RE: Mycock Family Trust Plan, Route 28, Cotuit
Gentlemen:
An opinion has been requested concerning the issuance of building permits
on subdivision plan of land in Barnstable, MA owned by Mycock Family Trust
dated October 27, 1983 James b. Wilkins, registered land surveyor. Said
plan is an Approval Not Required plan signed by the Planning Board on
November 28, 1983.
Section 6 of M.G.L. Chapter 40A, Approval Not Required Plan Exemption, states:
"When a plan referred to Section 81P of Chapter 41 has been submitted
to a �planning board and written notice of such submission has been
given to the city or town clerk, the use of the land shown on such
plan shall be governed by applicable provisions of the zoning ordinance
or by-law in effect at the time of submission of such plan. . . . . . . . . . . .
. . . . .and for a period of three years from the date of endorsement by
the planning board that approval under the subdivision control law is
not required, or words of similar import."
The zoning district at the time of approval was Business Limited C. Under
Section K, Use Regulations-Non-Residence Districts, paragraph 4, sub-para-
graph b. states as a permitted use:
b. Small retail businesses common to a residence district.
With the required agency approvals and review of plans for zoning approvals,
a building permit could be issued.
