to the expiration of said construction period,a written request to extend the period and provides an adequate justification for said extension. Within sixty (60) days of completion of the.licensed project, the Licensee shall request, in writing, that the Department issue a Certificate of Compliance in accordance with 310 CMR 9.19. That request shall be accompanied by a certification by registered professional engineer licensed in the Commonwealth that the project was completed in accordance with the: License. Acceptance of this Waterways License shall constitute an agreement by the Licensee to conform.with all terms and conditions stated herein. 2. This License is granted upon the express condition that any and all other applicable authorizations necessitated due to the provisions hereof shall be secured by the Licensee prior to the commencement of any activity or use authorized pursuant to this License. 3. Any change in use or any substantial structural alteration of any structure or fill authorized herein shall require the issuance by the Department of a new Waterways License in accordance with the provisions and procedures established in Chapter 91 of the Massachusetts General Laws.
