'The, zoning distrai"ct in which the premises are .located is RF. - Mrs., Irwin and her now deceased husband took, title' to the property in 1940... Thereafter, ;Mrs. Irwin tra:nsfered -the property to 'Mr . and Mrs . Aearse in 1.970 There have always been two bui;l dings on the property since the purchase of the land by the Irwins in 1940 . Throughout the sp ,tiod that., the .Irw 1 ns have owned the property, they have a1w,ays. utilized..bot-h, dwellings. During the 194.0 's the family would occupy the 'Train house during the fall, winter and spring and would movie to. the :cottage. during the summer months . Around 1950, the- family ceased living, in the cottage during the summer and ;rented, Iti to non-family members T.he : family remained in the, ma in house continsuing to use it as a single family family residence. This use of 'the property continued up to 1970, at which time the Petitioners ga1n.e.d title to the property.. In 1971 , Lawrence S. Bearse filed a. petition for a variance for the purpose of obtaining permission to -r.:e:model the t e summer. cottage for use as a permanent in-law apartment. At that. time, the Petitioner presented to the Board of Appeals a plan which showed :a .lot containing 1.3,047 sq. ft:. fronting on School Street , Cotuit, which had two (2.): 'existing buildings.;, The main dwelling was occupied` by the Petitioners and the cottage had been used, as. a summer cottage. The Petitioner proposed to install a ba-sement, under the existing cottage building. which would contain a central heating unit and ,to replace windows and doors where needed It was the intention of the Petitioners, upon completion, to use the pr.emise-s .as a separate dwelling for his mother-in-law, Mrs. Iwin'. The Roa'rd' of Appeals found that the, remodeling of the existing cottage for ,a year-,raund dwelling Wo',uld not be detrimental 'to the neghbor'hoo:d.
