The lots in question border on Grove and School Streets in Cotuit. The lots are located in the RF Zoning District,where there Is a minimum lot size of 1.00 acre and minimum frontage requirement of 150'. The applicant wishes both lots to be considered buildable under zoning after the re-division Is complete. Presently,the lot fronting on Grove St.is 1.47 acres, and the lot fronting on School St.is 0.5 acres. After the re-division,the lot fronting on Grove St.is proposed to be 1.00 acre(Lot C),while the lot on School St.will be 0.83 acres(lots A and B combined). The lot on School St.has 106.4' frontage. The lot on School St. has been owned by Richard Parker since 1973. He has owned the contiguous lot on Grove St. since 1974. There was a zoning change to minimum 1 acre lot size in Cotuit in 1973. State Law,MGL Chapter 40 A Section 6,would have required the undersized lot to be combined with the larger acreage for the purposes of zoning. While Assessor's records show land area total of the two parcels 1.97 acres, it should be noted that the plan prepared by Baxter 8 Nye shows the actual area to be 1.83 acres. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Oiioe of the Zoning Board of Appeals on February 28,1998. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on May 01, 1996,at which time the Board found to Grant the Variance. Board members hearing this appeal were Ron Janson,Richard Boy, Emmett Glynn,Gene Burman,and Chairman Gail Nightingale. Hearing Summary: Attorney John Alger represented the petition before the Board. Attorney Alger explained the history of the lots-Map 20, Parcel 134 and Parcel 108 have merged due to the requirements of MGL Chapter 40A and the Increase requirements of minimum lot area under zoning. A neighboring Parcel 135 was bought In 1963 by Mrs.Parker,the applicant's mother. She presently lives within the. dwelling developed on that lot. in 1988 she sold It to Richard Parker(her son)through a Life Estate. Parcel 134 was bought in 1964 by Mrs.Parker as a vacant lot and sold to Richard Parker in 1974. That lot is still vacant and the subject lot of this petition. Parcel 108 was bought on June 6, 1974 by Richard Parker and his wife. In 1992,his wife conveyed Parcel 108 back to Richard. As of today,Richard Parker owns Parcel 108 and Parcel 134 in his own name. He also owns Parcel 135,however,it is In a life estate for his mother and she is in complete control of that lot. The Variance is a request to re-divide two existing lots,one of which is nonconforming in size and frontage,the other Is not.
