Dear Mr. Davies,
This letter is in response to your inquiry as to the builability of the above referenced
` property. While I agree this lot meets the requirements of§4-4.2 (1) of the Zoning
Ordinance, this lot is not buildable. In 1986 there was a request for a variance from the
Zoning Board of Appeals to build on an undersized lot. The variance was denied because
the Board found the lot was not buildable. The specific reasons for this I cannot say, I
would suggest you have your attorney research this. However, by looking at the tax bills
for this property, it is clear this property was never taxed as a buildable lot.
In accordance with MGL Chapter 40A§8, you have the right to appeal this decision to the
Zoning Board of Appeals within thirty days of receipt of this letter.
If you decide to appeal my decision this office is willing to assist you in this process.

Please accept this letter as an attorney's affidavit as required by the
Building Permit Procedures for a New House.
I have enclosed for filing, the documentation to support the contention that
the lot in question, Lot 3 as shown on the.1994 Assessor's Map 34, is in
compliance with the Barnstable Zoning Ordinance Section 4-4.2, specifically
Section 4-4.2 1 .
I have reviewed the titles-of the abutting properties as well as the subject
properly and hereby certify that the Lot 3 as shown on Map 34 of Barnstable
Assessors' is in compliance with Barnstable Zoning Ordinance Section 4-4.2(1).
This letter serves as an affidavit-of compliance and the facts set forth
herein are true and accurate and are offered
based on personal and belief.
